HC seeks data on pupil-teacher ratio in all govt schools

Cuttack: Orissa high court has directed the director of elementary education to submit detailed data on the pupil-teacher ratio (PTR) across all govt-run schools till Aug 1.
The court issued the direction recently while hearing a petition filed by a teacher seeking intervention against his transfer from one school to another in Cuttack district.
In what it called "a bit unusual approach", the court directed the state authorities to submit PTR data for all schools, specifying existing vacancies and the measures being undertaken to fill them.
In his Aug 7 order, Justice Dixit Krishna Shripad noted that the transfer appeared to have been effected before the expiry of the minimum retention period (three years), which, as per the extant transfer guidelines, is to be reckoned from Aug 8, 2023.
Justice Shripad stayed the transfer of the teacher and observed that several such cases are being brought before the court, where the PTR is allegedly not maintained, adversely impacting the quality of instruction. "This court has been seeing many cases of similar nature, wherein very often it is contended with prima facie force that in many schools the pupil-teacher ratio is not maintained and that would affect the quality of instructions and teaching enormously," Justice Shripad noted.

He emphasised the critical importance of PTR as laid down in the National Education Policy formulated by the Centre. Stating that the Right to Education is a fundamental right under Article 21 of the Constitution, Justice Shripad remarked that it could not turn a "Nelson's eye" to administrative deficiencies in the education sector.
NEP-2020 recommends a pupil-teacher ratio (PTR) of under 30:1 at each school level, with a preference for 25:1 in socio-economically disadvantaged areas.
It is similar to the recommendations of the RTE Act, 2009.
"The future of the nation depends upon the quality of education given to growing children," Justice Shripad observed.
Petitioner Sitakanta Samal has been allowed to continue as assistant teacher in Bapuji Govt High School under the administrative control of block education officer, Nischintakoili, until the next hearing. The matter will be taken up again after two weeks.
According to the order issued on July 24, the petitioner was transferred to Baunsput Govt High School under block development officer, Banki, "on the ground of administrative exigency/rationalisation".

Bengaluru: Karnataka IT and Biotechnology Minister Priyank Kharge on Wednesday slammed the Centre's decision to impose a blanket ban on online real money gaming (RMG), calling it 'another masterstroke by Modi Sarkar in bad policy making.' Kharge, son of Congress president Mallikarjun Kharge, said the decision would hit state revenues, jobs and investments. 'India earns Rs 20,000 crore annually from GST and income tax via online RMG. The ban means states lose this revenue stream,' he said in a post on 'X'. The minister noted that over 2,000 gaming startups and more than two lakh jobs in IT, AI and design would be at risk. 'A ban kills India's gaming talent pool and pushes entrepreneurs abroad,' Kharge said, adding that Rs 23,000 crore of foreign direct investment in the last five years could dry up and about Rs 7,000 crore spent annually on ads, data centres, sponsorships and cyber security would vanish overnight. Warning of unintended consequences, the minister said, 'Bans don't stop addiction or suicides. Instead, they push users to unregulated offshore platforms worth Rs 8.2 lakh crore annually where government has no control at all. 'Security risks: Unregulated sites ensure money laundering, terror financing, data theft. Even FATF and Rashtriya Raksha University warn against such risks.' Noting that the Supreme Court is still deciding whether the Centre or states have the power to regulate, Kharge questioned 'Why the rush to ban now?' He said prohibition is not the solution and called for regulating skill-based platforms, enforcing IT Rules, 2021, and whitelisting legitimate operators. 'A well-balanced regulation will ensure jobs, revenue, safer users, national security and global innovation,' he said, cautioning that 'a blanket ban will not only lead to revenue loss, but will give rise to illegal markets that might threaten national security and, of course, there will be a huge innovation setback. Regulation is the way forward.' The proposed promotion and regulation of online gaming bill, cleared by the Union Cabinet on Tuesday, prohibits online money gaming or its ads, and prescribes imprisonment or fine, or both, for those offering or advertising them, as it seeks to differentiate such games from eSports or online social games, according to a source. The bench, also comprising Justices Surya Kant, Vikram Nath, PS Narasimha and AS Chandurkar, was told by Mehta that unlike criticism made in different quarters, the post of governor is not for political asylum seekers but has certain powers and responsibility under the Constitution. The solicitor general, who continued his submissions on the Presidential Reference which raised constitutional questions on whether the court can impose timelines for governors and the president to deal with Bills passed by state assemblies, said that elaborate debates on the role and appointment of governors has taken place in the Constituent Assembly keeping in view the federal scheme of the Constitution. On Tuesday, the top court questioned the Centre and the attorney general over the long pendency of Bills passed by assemblies with governors, underscoring the limitations of Constitutional courts in situations where legislation has been pending since 2020. The top court has said it would be expressing its views only on the law and not on the April 8 decision in the Tamil Nadu case, fixing a timeline for governors and the president for acting on Bills passed by state legislatures. The top court, while responding to the preliminary objections raised by Tamil Nadu and Kerala governments on maintainability of the Presidential Reference, said it would exercise its advisory jurisdiction as it was not sitting in the appellate jurisdiction. In May, President Droupadi Murmu exercised powers under Article 143 to know from the top court whether judicial orders could impose timelines for the exercise of discretion by the president while dealing with Bills passed by state assemblies. The Centre said in its written submission that imposing fixed timelines on governors and the president to act on Bills passed by a state assembly would amount to one organ of the government assuming powers not vested in it by the Constitution, and lead to "constitutional disorder". On April 8, the apex court while dealing with the powers of the governor with respect to Bills passed by the Tamil Nadu Assembly, for the first time, prescribed that the president should decide on the Bills reserved for her consideration by the governor within three months from the date on which such a reference is received. In a five-page reference, President Murmu posed 14 questions to the Supreme Court and sought to know its opinion on the powers of the governor and president under Articles 200 and 201 in dealing with Bills passed by the state legislature.
