
Ex-DWP employee identifies key reasons State Pension cannot be means-tested by UK Government
Pensions Minister Torsten Bell confirmed last month that the State Pension will not be means-tested in the future after growing speculation on social media hinted that the contributory benefit would be the next to be reviewed by the Labour Government.
Under the Triple Lock, the New and Basic State Pensions increase each year in-line with whichever is the highest between average annual earnings growth from May to July, Consumer Price Index (CPI) inflation in the year to September or 2.5 per cent. Deferred State Pensions and additional elements rise by the September CPI inflation rate.
Around 55 per cent of social security expenditure goes to pensioners - in 2025/26 the Department for Work and Pensions (DWP) will spend £174.9 billion on benefits for pensioners. This includes spending on the State Pension which is forecast to be £145.6bn over the current financial year.
As the costs continue to rise, the topic of means-testing will no doubt surface again, however, former DWP employee Sandra Wrench, who has 42 years' experience dealing with benefits including the State Pension, says it would be 'virtually impossible' to means-test the State Pension due to the different administration structures for the New and Basic State Pensions.
Mrs Wrench told the Daily Record: 'There are two main barriers that the Uk Government would face if they did go down this path and why it makes it virtually impossible to means-test the State Pension.
'I worked on the State Pension section at Bedford DWP for 18 years, and when you actually process claims for the State Pension, you have a greater understanding and knowledge of the benefit.'
Voluntary Contributions paid by way of cash
You can fill in gaps in your National Insurance (NI) record by paying cash into the State Pension scheme by way of Voluntary Contributions.
Mrs Wrench explained: 'You are not going to pay cash into a scheme unless you can get your money back. We look at the recent time extension for the payment of Voluntary Contributions from 2006, where the deadline was originally April 5, 2023, but this was extended by the UK Government to April 5, 2025, so they are still actively encouraging the payment of Voluntary Contributions.
'Would they be doing this if they were going to means-test the State Pension? The answer is no.'
She continued: 'If the State Pension was means-tested, HM Revenue and Customs (HMRC) would have to refund Voluntary Contributions to those members of the public, who had paid them, but were not entitled to the payment of State Pension.
'State Pension is based on the NI contributions you pay from age 16 to State Pension age - typically, a period of 50 years - so some people may have paid Voluntary Contributions 20/30 years ago for a period in the future.
'It is unlikely that HMRC would retain detailed payment details of Voluntary Contributions, both Class 3 and Class 2, paid all those years ago, even though the NI record will confirm that Voluntary contributions have been paid, which count towards qualifying years.'
The DWP insider highlighted how if the State Pension was means-tested, would HMRC be able to refund NI contributions from all those years ago?
Mrs Wrench said: 'In a nutshell, the answer is probably no, unless the customer had kept detailed records of all payments made for past years.'
She continued: 'I myself paid a substantial sum into the Additional Pension Top Up scheme for those who were State Pension age before April 2016, and this scheme ran between Oct 2015 and April 2017.
'Due to the higher rate of Basic State Pension for the New State Pension, currently £230.25 a week, this gave those pensioners who were State Pension age before April 2016 with the lower amount of Basic State Pension, currently £176.45 a week, the opportunity of purchasing up to £25 a week additional pension to help bridge this gap.'
It's important to note that the Additional Pension uprates annually under the CPI measure of the Triple Lock.
Additional Pension (1978-2016) and contracted out employment
The Old?Basic State Pension scheme consists of three parts:
Basic State Pension - paid on the number of qualifying years which you have
Additional pension - first known as SERPS (State Earnings Related Pension Scheme) from 1978, then known as the Second State Pension from 2002 to 2016, and it was the additional State Pension scheme you could contract out
The Graduated Retirement Pension which existed from 1961-1975
Mrs Wrench explained that with 'contracted out' employment, your additional pension is paid with your occupational pension as opposed to being paid by the state.
She continued: 'DWP have admitted and confirmed in writing that they do not know the exact amount your scheme will pay you as a result of contracting out as it will depend on the actual rules of your private scheme.
'So DWP would have to estimate the amount of additional pension in pay for State Pension purposes, if that person had been in contracted out employment. So how can you means-test an amount which is estimated?
'DWP have stated that the pension you get from your workplace or personal pension scheme for the periods you were contracted out, should include an amount that, in most cases, will be the equivalent of the Additional State Pension you would have got if you had not been contracted out, and this amount is known as the Contracted-Out-Pension-Equivalent (COPE).
