Temu and Shein are pivoting to Europe to deal with U.S. tariffs. But they may not get a warm welcome

Temu and Shein are pivoting to Europe as their business in the U.S. takes a major hit from unfavorable trade policies. But the China-founded budget e-commerce apps may not receive a warm reception in their new target markets.
In recent weeks, complaints have been filed against Temu and Shein in the EU, accusing them of unsavory business tactics. That comes as the bloc prepares a new two-euro flat fee on previously customs-free small packages from online marketplaces like Temu and Shein.
Experts say the new developments could be ominous signs for the platforms, as their business has already suffered from the closure of a small package tariff exemption in the United States, as well as new duties at 54% or $100 for those sent through the postal service.
"As regulatory and trade pressures intensify in the U.S., Temu and Shein are increasingly turning to Europe and the UK as critical growth markets," Anand Kumar, associate director of research at Coresight Research, told CNBC.
However, Kumar said that the companies have begun to face regulatory headwinds in Europe and the U.K. that echo the scrutiny they've encountered in the U.S.
"The EU's proposed €2 customs fee is more than a minor surcharge—it's a strategic regulatory move aimed at curbing the unchecked growth of ultra-cheap cross-border e-commerce, and it could reshape how platforms like Shein and Temu operate in Europe over the next 2–3 years," he added.
Temu and Shein have boosted their ad spending in Europe, particularly in the U.K. and France, according to a report from Reuters, reflecting their shift away from the U.S.
The growing importance of the EU and U.K. to the two companies has also been reflected in data from Consumer Edge Research, which traces consumer trends based on a sample of credit and debit card info.
According to the data it sent to CNBC, Temu's year-over-year consumer spending in the U.S. fell about 36% in May from a year earlier, while Shein's fell 13% over the same period. The company added that its data shows that some of Temu and Shein's U.S. customers have shifted their spending toward legacy department stores and fast fashion retailers.
Those trends coincide with data from market intelligence firm Sensor Tower showing that app usage of Temu and Shein in the U.S. is slowing significantly.
However, the opposite trends for the platforms were observed in the U.K. and EU. In May, year-over-year consumer spending growth reached 63% in the EU and 38% in the U.K. Shein experienced growth of 19% in the EU and 42% in the U.K. over the same period.
For Temu, Consumer Edge data showed that growth was especially pronounced in the key market of France, Europe's second-largest economy.
To capitalize on the momentum in Europe, Temu and Shein have been aggressively expanding their operations across the region, including ramping up warehouse capacity, experimenting with localized business models, as well as significantly increasing digital ad spending in key markets like the U.K., France and Germany, according to Coresight's Kumar.
"This expansion is not merely opportunistic—it signals a strategic shift in how these companies envision their next phase of growth," he said.
"That said, the European market is not without its challenges. The region enforces stricter regulations on product safety, consumer protection, and fair competition, all of which require Temu and Shein to invest more in compliance and operational transparency," he added.
Experts say that those challenges and the EU's potential duties on small-value packages may be signs of more pressures to come for Temu and Shein.
According to French local media, the wording of an "anti-fast fashion" bill, which is under debate in the French National Assembly, was recently rewritten to single out ultra-cheap platforms like Shein and Temu.
The bill, first approved by France's lower house of parliament in March last year, seeks to penalize fast-fashion products for their environmental impact.
Meanwhile, on Thursday, the pan-European consumer organization Beuc filed a complaint with the European Commission against Shein over its use of deceptive techniques, or "dark patterns" that cause overconsumption.
That comes after the European Commission announced its own investigation into Shein's compliance with EU consumer law in February and, in May, urged Shein to respect EU consumer protection laws.
BEUC has also filed a complaint against Temu, while 17 of its members filed the same complaint with their competent national authorities, the group said.
Xiaomeng Lu, director of geotechnology at Eurasia Group, told CNBC that the latest scrutiny Temu and Shein are experiencing in the EU is reminiscent of that in the U.S.
