BJP MP Kangana Ranaut's Plea Rejected By High Court In Defamation Case

The Punjab and Haryana High Court on Friday dismissed a plea of BJP MP Kangana Ranaut seeking quashing of a defamation complaint against her and the summoning order by a court in Bathinda.
The actor-turned-politician had challenged the defamation case which stemmed from her retweet consisting of her own comment about the complainant during the 2020-21 farmer protests against the now repealed farm laws.
The complaint was filed by Mahinder Kaur (73) of Bahadurgarh Jandian village in Punjab's Bathinda district in 2021.
She had alleged that Kangana Ranaut defamed her in the tweet by identifying her wrongly as Bilkis Bano of Shaheen Bagh fame.
Kangana Ranaut shared the tweet alleging that the 'Shaheen Bagh dadi' also joined the farmers' agitation at various border points of the national capital.
"There are specific allegations against the petitioner who is a celebrity, that false and defamatory imputations by her in the retweet have dented the respondent's reputation and lowered her in her own estimation, as also in the eyes of others. Therefore, filing of the complaint to vindicate her rights cannot be termed mala fide," Justice Tribhuvan Dahiya mentioned in the order while dismissing Ranaut's plea.
"... A reading of the impugned order as a whole, makes it apparent that the Magistrate (Bathinda court) has duly applied mind to the material on record, and only after recording satisfaction that commission of offence under Sections 499 IPC is prima facie made out against the petitioner, the process has been issued..," the order reads.
The petition was filed before the high court under Section 482 of the Code of Criminal Procedure seeking quashing of complaint filed under Section 499/500 Indian Penal Code and also the summoning order dated February 22, 2022 by the lower court.

"The most appalling aspect was that he (Nehru) did it without consulting Parliament. The treaty was signed in September 1960. However, it was placed before Parliament only two months later, in November, and that too, for a token discussion of a mere two hours," he wrote.

The Supreme Court on Monday said that former West Bengal education minister Partha Chatterjee should be released on bail in the cash-for-jobs case being probed by CBI, but after the trial court records statements of material witnesses. A bench of justices MM Sundresh and NK Singh said the statements must be recorded within two months. It noted that Chatterjee had been in jail for nearly three years and his continued incarceration would be tantamount to travesty of justice. The bench also granted bail to Subiresh Bhattacharya and Shantiprasad Sinha. The duo held positions in West Bengal's education bodies during the period of the alleged scandal. The case pertains to recruitment irregularities which allegedly took place when Chatterjee was West Bengal's education minister. He was holding other ministerial portfolios when he was arrested in 2022, but was sacked from the state Cabinet and suspended from Trinamool shortly after his arrest. CBI has alleged that Chatterjee was the mastermind behind the scandal and that he manipulated the recruitment process.