'DWP will know how much Additional Pension you would have got if you had not been contracted out, but this figure will be distorted once it is incorporated into an occupational pension scheme, via contracted out employment.'
Contributory and Non Contributory Benefits
Mrs Wrench explained how non contributory benefits are funded by general taxation and do not depend on NI contributions, and are benefits such as Attendance allowance, Carer's Allowance, Child Benefit, Universal Credit and Personal Independence Payment.
Contributory benefits are funded by NI contributions and include benefits such as Jobseekers Allowance, Employment and Support Allowance, State Pension and Statutory Sick Pay.
Mrs Wrench said: 'You could understand non contributory benefits being means tested, such as Universal Credit, but you would be hard pushed to start means testing contributory benefits, such as State Pension, as the payment of these depend on NI contributions paid by the public, and the public have paid into the scheme.
'With means testing, you are paid the benefit on a temporary basis, and if your circumstances change, the amount of money you are paid could fluctuate. The last thing you want when you reach retirement is fluctuating income, and the anxiety which accompanies this .
'At least with the State Pension, you receive what you are entitled to, know exactly how much money you have coming in a month and know exactly where you stand financially'
She added: 'To mention means-testing the State Pension may cause concern for some people, particularly when their State Pension may be their main source of income, but for the reasons mentioned above, it is highly unlikely that the government would be actually able to means-test it.'

New HMRC service announced for workers to take control of their tax

Income tax rises for Scots in April - how the changes affect you Workers are set to take control of their tax affairs after the UK Government announced a new online Pay As You Earn (PAYE) service for around 35 million UK taxpayers as HM Revenue and Customs (HMRC) sets out more than 50 measures to transform the UK's tax and customs system. The new online service for all PAYE taxpayers will make it simpler and easier to check and update their income, allowances, reliefs and expenses, and will be available via their Personal Tax Account on or on the official HMRC app. This service forms part of HMRC's Transformation Roadmap, which launched earlier this week. It sets out ambitious plans to become a digital first organisation by 2030, with 90 per cent of customer interactions taking place digitally. The roadmap sets out more than 50 IT projects, services and measures that, once delivered, will transform the UK's tax and customs systems, simplifying processes and making it easier to pay the tax that funds public services and deliver the UK Government's Plan for Change. The plans to modernise the tax and customs system, introduce new AI technologies and work with third parties and intermediaries will make it easier for taxpayers, businesses and intermediaries to interact with HMRC. The digital first approach will see HMRC automating tax wherever possible and offering new digital self-serve options across a number of tax regimes. Alongside the new PAYE service, HMRC will save £50 million a year - the equivalent of almost 1,500 full time nurses - by moving customer letters and reminders to a digital first approach, reducing the reliance on paper correspondence, by the 2028 to 2029 tax year. Paper post provision will remain for critical correspondence and for the digitally excluded. HMRC said increasing the use and investment in AI will enable customers to meet their tax obligations and allow the tax body to monitor the system in near real time. HMRC plans to introduce AI in work areas HMRC advisers and caseworkers: using AI capability to automate call summaries and the use of internal GenAI Chat Assistants to support them in their work. Digital assistants: developing new AI-powered features to help customers easily navigate HMRC services and improve the ability to update HMRC's content and guidance on Compliance: delivering an automatic document identifier system for HMRC caseworkers to identify fraudulent documents during compliance activities by using a biometric likeness-liveness check. HMRC said it will work with developers to create a set of principles which will set out HMRC's expectations of how third parties use AI in software where it interacts with the department and the tax administration system. These principles will give developers the confidence to introduce AI functionality into their products in the UK and minimise the risk of those products introducing error or non-compliance. James Murray MP, Exchequer Secretary to the Treasury, said: 'We are going further and faster to make HMRC fit for the 21st century, including delivering a simpler and easier system for all PAYE workers. 'By 2030, taxpayers can expect a modern and innovative HMRC with cutting-edge AI, industry-leading customer service practices, and a laser focus on delivering taxpayer value for money by ensuring everyone pays their fair share.' Mr Murray's key priorities for the department are: improve day-to-day performance and the customer experience reform and modernise the tax and customs system close the tax gap As announced at the Spending Review 2025, £1.7 billion will be provided to HMRC over four years to fund an additional 5,500 compliance and 2,400 debt management staff. HMRC said this will ensure more of the tax owed is paid, to fund public services. HMRC is focusing on tackling wealthy offshore tax non-compliance, with an additional 400 people set to work on wealthy offshore tax risks. This includes experts in private sector wealth management, who will help find and tackle non-compliance more effectively and train HMRC compliance staff. JP Marks, HMRC's Chief Executive and First Permanent Secretary, said: 'The Government's ambition is for a simpler tax and customs system and this roadmap sets out how HMRC will deliver a first-class experience that feels different to their customers. 