has sought a status report from the prosecution on a plea filed by one of the men convicted in the infamous 2010 Dhaula Kuan gang rape case.
In a recent hearing, the high court was dealing with a matter concerning Shahid alias Billi, one of the five convicts in the case where a BPO employee was abducted from south Delhi on Nov 23, 2010, in a mini truck by the five men allegedly belonging to the Mewati gang.
The victim was later dumped in the Mangolpuri area after being raped by the convicts, who were soon arrested following a manhunt launched to nab them.
The men were convicted by a trial court in 2014, while their sentence was upheld by the high court in 2018. Shahid, who was out on furlough, moved the court seeking its extension.
Issuing a notice to the prosecution, the high court granted Shahid a temporary exemption from surrendering after the expiry of his furlough, originally sanctioned by govt.
In his plea, the convict sought an extension of the furlough by another 12 weeks on humanitarian grounds because his daughter, who is a minor, is suffering from cancer. He also filed photographs as well as medical documents of his daughter. The court noted that the petitioner was incarcerated for about 13 years without remission and posted the matter for further hearing next month.
However, in interim relief, the court exempted Shahid from surrendering on the expiry of his furlough.

In 2014, a sessions court sentenced all five convicts to life imprisonment. The five — Shamshad alias Khutkan, Usman alias Kale, Shahid alias Chhota Billi, Iqbal alias Bada Billi, and Kamruddin — were found guilty of the offence of gang rape and various other provisions of the IPC. The court also sentenced the convicts to seven years' imprisonment on abduction charges and five years' rigorous imprisonment for criminal intimidation, noting that the convicts would undergo the jail terms concurrently.
The prosecution sought a life term, the maximum jail term for the offences for which the men were convicted, citing the horrendous nature of the crime.

Chhattisgarh HC RAIPUR: The Chhattisgarh High Court affirmed that acts of sexual assault or harassment against children must be dealt with stringently, leaving no room for leniency under the Protection of Children from Sexual Offences (POCSO) Act. The court made this observation while upholding the conviction and sentence of three men involved in a gang rape case in Makdi village, Kondagaon district. The court observed that a minor subjected to sexual abuse requires greater protection than an adult victim, as an adult may still be able to endure social ostracism and mental harassment inflicted by society, whereas a minor is far less equipped to cope. Most crimes against minors often go unreported, as the perpetrator is frequently a family member or a close acquaintance. Therefore, a child victim needs special protection, and no leniency can be extended to an accused found guilty under the POCSO Act , 2012, especially when the offence is proven by adequate evidence before a court of law. A division bench of Chief Justice Ramesh Sinha and Justice Bibhu Datta Guru delivered a common judgment on three criminal appeals filed by three accused. The appellants challenged the judgment dated August 25, 2021, passed by the Additional Sessions Judge (FTC) Kondagaon. Four boys gagged and dragged the victim to a field, where they sexually assaulted her and threatened to kill her. The victim identified the accused with the help of mobile torchlight. Following her complaint, a case was registered under Sections 376(D), 506 of the Indian Penal Code, and Sections 4, 6 of the POCSO Act. The court verified the victim's age, based on her father's statement and school records, confirming she was 13 years old at the time of the incident, falling under the definition of "child" as per Section 2(d) of the POCSO Act. Medical evidence also corroborated that sexual intercourse occurred within 24 hours of her examination. The court reiterated that the testimony of a prosecutrix in sexual offence cases does not require corroboration if it inspires confidence, citing previous Supreme Court rulings. The victim's consistent account to her parents, villagers, and the trial court, along with the corroborating statements of an eyewitness and other prosecution witnesses, were key to the conviction. The FSL report also confirmed the presence of semen stains, supporting the sexual assault. The High Court observed that the prosecution successfully proved beyond reasonable doubt that the victim was a minor at the time of the incident and that the accused committed aggravated penetrative sexual assault by gang-raping her. The court found no illegality or irregularity in the findings recorded by the Sessions Judge. The appeals were dismissed, and the conviction and sentence awarded by the trial court were upheld.

MANGALURU: In an incident that recently came to light, a woman from Rekya village in Beltangady taluk reported the theft of gold jewellery worth Rs 2.6 lakh from her home. Kusuma, 48, the complainant, stated that she and her husband follow a daily routine of locking their house and placing the key in the cattle shed before heading to work. According to her complaint, she owned approximately 52 grams of gold jewellery, including a chain, bangle, and earrings, which she stored securely in a locked cupboard inside their house. The key to the cupboard was usually kept in a corner of the house. She last saw the jewellery on May 23. However, on June 14 around 6.30 pm, while preparing to visit a temple, the couple looked for the jewellery, and the valuables were missing. The key remained in its usual place, suggesting that someone familiar with their routine may have accessed the locker. A case was registered at the Dharmasthala Police Station under Sections 331(1) and 305 of the Bharatiya Nyaya Sanhita (BNS), 2023. He employed Jobin Mathew as a rubber tapper on May 3, who was also residing in the plantation's shelter. According to the complaint, between 1pm on May 17 and 8pm on May 19, Jobin allegedly stole around 13 quintals of collected rubber scrap and absconded. The stolen material is estimated to be worth Rs 1.25 lakh. Vino said he travelled to Kerala to trace the accused at his native place but was unable to locate him. The complaint was filed after these efforts failed, leading to a delay in reporting the incident. A case was registered at Venur Police Station under Section 306 of the Bharatiya Nyaya Sanhita (BNS).
