SC issues guidelines to make Tamil Nadu prisons accessible for prisoners with disabilities
"The denial of accessibility and essential care to persons with disabilities incarcerated in prisons amounts to violation of fundamental rights under Articles 14 (right to equality) and 21 (right to life and liberty) of the Constitution," said a two-judge Bench of the top court of Justices JB Pardiwala and R Mahadevan.
The top court passed the verdict after hearing an appeal filed by one, L Muruganantham, a physically disabled advocate, who had alleged custodial abuse and inadequate medical care while incarcerated in a prison in Tamil Nadu in a case.
Upholding the dignity and the healthcare rights of the prisoners with disabilities, the apex court directed the State to amend the State Prison Manual within 6 months to make it in compliance with the Rights of Persons with Disabilities Act, 2016 (RPwD Act), and other provisions.
"Social and structural barriers they face in society are only magnified within the prison environment. Most prison facilities are structurally inaccessible to individuals with mobility, sensory, or cognitive impairments,' the Court said.
Highlighting that the State has a constitutional and moral obligation to uphold the rights of prisoners with disabilities, the apex court added, this right was not restricted to ensuring non-discriminatory treatment also carries with it an affirmative right to ensure effective rehabilitation and reintegration into society.

NEW DELHI: In an important judgment reinforcing the constitutional safeguards against custodial torture, the Supreme Court on Monday directed the CBI to register an FIR over the "brutal and inhuman custodial torture" of a police constable in Jammu and Kashmir and ordered the Union Territory administration to pay him Rs 50 lakh as compensation. "In order to provide some solace to the victim and his family for the barbaric acts of custodial torture leading to complete castration, we hereby direct the Union Territory of Jammu & Kashmir to pay compensation of Rs 50,00,000/- (Rupees Fifty Lakhs) to the appellant (victim), Khursheed Ahmed Chauhan. The said amount shall be recoverable from the officer(s) concerned, against whom departmental proceedings shall be initiated upon conclusion of the investigation by the CBI. The CBI shall submit its status report by November 10, 2025, to this court," said the apex court. "The injuries caused to the constable during his illegal detention, particularly the complete mutilation of his genitalia, the use of pepper/chilly powder, and electric shocks on his private parts, are grave reminders of the inhuman torture meted out to him. The cumulative effect of all these facts is deeply shocking to the conscience of this court," the two-judge bench of the top court, headed by Justice Vikram Nath and Justice Sandeep Mehta, observed.

The Vice President of India is the chairperson of the Rajya Sabha. "To prioritise health care and abide by medical advice, I hereby resign as the Vice President of India, effective immediately, in accordance with Article 67(a) of the Constitution. New Delhi: Vice President Jagdeep Dhankhar's abrupt resignation on Monday evening has opened the contest for his successor. With the ruling BJP-led National Democratic Alliance (NDA) enjoying a majority in the electorate, which includes the members of the Lok Sabha and the Rajya Sabha, it was taken by surprise by Dhankhar's decision to quit. It is likely to consider the probable names in the coming days. One of the governors, as Dhankhar was of West Bengal before taking the vice president's office, or a seasoned organisational leader or one of the Union ministers -- the BJP has a large pool of leaders to choose from for the position. Dhankhar's predecessor was M Venkaiah Naidu, a former Bharatiya Janata Party (BJP) president who was in the Cabinet of Prime Minister Narendra Modi when he was tapped by the party for the key constitutional position in 2017.