'By 2030, UK citizens will experience a tax administration system that is more automated, more focused on self-service, and better set up to get things right first time so they can fulfil their tax obligations.' The Transformation Roadmap sets out timescales for delivery and HMRC is committed to reporting on progress. Work is underway to deliver some of the measures set out in the roadmap this tax year, including: extending the rollout of the SMS confirmation service to Self Assessment appeals, complaint cases and some PAYE services. improving Self Assessment registration service and streamlining the exit process for those customers who no longer need to file a Self Assessment tax return. expanding the rollout of the voice biometrics pilot to make customer verification easier when calling HMRC's helplines. a new service to give employed parents, who are newly liable for the High Income Child Benefit Charge, the choice to pay it directly through their tax code without needing to register for Self Assessment. launching an enhanced reward scheme for informants, targeting information on serious non‑compliance in large corporates, wealthy individuals, offshore and avoidance schemes. The new scheme will reward informants with compensation linked to a percentage of any tax taken. Further measures and projects to be delivered as part of the roadmap include: digitalising the Inheritance Tax service to provide a modern, easy-to-use system, that makes submitting returns and paying tax simpler and quicker. launching a new service to allow agents to digitally submit information which may impact their client's tax code. delivering a Digital Disclosure Service to allow customers and intermediaries to correct mistakes, pay liabilities and penalties for all taxes and duties. introducing an electronic trade documentation pilot to see how it could improve customs operations. progressing the Verifiable Credentials pilot with US Customs and Border Protection to test the use of new internationally interoperable digital credentials and identity standards. HMRC wants to incentivise taxpayers to pay their tax on time by simplifying and strengthening penalties. In the 2023 to 2024 tax year, HMRC collected 94.7 per cent of the total tax due. Those who meet their obligations and pay their tax on time should not be disadvantaged by the minority who don't follow the rules. HMRC will update on modernising behavioural penalties later this year.

Older women urged to check for State Pension back payments worth over £8,300
The Department for Work and Pensions (DWP) has said that between January 8, 2024 and March 31, 2025, a joint State Pensions corrections exercise with HM Revenue and Customs (HMRC), identified 12,379 State Pension underpayments to women whose National Insurance (NI) records are incorrect. In 2022, the DWP became aware of a number of State Pension cases where it appeared that historic periods of Home Responsibilities Protection (HRP) were missing, leading to inaccurate State Pension payments. So far, around £104 million in arrears have been paid out, with an average payment of £8,377. Retirement expert Helen Morrissey is urging older people to complete the online form or contact the Pension Service if they think they have been affected after new research from the DWP showed the main reasons why those who have received a letter from HMRC asking them to check their State Pension - as it could be wrong - have failed to do so. HMRC has sent out more than 370,000 letters - mostly to women - urging them to check their State Pension payments as they may be lower than they are entitled to. However, the DWP research indicates that the majority of people contacted by letter did not go on to apply for HRP. Barriers included: Not understanding the letter Thinking the communication was a scam Reliance on digital methods to put in a claim HRP was a scheme designed to help protect parents' and carers' entitlement to the State Pension and was replaced by NI credits from April 6, 2010. HMRC is using NI records to identify as many people as possible who might have been entitled to HRP between 1978 and 2010 and have no HRP on their NI record. After May 2000, it became mandatory to include a NI number on claims so people claiming after this point will not have been affected. The head of retirement analysis at Hargreaves Lansdown, said: 'This research lays bare the complexities the government faces in resolving the long running issue of underpaid State Pensions. The State Pension system has become so confusing that even when the UK Government has communicated with those who may have a claim, the complexity and jargon has put many of them off. This means many thousands are getting less than they are entitled to. 'Issues identified by the government include the use of jargon. Many simply didn't understand what was being asked of them -that mistakes made decades ago had been identified and could be rectified. 'Terms such as Home Responsibilities Protection haven't been used for many years - it's understandable that people may have little recollection as to whether they claimed it or not. 'The reliance on online forms to claim refunds was also a significant barrier, with many not feeling internet savvy enough to navigate the system without help.' Ms Morrissey continued: 'Notably many people decided not to take action because they feared doing so might actually reduce their state pension or they were scared that they had been targeted by scammers. It's clear the government faces an uphill battle if it is to successfully reunite those affected with their extra pension payments. 