"[Temu and Shein] offer cost effective solutions and an efficient supply network that fare well in the fast moving fashion world. However their labor practices and human rights standards may not fully align with high value markets like the EU and U.S.," Lu said.
That conflict and "rising protectionism" globally are the "key drivers of these regulatory reactions," she added.
In the U.S., officials had also taken issue with Temu over its alleged non-compliance with the Uyghur Forced Labor Prevention Act (UFLPA), which prohibits the import of goods made with forced labor from China's Xinjiang region.
According to Coresight's Kumar, Europe, for its part, is progressing toward stricter oversight through the Corporate Sustainability Due Diligence Directive — which EU member states have until July 2026 to integrate into their national laws.
The directive would compel companies operating in the EU to identify and mitigate human rights abuses in their supply chains, disclose environmental impact and sustainability metrics and face legal consequences for failing to take adequate preventive steps.
That means Temu and Shein will face stringent compliance demands in the EU, Kumar said. However, the region still offers meaningful opportunities for expansion in an increasingly protectionist global trade environment, he added.

A federal appeals court agreed on Tuesday to allow President Trump to maintain many of his tariffs on China and other U.S. trading partners, extending a pause it granted shortly after another panel of judges ruled in late May that the import taxes were illegal. The decision, from the U.S. Court of Appeals for the Federal Circuit in Washington, delivered an important but interim victory for the Trump administration. The government still must convince the judges that the president appropriately used a set of emergency powers when he implemented the centerpiece of his economic agenda. The decision came as negotiators from the United States and China agreed to a framework intended to extend a trade truce between the two superpowers. The Trump administration had warned that those talks and others around the world would have been jeopardized if the appeals court had not granted a stay while arguments proceeded. At the heart of the legal wrangling is Mr. Trump's novel interpretation of a 1970s law that he used to wage a global trade war on an expansive scale. No president before him had ever used the International Emergency Economic Powers Act, or IEEPA, to impose tariffs, and the word itself is not even mentioned in the statute. But the law has formed the foundation of Mr. Trump's campaign to reorient the global economic order. He has invoked its powers to sidestep Congress and impose huge taxes on most global imports, with the goal of raising revenue, bolstering domestic manufacturing and brokering more favorable trade deals with other countries. A group of small businesses and a coalition of states in April each sued the Trump administration in the U.S. Court of International Trade, claiming that they faced financial hardship from the president's illegal actions. The trade court agreed, finding late last month that Mr. Trump had greatly overstepped the bounds of the emergency powers law. The judges ordered the White House to halt many of its tariffs, including those imposed on China, Canada and Mexico. But the Trump administration immediately appealed the ruling, and judges on the appeals court initially granted the government a temporary stay. That allowed the president's tariffs to remain in place, while the court began to evaluate the government's request for a longer-term pause on original ruling. It granted that motion on Tuesday, allowing the court to turn next to the legal arguments at the heart of the case — and the extent to which Mr. Trump possesses the sweeping trade powers that he claims.

