Land deal cancellation was illegally revoked by ex-Haryana CM Hooda: ED to Court
'The mutation was cancelled by the then Director General of Land Consolidation and Land records-cum-Inspector-General of Registration of Haryana (IAS Ashok Khemka)… the cancellation was revoked illegally by Haryana's CM,' said ED's Special Counsel Zoheb Hossain before the court of Special Judge Sushant Changotra.
The deal being mentioned here was the purchase of 3.5 acres of land in Shikohpur from Onkareshwar Properties for Rs 7.5 crore in 2008 and selling the land to DLF four years later for Rs 58 crore by a company named Skylight Hospitality, whose director was Vadra.
'There were irregularities such as false declarations. This company had no capacity to pay. It had only Rs 1 lakh in its capital… the actual payment was made later leading to evasion of stamp duty,' Hossain, who was accompanied by ED's Special Public Prosecutor NK Matta, argued.
The ED was arguing on its chargesheet, which was filed last Thursday against Vadra and 10 others (eight companies and two persons). The chargesheet was filed a day after the agency attached 43 immovable properties linked to Vadra, Sky Light Hospitality Pvt Ltd and others.
'The seller never encashed the cheque. The buyer didn't have the capacity to buy. The government was cheated of revenues and stamp duties worth `45 lakh were evaded,' Hossain said.
'The real transaction was 15 crores, not 7.5 crores… all the proceeds of crime flowed to companies owned by Vadra,' he added.
According to sources, the ED's chargesheet alleged that the sale deed 'falsely' stated that the payment was received via cheque, which was actually never encashed. The chargesheet also states, as per sources, that the stamp duty worth `45 lakh was evaded via misdeclaration. The ED has quantified the total proceeds of crime to be worth Rs 58 crore tentatively.
The chargesheet claims that there was pressure on Directorate of Town and Country Planning (DTCP) officials from higher authorities to accelerate the process, say sources.
'All pvt. ltd. companies were converted into LLPs (limited liability partnerships) …as the former have more disclosure requirements,' Hossain argued before the Court.
The matter will now be heard on July 31 and the ED will outline the individual roles of all the accused persons in the case. After the ED has concluded its arguments, the Judge is likely to decide whether to take cognizance of the chargesheet or not.

'Would you worship Bhagwa terrorist?': Shankaracharya Avimukteshwaranand says 'don't link terrorism with colour'; questions failure to find Malegaon blast culprits
Shankaracharya Swami Avimukteshwaranand NEW DELHI: The debate over the use of the term 'Saffron Terror', that resumed after the July 31 verdict in the 2008 Malegaon blast case, has refused to die down. Commenting on the term, Shankaracharya Swami Avimukteshwaranand Saraswati Maharaj said that colour should not be linked with terrorism. He said those who associate a colour with terrorism are supporting terrorism. The Shankaracharya said, "A terrorist is a does colour mean with the word terrorism? Terrorism is terrorism, and a zero-tolerance policy should be adopted against it... The Malegaon blast happened, but you could not find the person who committed who look for colours in terrorism are supporters of terrorism." The term 'Bhagwa Aatank' or 'saffron terrorism' was first used after the 2002 Gujarat riots, as per a report by the news agency ANI. It was later used again after the 2008 Malegaon blasts. Some political leaders and parties used the term in their statements. The term was also mentioned by then home minister P Chidambaram in an official meeting with police officials. "We do not wish to comment on the court's proceedings; whatever was done in court, we believe, must have been correct. If these people were found innocent in the court's view, then it is right they were acquitted. But the bigger problem is that the blast did not happen on its own — someone must have done it. Who was it? Where is the Government of India, the state government failing, that someone comes, carries out a blast, and leaves, and despite having vast resources and plenty of time, we are still unable to catch the culprit? This is a big slap on our capability that we cannot apprehend the guilty," he said. On July 31, a special NIA court in Mumbai acquitted all seven accused in the 2008 Malegaon blast case. The court said that the prosecution could not prove the charges beyond reasonable doubt. The court also directed the Maharashtra government to pay Rs 2 lakh compensation to the families of the people who died in the blast, and Rs 50,000 to those who were injured. The seven accused were former MP Sadhvi Pragya Singh Thakur, retired Major Ramesh Upadhyay, Sudhakar Chaturvedi, Ajay Rahirkar, Sudhankar Dhar Dwivedi (also known as Shankaracharya), and Sameer Kulkarni. "All bail bonds of the accused are cancelled and sureties are discharged," the court said. The court examined 323 witnesses from the prosecution and eight from the defence before giving the verdict. All seven were acquitted of charges under the Unlawful Activities (Prevention) Act, the Arms Act, and other related charges. The blast occurred on September 29, 2008, near a mosque in Bhikku Chowk area of Malegaon. An explosive device placed on a motorcycle went off, killing six people and injuring 95 others. Initially, 11 people were named as accused, but charges were framed against seven. The lawyer representing the victims' families has said that he will challenge the acquittal in the high court. Earlier, on the eve of the judgment in the Malegaon blast case, Union home minister Amit Shah had said in Parliament that no Hindu can ever be a terrorist. "I am proud to say, no Hindu can ever be a terrorist," Shah had said in Rajya Sabha. Meanwhile, after the NIA court judgment, former Maharashtra CM Prithviraj Chavan also spoke on the matter last week and said that he does not support the use of the term "saffron terror." "Don't use the term 'Saffron terrorism'. If you want to describe such acts, use 'Hindu fundamentalist' or 'Hindu terrorism' instead."

KTR comes to aid of TG woman trapped in Oman
Hyderabad: Once again demonstrating his humanitarian commitment, BRS working president KT Rama Rao came to the aid of a 28-year-old woman from Telangana who was trapped and abused in Oman after being misled by a recruitment agent. Afrin, a native of Godavarikhani, had travelled to Oman for employment after being assured a domestic worker's job. However, upon arrival, she was locked in a room, denied food, and subjected to severe physical and emotional abuse by her employer. Attempts to switch jobs only led to more harassment. Despite seeking help from multiple sources and reaching out to the Indian Embassy, Afrin's pleas went unanswered. Eventually, her ordeal reached KT Rama Rao through a BRS party worker. Responding without delay, Rama Rao directed party leader Harish Reddy from Ramagundam to take up the matter and coordinate her rescue. With support from KTR's office, contact was established with the Indian Embassy in Oman. To facilitate her release, Rs 1,20,000 was paid to the local agent. Following this, arrangements were swiftly made to bring Afrin back to Hyderabad. Upon her arrival on Sunday, Afrin visited Telangana Bhavan to thank KTR in person. Overwhelmed with emotion, she said, 'It is only because of KTR's support and assurance that I was able to return home safely. In a foreign land where I had no one, he stood by me like a protective elder brother.' As a gesture of gratitude, she tied a rakhi on his wrist. KTR expressed happiness over her safe return and inquired about her family's well-being. 'While no government came to her aid, it was our party and our leadership that stood by her,' he said, promising continued support to Afrin and her also praised the efforts of Harish Reddy, who coordinated the rescue mission from Muscat to Hyderabad.
