Bombay HC dismisses PIL challenging transfer of salt pan lands for Dharavi redevelopment project affected people
A bench of Chief Justice Alok Aradhe and Justice Sandeep Marne was hearing PIL challenging the government's approval of transferring 256 acres of salt pan land for the Dharavi Redevelopment Project (DRP) to accommodate ineligible residents of Dharavi.
The court dismissed the PIL, citing a lack of research and evidence to support the information raised in the PIL. The Court also observed that salt pan lands are excluded from wetlands after the Centre changed policy in 2024, permitting the transfer of salt pan lands for specific purposes. PIL has failed to prove that salt pans cannot be utilised for rehabilitation.
The lawyer Sagar Devre challenged the State's decision to hand over the salt pan land parcel in Mulund, Kanjurmarg and Bhandup to Adani for a rental housing scheme for ineligible residents of Dharavi and the Union Ministry of Commerce and Industry's Office Memorandum (OM), which enables the transfer of land. The State proposed to the Centre, which owns the salt pans, for the transfer of land for the Dharavi PAP project on a 99-year lease in February last year.
According to Mr. Devre, how can land be used for construction when it is situated in a Coastal Regulation Zone (CRZ) area. While on behalf of the Central government, Additional Solicitor General (ASG) Anil Singh argued PIL was filed casually.
While dismissing the PIL, the HC also asked the government to consider environmental issues during execution.
Sanjay Devre said, 'Will take the matter to the Supreme Court and file a detailed petition.'

Sent Rs 3 lakh crore to Tamil Nadu: PM refutes MK Stalin's claim on central funds
Prime Minister Narendra Modi on Saturday refuted Tamil Nadu Chief Minister MK Stalin's claim that the state was denied its rightful share of funds by the Centre, and said that Rs 3 lakh crore was disbursed to the south Indian state in the last 10 years, which was thrice as much as the UPA government released from 2004 to 2014. The PM said that as many as 11 new medical colleges have also been set up in Tamil Nadu in the last 11 years with the Centre's help. Notably, DMK chief Stalin has been continuously complaining about the Modi government not releasing enough funds for Tamil Nadu. After the Niti Aayog meeting in New Delhi in May, Stalin said that due to a few states not signing the Memorandum of Understanding (MoU) with the Ministry of Education on the PM Shri scheme, the Samagra Shiksha Abhiyan funding was denied. He said that specifically, for the year 2024-2025, nearly Rs 2,200 crore in Union funding was withheld from Tamil Nadu. On Saturday, PM Modi addressed a public rally in Tamil Nadu's Thoothukudi, where he inaugurated infrastructural projects worth Rs 4,900 crore. PM Modi reached Thoothukudi directly from the Maldives where he completed a two-day state visit and signed a number of key agreements with President Mohamed Muizzu.

Want Bengal govt to respond to Centre's queries on Aparajita Bill: Guv
The West Bengal assembly had unanimously passed the Aparajita Women and Child (West Bengal Criminal Laws Amendment) Bill nearly a month after the alleged rape and murder of a postgraduate trainee doctor at Kolkata's RG Kar Medical College and Hospital on August 9, 2024. He also said the Bill was larger in its context and content, and thus required an examination from the President. Kolkata, Jul 26 (PTI) A day after he sent the Aparajita Bill back to the West Bengal government, Governor CV Ananda Bose on Saturday said that he wanted the state administration to respond to the Centre's objections to the legislation. 'The Aparajita Bill was larger in its context and content. Therefore, I thought that it was something that required the examination of the President of India. Now, the Government of India (GoI) has raised certain queries, which I have asked the state government to answer. I want the state government to be fully involved in this,' he said. Bose sent the Aparajita Bill back to the state government for consideration of the serious objections raised by the Centre over the proposed changes to the Bharatiya Nyaya Sanhita that the legislation seeks, a Raj Bhavan source had said on Friday. According to the source, the Centre, in its observation, found that the Aparajita Women and Child (West Bengal Criminal Laws Amendment) Bill, passed in the assembly in September 2024, seeks changes in punishment for rape under multiple sections of the BNS that are 'excessively harsh and disproportionate', the source had said. The Bill proposes enhancement of punishment for rape from the existing minimum of 10 years under the BNS to life imprisonment for the remainder of one's life or death. 'There are three options before a governor. First is to give ascent to the Bill. Many Bills I had given ascent because these were very good in every respect, Constitutional within the law of the land. 'The second option is that the Bill can be sent back to the Assembly for reconsideration with certain suggestions, or without suggestions. Once passed by the Assembly, the Bill comes back to the Governor, and he has to give assent to the Bill. The third option is to refer it to the President of India,' Bose told reporters at the Raj Bhavan here. The Ministry of Home Affairs (MHA) had 'flagged multiple provisions in the Bill as problematic', the source had said. 'After taking note of the MHA observation, the Governor has referred those for appropriate consideration to the state government,' the source added. HC halts stone crusher operation near residential area
Dehradun: Uttarakhand high court's division bench of Justices Ravindra Maithani and Alok Mahra issued notices to M/s Sai Kripa Stone Crusher during a PIL hearing on environmental concerns over its construction in Dehradun. The court directed the state to act within a week and submit a counter-affidavit in four weeks. Petitioner Skand Kumar Sing, a social activist, highlighted that the crusher is just 200m from a densely populated area, including residential houses, schools, and an anganwadi centre. The petitioner also submitted maps showing the location of the crusher. He sought the suspension of both construction and operations during the petition's pendency. A college principal also repeatedly notified authorities about the stone crusher's construction, disrupting educational activities in the school. The counsel representing the Uttarakhand Environment Protection and Pollution Control Board (UEPPCB) said that, as per Central Pollution Control Board (CPCB) policy, stone crushers are permitted to operate only in designated zones and must be at least 300m from residential areas. These operations release significant fugitive dust, causing environmental pollution and health risks to workers and nearby residents. The court allowed respondents to file objections to the interim relief application. "In the meanwhile, the stone crusher unit shall not carry out construction or operation of the stone crusher. The district magistrate, Dehradun, shall ensure it," the court said on Friday, scheduling the next hearing for Oct 8.
