On Tuesday, as an official of Faridabad's Neemka jail announced the name of 24-year-old Nitesh, informing about his release on bail, another man stepped forward. A name was not the only thing the 27-year-old man shared with Nitesh; both inmates, who were undertrials in the same ward, also had the same father's name: Ravinder. Taking advantage of the mix-up, and the fact that the Nitesh the jail official was looking for was elsewhere, Nitesh Pandey managed to walk out of jail.
On Saturday, Faridabad Crime Branch apprehended Pandey from Kalyanpur village in Patna, Bihar, following a tip-off.
'The two undertrials were in the same ward. Pandey had knowledge of the impending bail order for Nitesh, and the fact that the father's name of both the men were the same. When a jail official announced Nitesh's name to instruct him to step out of the ward, Pandey, taking advantage of Nitesh's absence, raised his hand, managing to get free,' a Faridabad Police spokesperson told The Indian Express on Sunday.
Pandey was arrested in October 2021 for alleged sexual assault on a nine-year-old boy in Sector 58. The other Nitesh, who goes by only one name, is a resident of Shastri Colony, Faridabad, and had secured bail on May 26 in a trespassing and assault case.
Pandey's fraud was discovered when his namesake, still in custody despite the bail order, inquired about his release. Records were soon examined, which revealed that Pandey had been released instead.
An FIR was filed against Pandey on Wednesday at Ballabhgarh Sadar police station under sections 262 (obstructing lawful apprehension) and 319 (cheating by personation) of the Bharatiya Nyaya Sanhita (BNS).
Pandey, hailing from Patna, was earlier booked under Indian Penal Code (IPC) sections 377 (unnatural sex), 506 (criminal intimidation), and Section 6 of the Protection of Children from Sexual Offences (Pocso) Act. His bail plea was rejected in 2022, and his trial in the case is underway.
'Undertrial prisoner Nitish Pandey … who, knowing that there are no bail papers in his name, concealed his identity and got himself released in the name of another prisoner,' the complaint by Vikram Gill, Faridabad Jail Superintendent, read.
Five Neemka jail staff members were suspended on Friday for alleged lapses on their part, and face departmental proceedings. Assistant Superintendent Mohanlal, Deputy Superintendent Pradeep Tyagi, Head Constable Rajendra and wardens Sanjeev and Rajesh were suspended based on an internal investigation conducted by Jail Superintendent Harendra Singh.
The inquiry report highlighted negligence on their part, following which they were suspended by the Director General of Prisons, Gill had said.
The original Nitesh, meanwhile, walked out of jail on Wednesday – a day after he was supposed to be released.

THANE: In a major breakthrough in the ₹91-crore 'Q Phone App' fraud, the Thane police have arrested Parag Ashok Kumar Shah, one of the main accused in the case. After months of ducking law enforcers, Shah was arrested from Narayangaon near Pune on Wednesday, and has been remanded to police custody till June 11. He is the third individual to be arrested in the case. The elaborate Ponzi scam, which defrauded 120 investors with promises of high returns through a fake digital investment model, was perpetrated under the banner of a company named 'Q Phone App'. Investors were led to believe that Q Phone App developed applications for Google. They were promised substantial returns in US dollars through revenue generated from digital advertisements. The fraud took place between May 2020 and January 2024, and operated across many states. The case was registered at Vartak Nagar police station in Thane under Sections 406 (criminal breach of trust), 409 (criminal breach of trust by public servant or banker), 420 (cheating), 34 (common intent) of the Indian Penal Code (IPC) and sections of the Maharashtra Protection of Interests of Depositors (MPID) Act. The Economic Offences Wing (EOW), Thane, which is investigating the case, suspects that the number of victims and the total defrauded sum will rise as more people come forward. A senior police officer said Parag Ashok Kumar Shah was a small businessman from Narayangaon. He met some businessmen from Gujarat and they committed the crime together. 'The group took money in cash and used it for personal gain,' he said.

As the police are yet to arrest a teacher, who has been booked for reportedly sodomising a 15-year-old student in Nabha town of Patiala district, the Punjab State Commission for Protection of Child Rights (PSCPCR) on Wednesday issued a notice to the Patiala SSP directing him to submit a report on the matter by June 13. The commission said that they had taken a suo-motu cognisance of the matter and directed Patiala SSP to thoroughly investigate the case and file an action-taken report in the matter before the commission by June 13. The commission in its notice to SSP Patiala has stated that the commission is empowered to conduct a suo motu inquiry under Section 13 of the Protection of Children from Sexual Offences Act, 2012, whenever there were violations of child rights. 'This is a serious issue. We will ensure that the police conduct a fair and speedy investigation into the case. Though the accused is a decorated teacher, we will ensure the rule of law prevails,' said Kanwardeep Singh, chairman, Punjab State Commission for Protection of Child Rights. When asked about the boy being threatened in the court by an unidentified individual, the chairman said that they would ensure the safety of the victim. 'We will take care of the safety of the victim. Besides, we will look after his mental health also,' said Singh. The accused teacher is a physical education teacher at Government High School and was booked under Section 6 of the Protection of Children from Sexual Offences Act (POCSO) Act and 351 (2) of the Bharatiya Nyaya Sanhita (BNS). Meanwhile, Patiala police said raids were being conducted to nab the accused. The Punjab education department on Monday suspended the accused teacher.

Belgium on Wednesday confirmed that the foreign citizen who allegedly put up posters carrying a photograph of Israeli Prime Minister Benjamin Netanyahu alongside the word 'Wanted' in Chanakyapuri area of the national capital was a staffer of a government export and investment agency linked to its embassy. On Tuesday, The Indian Express had reported that the Delhi Police have approached the Union Ministry of Home Affairs (MHA) on the issue. Responding to questions from The Indian Express, the Belgian Foreign Ministry spokesperson said on Wednesday, 'The Belgian Ministry of Foreign Affairs is aware of the incident.' The spokesperson said the 'person works for the Wallonia Export & Investment Agency (AWEX)'. Wallonia is one of the three regions of Belgium — the other two being Brussels and Flanders — and has some companies which are world leaders in armaments, glass production, lime and limestone production, and aviation parts. AWEX is the region's government agency in charge of foreign trade promotion and foreign investment attraction. 'For the time being, (neither) the Belgian Ministry of Foreign Affairs nor the Embassy of Belgium in New Delhi have received requests from the Indian authorities on this matter,' the spokesperson said. The Indian Express had reported that the matter came to light around 7.30 am on May 29 when personnel from the Chanakyapuri police station spotted two such posters on electricity poles – one near the Carmel Convent School in Malcha Marg and another near the American Embassy School. 'They informed their seniors and were asked to remove the posters,' a Delhi Police officer had said. 'After scanning footage from around 50 CCTV cameras, police personnel found that a man wearing a blue shirt and black trousers came on a bicycle at around 5.30 am and put up one of the posters on an electricity pole. After scanning multiple CCTV cameras, it has been revealed that he left from one of the flats in Sardar Patel Marg,' the officer had said. A team from the Chanakyapuri police station then reached his residence and identified the occupant. Since it involves a foreign national working for an agency associated with the Belgium Embassy, the Indian officials are cautious on how to proceed. It is a sensitive matter pertaining to certain immunities granted to embassy staffers. Although the person concerned is not a diplomat and therefore doesn't enjoy full diplomatic immunity, it is a grey area and Delhi is treading the issue with some degree of caution.
