Pityana's calls for increased scrutiny of banking regulator's powers

BUSINESS leader Sipho Pityana has described the SA Reserve Bank's (Sarb's) Prudential Authority (PA) as a rogue institution that places itself above the law.
Pityana recently secured a major victory against the PA when it was found that it had unlawfully blocked his appointment to the Absa board.
'What was the basis for their objection? They never said I was unfit,' Pityana said.
'The Reserve Bank first indicated they had issues with my nomination by suggesting I may not be a 'fit and proper person' — without ever formally asserting that I was implicated in harassment or any misconduct,' Pityana said.
'In fact, in all the court papers, they stated that they never asserted I was unfit or unqualified. They never actually said I wasn't a fit and proper person.'
The PA acted without legal justification, relying instead on informal, 'backroom processes' to strong-arm the Absa Board into rejecting Pityana.
The PA had firmly defended its legality and conduct amid debates over its role in the appointment of bank executives. Central to its arguments was that it had not acted unlawfully or beyond its powers under the Banks Act.
In court filings, the PA stated: 'The Authority always acted lawfully,' affirming that its interactions with banks were in line with regulatory standards.

Regarding the nomination process itself, the PA highlighted its statutory authority to review and potentially object to candidate appointments. It said: 'Section 60(5) of the Banks Act read with Regulation 42(1)(a) of the Regulations and section 60(5)(b) of the Banks Act provide that the notice must reach the Authority at least 30 days before the proposed date of appointment,' and that 'the Authority may object to the proposed appointment by means of a written notice, stating the grounds for objection.'
The PA further argued that its oversight included providing early guidance to banks. 'Financial institutions often engage with the Authority in advance of any nomination of directors or senior executives. They seek early guidance regarding any fitness or proprietary concerns,' it said, underlining that these interactions were part of the regulatory process and were intended 'to facilitate compliance with the statutory requirements by banks'.
In her judgment, Judge Luleka Flatela underscored that the PA's actions went beyond these prescribed procedures.
'The First Respondent acted unlawfully and in excess of its powers per the Banks Act 94 of 1990 by engaging in an informal process with the Second and Third Respondents in connection with the nomination of the Applicant as Chairperson of the Second and Third Respondents' board of directors, and in particular by notifying the Second and Third Respondents of its objection, alternative intention to object to the Applicant's nomination.'
Pityana did not mince words when describing the PA's conduct: 'They knew the process they were following was unlawful. Everything they submitted in court suggested they understood the unlawfulness of their actions but looked for excuses to justify using the informal process.'

'Ethics, if you put it in a very simple way, is how children can understand that we hold the lives of others in our hands, and that what we do or do not do has an impact on ourselves and others - the very concept of Ubuntu,' Torres said. Jansen explained that he works across high schools and higher education, and he highlighted how the Israel and Palestine conflict has impacted on educating the youth. 'It is the most televised war, they say, in history, from which all our children learn about war, but also about silence and complicity. It is also a test of the faith communities' commitment to go beyond easy words 'condemn', 'withdraw' and 'end the war',' he said.

R779 million spent on private security for state-owned properties over last five years

