Siti Kasim wins RM160k in damages over unlawful arrest by JAWI
Judge Su Tiang Joo ordered JAWI, 15 officers, and seven others to pay RM100,000 in exemplary damages, RM60,000 in aggravated damages, and RM100,000 in legal costs.
The court determined that Siti Kasim, whose full name is Siti Zabedah Kasim, was wrongfully detained by JAWI officers after leaving a private fundraising event at a hotel.
The judge stated, 'In my considered view, there was misfeasance in public office by the defendants in conducting a raid and apprehending a participant at a state event, without ensuring the lawful exercise of their powers, thereby causing unnecessary fear and discomfort.'
Siti Kasim filed the lawsuit in September 2019, alleging false imprisonment, misfeasance in public office, and a breach of her constitutional right to personal liberty.
She maintained that she was performing her duties as a lawyer and did not obstruct any officers.
Earlier, on August 21, 2020, the Magistrates' Court acquitted her of obstructing public servants, ruling insufficient evidence under Section 186 of the Penal Code. - Bernama

KUALA LUMPUR, Aug 7 (Bernama) -- A former wushu coach was today sentenced to 13 years in prison and four strokes of the cane by the Sessions Court here after being found guilty of committing physical sexual assault against a 10-year-old girl. Judge Tasnim Abu Bakar handed down the sentence after ruling that the defence had failed to raise a reasonable doubt in the case against Gjeblehim Bong Teck Fuu, 34. "The court imposes a sentence of 13 years' imprisonment from today, along with four strokes of the cane. The accused is also ordered to undergo counselling throughout the imprisonment period and placed under police supervision for three years after completing his sentence," said the judge. The court then dismissed an application by defence counsel Tharamjit Singh for a stay of execution pending an appeal to the High Court. Bong was charged with committing the offence in his capacity as a person in a position of trust, as the victim's coach, at a premises in Taman Sri Sentosa, Jalan Klang Lama, about 7.30 pm on April 13, 2022. He was charged under Section 14(a) of the Sexual Offences Against Children Act 2017, read together with Section 16(1) of the same Act. Section 14(a) provides for a maximum sentence of 20 years' imprisonment and whipping, while Section 16(1) carries a jail term of up to five years and not less than two strokes of the cane, upon conviction. In mitigation, defence counsel Tharamjit Singh urged the court to impose a lenient sentence, citing that the accused had to care for his elderly mother. However, deputy public prosecutor Nur Shakila Mohd Shariff pressed for a heavier sentence, arguing that the offence was serious and had caused lasting psychological trauma to the victim.

Cop killed in line of duty during burglary, suspects nabbed
ALOR STAR: A policeman was killed in the line of duty today after he was run over by a fleeing burglary suspect at Taman Golf here. Corporal Mohd Hafizul Izham Mazlan, 35, from the Kedah Criminal Investigation Department (CID), died at the scene after being struck by a vehicle driven by one of the suspects, who was attempting to steal a metal safe from the house. Kedah police chief Commissioner Datuk Adzli Abu Shah said the incident occurred at about 3.30pm following a tip-off regarding suspicious activity at the premises. "Acting on the information, a team of five CID policemen in two vehicles was dispatched to the location. "Upon arrival, our men encountered the suspects in the act. "One of them, who was behind the wheel of a Lexus, accelerated and rammed into our policeman just as he exited his vehicle. "He was run over and died at the scene. "This is a tragic loss for the police force, especially for us in Kedah," he said when met at the scene. Adzli said one of the suspects was arrested on-site, while three others fled in the Lexus, which sustained damage during the collision. "The group was tracked to Kepala Batas in Jitra and detained within an hour. "The suspects even stole another car during their escape. "However, all four have been arrested," he said. The suspects, aged between 24 and 26, are believed to be from Johor. Police checks revealed one had 77 prior offences, mostly for house break-ins and car theft, while another had 30. The other two had six and two past offences, respectively. "They appear to be part of a mobile burglary syndicate operating across state borders. "We are working closely with other contingents, including Johor, to determine whether this was a random strike or a job based on insider information," he said. Investigators found clear signs of forced entry at the house, including broken locks and a pried-open door. No one was home during the incident. "All vehicles involved, including the Lexus used to run over our officer and the second vehicle stolen during the escape, have been recovered," Adzli said. Mohd Hafizul, a native of Setiu, Terengganu, is survived by his wife and four children aged four, nine, and 11. Arrangements are being made for his burial. "He died while carrying out his duties. His death is a tremendous loss to the force. We will ensure justice is served," said Adzli. The case is being investigated under Section 302 of the Penal Code for murder and Section 457 for housebreaking. Adzli also urged the public not to speculate on the case, particularly about the targeted home or the officer's family. "My officers or I will provide updates should there be any new developments," he said.

Penang cops wrapping up probe into Iranians accused of robbing 'hypnotised' tourists
GEORGE TOWN: Police are finalising the investigation into a case where five Iranians were arrested over the alleged theft of money from tourists in the city centre here. Acting Penang police chief Datuk Mohd Alwi Zainal Abidin said all five suspects aged from 19 to 35, have finished their police remand and are currently being remanded by the Immigration Department until Aug 15, "Police are still conducting investigations from various angles, including the possibility of their involvement in similar cases in other places (other states). However, there have been no findings so far. "Investigations show that they are involved in three cases in the George Town area and we are completing the investigation papers before it is sent to the Deputy Public Prosecutor's office for further action," he said on Thursday (Aug 7). He added police were also still waiting for a response from Immigration to confirm the authenticity of the passports of the five Iranians and records of their entry and exit in the country. Mohd Alwi said police were investigating the cases under Section 379 of the Penal Code for theft and Section 380 the same Act, in addition to Section 6 and Section 15(1)(a) of the Dangerous Drugs Act 1952. On Saturday (Aug 2), police arrested three men and two women at Plaza Gurney here during "Ops Tourist". The suspects are believed to have sweet-talked or hypnotised (pukau) victims before stealing their money. Police received three reports of robberies involving tourists in the Pulau Tikus and Jalan Penang areas involving victims from Taiwanese, Holland and Syria from July 30 to Aug 1. – Bernama
