A-G to look into court decision on influencer's false report case

KOTA BARU: The Attorney-General's Chambers (A-GC) will look into the decision by the Muar magistrate's court to sentence a social media influencer and his brother to one month in jail and a RM1,500 fine for lodging a false police report over his disappearance.
Attorney-General Tan Sri Mohd Dusuki Mokhtar confirmed the matter when asked to comment on public dissatisfaction, with many saying the punishment handed down by the court was too lenient.
However, Dusuki said he could not comment further as the decision fell under the court's jurisdiction.
"Nonetheless, we will review the decision," he said at a press conference after launching the Santuni Madani: One Leader, One Village programme by the A-GC at SK Pulai Chondong here today.
It was reported yesterday that influencer Tengku Nizaruddin Tengku Zainudin, 38, also known as Ija, and his brother Tengku Abdul Aziz, 30, were each sentenced to one month in jail and fined RM1,500 by the magistrate's court in Muar, Johor.
The sentence was handed down after both pleaded guilty to lodging a false report over the influencer's disappearance in Sungai Tui, Bukit Kepong.
The court also ruled that Tengku Nizaruddin could face an additional three months' imprisonment and Tengku Abdul Aziz six months, should they fail to pay the fine.
Following the court's decision, many expressed dissatisfaction, saying the sentence was too lenient considering the influencer's actions had caused the Fire and Rescue Department to launch a search operation and remain stationed at the location in search of him.

Inspector-General of Police Tan Sri Mohd Khalid Ismail said such actions could jeopardise the ongoing investigation and deny justice to those involved. "The police have detected the circulation of false claims and photographs of a child allegedly linked to the case, which have been uploaded and shared by certain individuals. "The information being shared is inaccurate and has the potential to mislead the public. "Such actions can not only compromise the ongoing investigation but also jeopardise justice for all parties involved," he said in a statement. Khalid reminded the public that such acts are offences under Section 15 of the Child Act 2001, which prohibits the disclosure of information on the identity, address, school name, and photographs of children involved; Section 203A of the Penal Code for disclosure of information; and Section 233 of the Communications and Multimedia Act 1998 for improper use of network facilities or network services. He said all investigation processes, including the post-mortem, were being carried out in accordance with existing procedures and legal provisions. He said that compliance with the law was fundamental to the nation's peace and wellbeing, warning that any violations would be met with stern action. It has returned the full preliminary investigation report on the death of Zara to the police. She was declared dead at Queen Elizabeth I Hospital in Kota Kinabalu the next day. The death of the teenager has sparked heated debate online after allegations of bullying and supposed failures in the early stages of the investigation, including the lack of a post-mortem examination before she was buried. On Aug 1, Zara's family requested an inquest to be held to determine whether any criminal elements were involved in her death. They had, among other requests, called for Zara's body to be exhumed. Previously, Inspector-General of Police Datuk Seri Mohd Khalid Ismail said police had submitted the preliminary investigation paper on Zara Qairina's death to the A-GC. However, earlier today, Attorney-General Tan Sri Mohd Dusuki Mokhtar said the A-GC had returned the investigation paper to police yesterday for further action to be taken.

The AGC also noted that it received the full preliminary investigation report on the case at its Sabah branch on Aug 3, and at its headquarters in Putrajaya on Aug 4. Zara Qairina, 13, was pronounced dead at Queen Elizabeth I Hospital in Kota Kinabalu, Sabah, on July 17. KUANTAN: A former police station chief who held the rank of sergeant major was fined RM20,000 after he pleaded guilty to 40 counts of bribery amounting to RM5,850 at the Sessions Court here today. Anuar Yaakob, 56, made the guilty plea after the charges were read out to him in front of judge Sazlina Safie. He was accused of receiving valuable items, namely cash ranging from RM150 to RM1,000, from several individuals connected to his official duties through online transfers to his account between January 2021 and September 2022. He was accused of committing the act while on duty, holding the rank of sergeant and then sergeant major serving as the Cherating police station chief. He was charged under Section 165 of the Penal Code which carries a penalty of imprisonment of up to two years or fine, or both. Malaysian Anti-Corruption Commission deputy prosecuting officer Ezuain Farhana Ahmad appeared for the prosecution while Anuar was represented by lawyer Mohd Baharuddin Ahmad Kassim. In sentencing, Sazline fixed RM500 fine for each charge. Anuar paid the fine. In 2023, Anuar claimed trial to 98 counts of bribery amounting to RM31,400 in 2021 and 2022.
