Teacher who molested boy in library ordered to enter defence

PETALING JAYA : The Muar sessions court has ordered a teacher to enter his defence on charges of sexually assaulting a nine-year-old boy in a Tangkak school library six years ago.
Judge Sayani Nor found that the prosecution had succeeded in proving a prima facie case in the two charges against the accused, Fauzi Musa, 37, Harian Metro reported.
The judge said he came to this decision after examining the evidence from the prosecution witnesses and case exhibits presented in court.
On both counts, Fauzi is accused of molesting the victim in the library in November 2019 and January 2020.
The charges were framed under Section 14(a) of the Sexual Offences Against Children Act 2017, which is punishable by up to 20 years in jail and whipping, if convicted.
This section involves acts of physical sexual assault committed against a child regardless of the child's consent or gender.
The charges were also read with Section 16(1) of the same Act which involves those in a relationship of trust. This provides for a maximum additional jail sentence of five years and two strokes of the rotan, upon conviction.
The incident came to light after the child's friend told the victim's mother, who then filed a police report.
Deputy public prosecutor Othman Affan Ismail prosecuted, while the accused was represented by lawyer Hanif Hassan.
The court then set Nov 10 and Nov 11 for the accused to present his defence.

The two Malaysians, Gan Xiao Zhen, 27, and her boyfriend Ong Yik Leong, 26, were attacked by an unemployed man who allegedly doused them with thinner before setting them alight near a shopping mall on Ratchadamri Road at about 10 pm on Aug 7. However, Kin In said they were worried about the medical expenses, which had already reached around 150,000 baht after just over a week of treatment at King Chulalongkorn Memorial Hospital. He said the Thai government had agreed to provide total compensation of up to 550,000 baht per person. 'We are worried that the total amount of compensation may not be enough to cover the total medical costs here, as the charges are quite high,' he said. Kin In, a retiree, added that doctors were not optimistic about allowing the victims to be transferred back to Malaysia anytime soon. 'Yesterday, Xiao Zhen had a fever and high blood pressure, but she has recovered today. Her condition is now more stable, and if her health permits, doctors will carry out minor skin operations in phases,' he said. In the latest update on Xiao Zhen's condition, Kin In said doctors estimated it would take around two months for her to recover after the skin graft procedures, which would need to be done in stages to minimise pain and discomfort. KLUANG, Aug 15 — A 36-year-old unemployed man was arrested by police for allegedly stealing 70 kilogrammes of bananas from a plantation in Kampung Sungai Besoi, Layang Layang, last night. Kluang police chief Assistant Commissioner Bahrin Mohd Noh said authorities received a report of a man trespassing at the banana plantation at 11.20pm. 'A team of policemen from the Layang Layang police station were dispatched to the plantation, where the male suspect was arrested at 11.50pm. 'Police also managed to seize six bundles of bananas weighing 70kg and confiscated a Perodua Kancil car that was driven by the suspect,' he said in a statement today. Bahrin said a check on the suspect's background found no previous criminal records, but he tested positive for methamphetamine use during a drug test. He said the case is being investigated under Section 447 of the Penal Code for criminal trespass, which carries a maximum six-month jail sentence, a fine, or both if convicted. 'We have remanded the suspect for four days starting today pending investigation,' he said. Police urged anyone with information on the case to assist investigators by contacting the Kluang district police station at 07-7784222 or its direct line at 07-7784256.

Md Mamun Ali, 31, was charged with providing support to the Islamic State (IS) terrorist group through Facebook, using an account under the name of 'Sahifulla Islam', between July 28, 2023 and April 30, 2024. The charge, under Section 130J(1)(a) of the Penal Code, provides for a life sentence or imprisonment of up to 30 years, and the possibility of a fine, upon conviction. Meanwhile, Refat Bishat, 27, was charged with possessing a picture of the IS terrorist group flag on an Honor X6a mobile phone at about 4.30pm on July 10, 2025, at a house in Larkin Industrial Estate. The charge, under Section 130JB(1)(a) of the Penal Code, provides for imprisonment of up to seven years or a fine, and the forfeiture of the goods involved, upon conviction. The men were charged before judge Ahmad Kamal Arifin Ismail, who set Sept 12 for mention for the appointment of an interpreter.