US tariff turmoil makes Spain's flagship foods seek other markets

It's lunchtime in a bar in the southern Spanish city of Seville. The kitchen is humming with activity, and behind the bar a member of staff pours cold beer from a tap into a glass. Nearby, another uses a carving knife to cut slices from a large leg of jamón ibérico, or Iberian ham, placing each one on a plate, to be served as an appetiser. There are few more Spanish scenes. And there are few more Spanish products than jamón ibérico, whose unique salty flavour is renowned across the world, and part of a national cured ham industry worth nearly €750m ($850m; £630m) each year in exports. As he watches the jamón being carved, Jaime Fernández, international commercial director for the Grupo Osborne, which produces wine, sherry and the renowned Cinco Jotas brand of ham, describes it as a "flagship" national foodstuff. "It's one of the most iconic gastronomic products from Spain," he says, pointing out how the pigs used to make the ham are reared in the wild and fed on acorns. "It represents our tradition, our culture, our essence." There was no tariff on Spanish ham exports to the US until April of this year, when a 20% charge on all European imports was suddenly introduced, dropping to 10% pending negotiations. However, in May Trump unsettled European exporters again when he said that the tariff for all EU goods could rise as high as 50% if trade talks with Brussels do not come to a successful agreement. The current deadline for this is 9 July. "The United States is one of our top, priority markets," says Mr Fernández. "The uncertainty is there, and it complicates our medium-and long-term planning, investments and commercial development." The tariffs, he adds, "pose a threat to our industry." Spain's overall economy is in rude health. The IMF has forecast growth this year of 2.5% – much higher than the other main EU economies – and unemployment is at a 17-year low. But the tariff issue comes as a blow for the country's pork industry, which represents more than 400,000 direct and indirect jobs, and is Europe's largest. Demand for cured ham in the US has grown substantially in recent years, and it has become the biggest importer of Spanish ham outside the EU. But the Spanish industry now faces the prospect of having to raise retail prices for US consumers and therefore losing competitivity to local products, or those not subject to the same tariffs. Spain's olive oil sector is in a similar quandary. The world's biggest producer of olive oil, Spain had set its sights on the US as a burgeoning market whose growth was driven by growing awareness of the health benefits of the product. Yet the the tariff turmoil comes just as Spanish producers and exporters have recovered from a drought that slashed harvests in the south of the country, and sent prices temporarily soaring. The US represents half of world olive oil consumption outside the EU. It is also the country whose imports of the foodstuff from Spain have grown the most in recent years, increasing from approximately 300,000 tonnes per year a decade ago to around 430,000 tonnes, says Rafael Pico Lapuente, director general of the Spanish association of olive oil exporters (ASOLIVA). Much will depend, he says, on the final tariff set for the EU. "If there is a 10% tariff which is permanent, without differentiating between countries of origin, it's not going to create a distortion on the international market," says Mr Pico Lapuente. He explains that American consumers might have to absorb the extra cost. And although local US producers of olive oil or similar products would gain a competitive edge, their output is small enough for it not to concern the likes of Spain. However, he says it would be "a different story" if Trump introduced higher tariffs for the EU than for competitor olive oil countries outside the bloc – such as Turkey, the world's second-largest producer, or Tunisia, an emerging grower. That scenario, he says, would have a major impact on the world market and Spanish producers. But variations in tariffs between countries or trade blocs would also lead to a certain amount rule-bending and even chaos, according to Javier Díaz-Giménez, a professor of economics at the IESE business school in Madrid. He suggests two of Spain's direct neighbours as a hypothetical example. "If Spain has a 20% tariff and Morocco and Andorra have a 10% tariff, all the Spanish products that can go through Morocco or Andorra… will do so." He adds: "They will be first exported to Morocco and Andorra and from there re-exported to the United States with a 10% tariff. "And it's going to be really hard to make sure that these olives came from Andorra proper and not from Spain. Is Trump going to do something about that?" For now, Spanish producers and exporters must hold their breath as EU negotiations take place with Washington. For Mr Pico Lapuente, a big cause of concern is the influence – or as he sees it, lack of influence – his sector wields within the European trade bloc. "The negotiations representing the EU's 27 countries are carried out by Brussels," he says. "In these negotiations, industrial products have a much bigger influence than food. "I wouldn't like it if, in this negotiation, food products like olive oil were used as mere bargaining chips in order to get a better deal for Europe's industrial products. That worries me. And I hope it doesn't happen." A spokesperson for the European Commission told the BBC that in negotiations with the US it will act "in defence of European interests, protecting its workers, consumers and its industries". Jaime Fernández, of the Grupo Osborne, believes his industry could live with the 10% tariff that is currently in place without suffering too much fallout. However, a 20% charge, he says would cause the industry "to reconsider how to accelerate growth in some other markets, which would eventually lead to the relocation of resources from the US". He says his company is already looking at alternative markets in which to invest, such as China, or proven European ham consumers such as France, Italy and Portugal. Mr Díaz-Giménez says that is the logical response to the current uncertainty. "If I was the CEO of any company with a high exposure to the United States… I would have sent my entire sales team to find other markets," he says. "And by now, they would have found them.