Image: Henk Kruger / Independent Newspapers Taxpayers have paid R779 million over the past five years to provide private security at state-owned properties across the country. This was disclosed by Public Works and Infrastructure Minister Dean Macpherson when he was responding to parliamentary questions posed by DA MP Edwin Bath. Macpherson said the expenditure on private security contracts was R140.9m in 2020/21, R124.6m the following year, R144.8m in 2022/23, R161.7m two years ago, and R199.9 in 2024/25. He also said the department has a total of 318 properties that are currently protected by private security companies. 'This is a constantly changing number due to properties that get vacated by tenants and thus require security services to prevent and respond to threats of illegal occupation. This number includes occupied and unoccupied properties located in various regions.' Macpherson further said there was a total of 248 security contracts in place. The top 10 costly private security contracts signed by the department are worth R81m and cover periods ranging from 24 to 36 months. He said none of the listed contracts exceeded the original contract value. 'The department works hard to ensure that security contracts remain within the awarded value.' Macpherson also said the anticipated implications on the continued protection of state-owned properties currently secured through private security contracts remain uncertain, as the proposed regulations by the Private Security Industry Regulatory Authority are yet to be finalised. 'Once these regulations are finalised, the department will align its procurement documentation for private security contracts to ensure compliance with the amended regulatory framework,' he said. Macpherson said the department has a total of 10,458 unutilised state-owned properties. 'This does not mean that each one can house a government organisation. They could be derelict, condemned, or unfit for human habitation.' He was responding to ATM leader Vuyo Zungula, who asked the reason for the justification for the government's use of private properties. Macpherson said the default position was to provide state-owned accommodation, but his department found itself relying more on private-leased accommodation because state-owned assets were not conducive to occupation. The department has spent R5.5 billion on private leases and R2.8 billion on maintenance during the 2024/25 financial year. He said the department has adopted asset optimisation strategies that sought to prioritise the development, refurbishment, and repurposing of state-owned properties to reduce the size of private leased properties. 'The minister has tightened controls on how and when leases are required as well as taking action against officials who collude to award leases that are needed,' said Macpherson, adding that he has referred the top 10 leases by value to the Special Investigating Unit for investigation to understand whether they were awarded correctly and if there was value for money. Asked by EF MP Blose Mazwikayise about unoccupied state properties, Macpherson said there were currently 1,743 that remained unoccupied and considered by his department as being under-utilised. 'Properties have been identified by the Department of Public Works and Infrastructure (DPWI) and submitted to the Department of Higher Education and Training (DHET) for analysis, including evaluation to determine suitability for student accommodation as per geographical needs and budget availability. 'This information is being awaited from DHET. On receipt of the above, DPWI will determine the most appropriate implementation model aligned to its asset optimisation strategy to support student accommodation requirements,' he said. The IF20 forum convenes religious leaders, civil society organisations, government officials, multilateral institutions, and scholars to explore collaborative solutions to pressing global challenges. Tuesday's discussion sought to explore analytic work and policy proposals in the face of challenges often cited by the youth, including employment, quality education, and addressing numerous challenges to mental health. The discussion was moderated by Andrea Kaufman, Director, Faith & External Engagement, World Vision International, and Angela Nielsen Redding, Executive Director, Radiance Foundation. The moderators set the scene with Redding explaining that at Radiance Foundation, they looked at Gallup World Poll data, a global network of quality data collection built to measure public opinion, which often asked questions about religiosity and well-being, but 'they had never compared the relationship between the answers to those questions'. 'We funded a historical look at the last 12 years to look at what is the relationship between personal and societal well-being to religiosity, and in addition, we did a meta-analysis of over 65 medical studies and psycho-social studies, and what they found is that the spirituality-well-being link is clear. 'It is unequivocal. There is clearly a link between higher levels of religiosity, higher levels of religion being important to people and better well-being outcomes,' Redding said. 'People who are religious throughout the world are more likely to be civically engaged. They have higher outcomes on positive experience, social support, and more involvement in their communities, despite more negative experience. 'But here is what is more interesting, in communities where religiosity is important, those effects are stronger, and in countries where you have fewer religious people, those effects are diminished or even decreased entirely. In countries within the continent of Africa, the well-being-spirituality link is even stronger.' She said that when that is coupled with their research, they have found that there are a few key indicators for resilient societies, and that being freedom of religion and media freedom. She said that according to the Pew Research Centre, 84% of humankind is affiliated with religion, and that number is set to increase based on basic demographics. 'A lot of the work that we do is what we are being told about religion, from a communications perspective. We did an AI-enabled study of over 30 million pieces of digital content, and we found that 74% of faith-related digital content was negative or extreme in nature, including 11% which was hate speech. That remaining percent was just informational. 'Only 6% of digital content is both personal and positive. There is a huge disconnect between the personal lived experience of people who are religious, and the communities where religion is important, and what you see represented in the media.' Redding explained that it applies to mental health, whereas people who are religious and less likely to be depressed, suffer from anxiety and other mental illnesses, isolation, and other things. Other panellists included Sandile Hlayisi, Church of Scientology, Scientology Volunteer Ministers, Doug Fountain, Executive Director, Christian Connections for International Health, Rogelio P. Lelis Jr., Mental Health and Psychosocial Support (MHPSS) Technical Advisor -ACWAY, Iraq. Fountain highlighted that in their network, they are focusing on mental health, and a vital thing that can be done is to advocate for youth mental health inclusion in national policy frameworks, 'both in health, and anything that looks like it affects the youth'. 'You want the youth of the world to shape these programmes, and if they are not designing these programmes, then what the hell are we doing?' Lelis Jr. also touched on accessibility and availability of access to health services for the youth. He said that there seems to be a misunderstanding in how it is tackled, and that 'everyone who needs mental health support needs to go right away to a specialised service, when in fact, there are a lot of things that can be delivered on a community level'. 'We can support each other, and that includes faith and religious leaders. That is a way to diversify services because, no matter if we want to have professionals, there is just not enough (to accommodate everyone).' Later, he added that it is important to mobilise the youth and to meet them in the spaces where they are.
