
Pune Porsche Crash Left 2 Dead. Drunk Driver, 17, Won't Be Tried As Adult
The main accused in the Pune Porsche crash case - in which an allegedly drunk teenager rammed his father's Rs 2.5 crore electric supercar into a two-wheeler and killed two software professionals - cannot be tried as an adult now, despite having crossed that threshold, the Juvenile Justice Board has said.
The main accused - out 'celebrating' exam results by heavy underage drinking, and running up a bill of Rs 48,000 in just 90 minutes - was 17 years old at the time of the tragic incident; he was four months short of the legal age for driving and eight years shy of Maharashtra's legal drinking age, which is 25.
The crash, and the death of Aneesh Awadhiya and Ashwini Koshta, both from Madhya Pradesh and both just 24, led to outrage, particularly since the accused is the son of a prominent Pune businessman and the local police were accused of deliberately mishandling critical evidence to ensure his release.
This included feeding him burgers immediately after the crash to hide or dilute the alcohol in his bloodstream. Local police reportedly also did not alert their superiors, as required to by law.
There were also questions asked of the medical professionals involved, including doctors tasked with extracting and securing samples from the accused to test for blood alcohol levels.

It soon transpired the blood samples had been replaced with those of his mother - who was arrested and then released in April - in a crude attempt to conceal the fact he was driving while drunk.
And finally the Juvenile Justice Board itself faced scrutiny after allowing the boy bail 15 hours after the crash. The conditions imposed - one was to write a 300-word essay - were slammed as 'ridiculous'.

Faced with backlash over these conditions, the JJB then directed the boy be placed in the custody of state authorities. However, this order was countered by the Bombay High Court.
Last year Pune Police had sought permission to try the main accused - the others included members of his family for trying to destroy evidence - as an adult, citing his "heinous" act.
In May, exactly a year after the crash, and with no sign of justice for his son Anish, Om Awadhiya said, "Our son is no longer with us; nothing can compensate for that loss, but justice would send a strong message against drunk driving and those who believe money and power put them above the law."
"This entire year has been painful for me, my wife, and our whole family. Not a single day goes by without us remembering him and cherishing his beautiful memories. After Anish's tragic death, our world has come crashing down," Mr Awadhiya, who lives in Madhya Pradesh, said.
At present the boy's father, doctors Ajay Taware and Shrihari Halnor, hospital employee Atul Ghatkamble, and two middlemen are in jail in connection with this case.
The boy remains with his family.

ED attaches Rs. 15.47 crore property of Delta Ltd in money laundering case
Kolkata, July 26 (UNI) The Enforcement Directorate (ED) has attached immovable properties worth Rs 15.47 crore belonging to Delta Ltd and others in connection with a money laundering case. The ED has also submitted a final charge sheet July 24 in a special court under the Prevention of Money Laundering Act (PMLA) in Kolkata against the company and 7 others, agency officials said. The central anti-laundering money agency began its probe on the basis of an FIR registered at Hare Street Police Station, Kolkata, following a directive from Calcutta High Court on writ petitions alleging non-payment of statutory dues, such as Provident Fund (PF), despite regular salary deductions. The FIR was lodged against Delta Ltd and others for alleged criminal conspiracy, cheating, and misappropriation of workers' Provident Fund deductions. The ED's investigation revealed that nearly 800 workers of the company and its associated entities were cheated through the misuse of their PF fund trust (Delta Jute & Industries Ltd Worker's Provident Fund Trust). The company had been granted exemption under the Employees Provident Funds (EPF) Act, allowing it to manage PF money through its own trust. This trust was intended to operate and ensure proper investment of employees' PF funds. However, in violation of the mandate, employees were appointed as trustees instead of professionals or fund managers. These employees acted solely under management's directions and had no real decision making power. Due to continuous violations and financial losses, the exemption was revoked in 2014. Despite this, and even after ongoing court proceedings, the company continued deducting PF from workers' salaries but failed to deposit it with either the trust or PF authorities, the ED said. "The money was wrongfully retained as the company deliberately avoided depositing the statutory contributions deducted from employees," the ED noted. According to the agency, the withheld amounts were subsequently laundered and used for non-permitted purposes, including loan repayment, meeting business expenses, and property transactions. The total Proceeds of Crime (POC) in the case amount to Rs.15.47 crore. The comments came while quashing the 2015 dismissal of special court judge Jagat Mohan Chaturvedi, who was removed from service for granting bail in a case. The bench found no material evidence of misconduct or corruption against him and directed the state to pay Rs 5 lakh as compensation for the damage to his reputation. The court observed that incidents of district judges being made to personally attend to high court judges at railway stations or being denied a seat in official meetings reflect a colonial hangover and a persistent culture of entitlement. 'The dismal relationship between the judges of the High Court and the judges of the District Judiciary is one between a feudal lord and serf," the bench said. It further stated that such power dynamics contribute to a backlog of bail applications and appeals, as district judges often function in fear of being penalised for their judicial decisions. The judgment underlined the psychological burden carried by the lower judiciary, stating: 'The subjugation and enslavement of the psyche of the judges of the district judiciary is complete and irreversible, so it seems." The court also restored Chaturvedi's pensionary benefits and ordered payment of back wages with 7 per cent interest from the date of dismissal to the date he would have superannuated.
