High Court sets July 21 for contempt hearing against Dr M in ‘Kutty' suit

Kuala Lumpur: The High Court here has fixed July 21 to hear Ahmad Zahid Hamidi's committal proceedings against Dr Mahathir Mohamad over a press conference the former prime minister held last year after testifying in his defamation lawsuit. Judicial Commissioner Gan Techiong set the date after Mahathir's lawyer, Mior Nor Haidir Suhaimi, informed the court that they needed more time to file additional affidavits. 'We need to get his (Mahathir's) instructions for the purposes of filing,' he said, adding that Mahathir is currently attending the Langkawi International Maritime and Aerospace Exhibition 2025. Zahid's lawyer, Shahrul Fazli Kamarulzaman, said they had no objection to the deferral of the hearing to July 21. The court granted Zahid leave to initiate contempt proceedings on Jan 7. This followed a press conference Mahathir had held after testifying in his defamation suit.
Advertisement During the press conference, Mahathir produced copies of his identity card as well as the birth certificates of him and his children. Zahid claimed the media conference breached the sub judice rule, potentially impairing the integrity and independence of the judiciary in administering justice. Mahathir filed the defamation suit in 2022, alleging that Zahid had used the name 'Kutty' as a derogatory reference to him. Zahid is alleged to have made the remark at an Umno divisional meeting in Kelana Jaya, Selangor, on July 30, 2017. Mahathir claims the remark implied that he was not born a Malay or a Muslim, and that his original name was Mahathir son of Iskandar Kutty. It also implied that the name Mahathir Mohamad was used to profit himself politically and personally, the former prime minister said. Zahid hails London visit as bridge to reinforce Malaysia-UK ties
LONDON: Deputy Prime Minister Datuk Seri Dr Ahmad Zahid Hamidi described his four-day working visit to the United Kingdom which concluded Wednesday as a bridge to strengthen bilateral relations. Zahid, who is also Minister of Rural and Regional Development, said the visit, filled with discussions and programmes, differed from previous visits as he had the opportunity to personally witness the commitment of students sponsored by Majlis Amanah Rakyat (Mara) at University College London (UCL) during a session with them. When they come here and gain knowledge, then return to Malaysia, they will contribute not only to their professions but to other fields as well, providing motivation especially to Generation Alpha and the millennial generation," he told a press conference here upon the conclusion of his visit. Additionally, Zahid shared that Malaysia's Technical and Vocational Education and Training (TVET) received very positive feedback from the university and students who were excited about the government's game-changing initiatives. "…we are aware of the government's aim to create 60,000 high-tech engineering job opportunities, and we have requested for the Training of Trainers (ToT) programmes to be expedited," he said. Beyond TVET, the visit also strengthened cooperation in rural development, renewable energy, and climate resilience through Zahid's meeting with the UK's Secretary of State for Environment, Food and Rural Affairs, Steve Reed. The meeting also discussed collaboration in rural transformation, disaster management, water security, and investments in green energy, including the reactivation of the Asean Power Grid. During the visit, Malaysia also proposed the use of green sukuk for climate financing and efforts to lead the global halal ecosystem through the World Halal Council and a unified halal logo. Both countries also reaffirmed their commitment to enhancing trade relations under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP) and through private sector cooperation. Through the Malaysia-UK franchise business dialogue held during the visit, Ahmad Zahid expressed hope that it would help Malaysian franchise brands penetrate the UK market by 2026. Zahid also expressed confidence that the launch of Visit Malaysia 2026 (VMY2026) in the UK would expand collaboration with UK industry players, including airlines, to attract more UK tourists to Malaysia.

Court to hear Muhyiddin's reference bid on August 28

(Bernama pic) Kuala Lumpur: The High Court here will hear Muhyiddin Yassin's bid to refer legal questions to the apex court on the validity of certain provisions under the Sedition Act on Aug 28. The former prime minister is accused of making seditious statements during the Nenggiri by-election in Gua Musang, Kelantan, last year. Justice Jamil Hussin fixed the date after lawyer Joshua Tay, appearing for Muhyiddin, told the court that the defence and prosecution had agreed on the date. The court then instructed the prosecution and defence to file their submissions by Aug 14. Deputy public prosecutor Razali Che Ani appeared for the prosecution. Muhyiddin allegedly said he was not invited by the then Yang di-Pertuan Agong to be sworn in as prime minister following the 2022 general election, despite having obtained the majority support of 115 MPs. If found guilty, the Perikatan Nasional chairman and Bersatu president will face a jail term that could extend to three years or a maximum fine of RM5,000. Muhyiddin was initially charged at the Gua Musang sessions court in August last year. [UPDATED] High Court rejects Anwar's bid to refer constitutional questions to federal court [WATCH]
KUALA LUMPUR: Prime Minister Datuk Seri Anwar Ibrahim has failed in his bid to refer eight constitutional questions to the Federal Court regarding the legal provisions on the immunity of a sitting prime minister. High Court Judge Roz Mawar Rozain dismissed the application, ruling that it did not meet the requirements under Section 84 of the Courts of Judicature Act (CJA). "Having considered the affidavits, the eight proposed questions, and submissions of all parties (both written and oral), this court is not satisfied that the statutory threshold under Section 84 of the CJA is met. "The questions posed are speculative, not necessary to the disposal of this case, and do not concern the interpretation or validity of any constitutional provision," she said in her decision. Anwar's application is linked to a sexual assault lawsuit filed against him four years ago by his former research officer, Muhammed Yusoff Rawther. The trial is scheduled to begin on June 16. Roz Mawar said the proposed constitutional questions failed to meet the statutory threshold under the section, and that not every question referencing the Federal Constitution warrants referral. "The Federal Court is not a forum for speculative advisory opinions. "Furthermore, the defendant (Anwar) has affirmed readiness to proceed with trial and there is no evidence that the suit impairs his ability to perform constitutional duties. "This court finds no special circumstances warranting a stay of proceedings," she said. Roz Mawar awarded RM20,000 in costs to Yusoff Rawther. She also ruled that the June 16 trial will proceed. After the proceedings, Anwar's lawyer Datuk Seri Rajasegaran Krishnan said they will file a notice of appeal at the Court of Appeal. On May 23, Anwar applied to the High Court to refer eight legal questions to the Federal Court, which included whether he possesses immunity from a civil suit filed by Yusoff. Anwar had sought the apex court to rule whether Articles 5,8, 39,40 and 43 of the constitution grant him qualified immunity from Yusoff's suit. Yusoff had filed the suit before Anwar became prime minister on Nov 24, 2022. Anwar had asked the court to decide whether Yusoff's suit would impair the effective discharge of his executive duties and undermine the constitutional separation of powers. Anwar had also requested the court to consider whether the lawsuit impacts his ability to carry out executive duties and undermines the principle of separation of powers guaranteed by the constitution. Previously, Anwar's senior political secretary Datuk Seri Shamsul Iskandar Mohd Akin had said there was no attempt in the application to seek absolute immunity. He said Anwar's application to the Federal Court is a lawful process to seek clarity from the court on his position in carrying out official duties when facing a civil suit based on claims that precede his appointment as prime minister. Shamsul Iskandar had said the issue is whether such civil action could interfere with the efficiency of a prime minister in carrying out the executive functions of the state. He had said it is a legitimate and lawful matter to be referred to the Federal Court, the highest judicial institution in the country, with the jurisdiction to interpret the constitution fairly and objectively.