'The introduction of the New State Pension system in 2016 was meant to simplify things - and it should, but again challenges remain for these younger groups. Those who opted out of Child Benefit because of the High-Income Child Benefit Charge will not have known that by doing so they risk missing out on National Insurance credits towards their State Pension.' The UK Government has put measures in place to deal with this, but Ms Morrissey warns it remains something that can 'trip people up and so awareness needs to be raised on an ongoing basis'. The retirement expert added: 'Encouraging people to check their State Pension record to see if there are any gaps is vital - if there are mistakes, then they have time to correct them. 'If the gap has occurred during a period of time when they qualified for a benefit, such as Child Benefit, then they can backdate a claim and get the gaps filled for free. There's also the option of paying for voluntary contributions to make sure you get the most from your state pension.' How to use the online HRP tool You may still be able to apply for HRP, for full tax years (6 April to 5 April) between 1978 and 2010, if any of the following were true: you were claiming Child Benefit for a child under 16 you were caring for a child with your partner who claimed Child Benefit instead of you you were getting Income Support because you were caring for someone who was sick or disabled you were caring for a sick or disabled person who was claiming certain benefits You can also apply if, for a full tax year between 2003 and 2010, you were either: Who qualified automatically for HRP The guidance on explains that most people got HRP automatically if they were: getting Child Benefit in their name for a child under the age of 16 and they had given the Child Benefit Office their National Insurance number getting Income Support and they did not need to register for work because they were caring for someone who was sick or disabled If your partner claimed Child Benefit instead of you If you reached State Pension age before April 6, 2008, you cannot transfer HRP. However, you may be able to transfer HRP from a partner you lived with if they claimed Child Benefit while you both cared for a child under 16 and they do not need the HRP. They can transfer the HRP to you for any 'qualifying years' they have on their National Insurance record between April 1978 and April 2010. This will be converted into National Insurance credits. Married women or widows You cannot get HRP for any complete tax year if you were a married woman or a widow and: you had chosen to pay reduced rate Class 1 National Insurance contributions as an employee (commonly known as the small stamp) you had chosen not to pay Class 2 National Insurance contributions when self-employed If you were caring for a sick or disabled person You can only claim HRP for the years you spent caring for someone with a long-term illness or disability between April 6, 1978 and April 5, 2002. You must have spent at least 35 hours a week caring for them and they must have been getting one of the following benefits: Attendance Allowance Disability Living Allowance at the middle or highest rate for personal care Constant Attendance Allowance The benefit must have been paid for 48 weeks of each tax year on or after April 6, 1988 or every week of each tax year before April 6, 1988. You can still apply if you are over State Pension age. You will not usually be paid any increase in State Pension that may have been due for previous years. If you were getting Carer's Allowance You do not need to apply for HRP if you were getting Carer's Allowance. You'll automatically get National Insurance credits and would not usually have needed HRP. If you were a foster carer or caring for a friend or family member's child You have to apply for HRP if, for a full tax year between 2003 and 2010, you were either: a foster carer caring for a friend or family member's child ('kinship carer') in Scotland All of the following must also be true: you were not getting Child Benefit you were not in paid work you did not earn enough in a tax year for it to count towards the State Pension If you reached State Pension age on or after 6 April 2010 Any HRP you had for full tax years before April 6, 2010 was automatically converted into National Insurance credits, if you needed them, up to a maximum of 22 qualifying years. 'Martin Lewis tip helped me get back £31,674 from HMRC - others are owed money too'

The reader, known only as Cilla, had unknowingly been underpaid her state pension for 15 years. The issue relates to an old version of National Insurance credits, known as Home Responsibilities Protection (HRP). HRP reduced the number of qualifying years you need on your National Insurance record to claim the state pension - however, an investigation found thousands of people, mainly women who had to take time off work to look after children or other family members, did not have the correct level of HRP applied to their National Insurance record. It was revealed that Child Benefit claim forms submitted before 2000 did not include a National Insurance number - and this led to HRP not being correctly applied to National Insurance records. You could be impacted by this error if you made a claim for Child Benefit between 1978 and 2000. Your National Insurance record is used to determine if you receive the full amount of state pension in later life. As HRP was designed to reduce the number of years you need, missing out on this protection means you may have gaps in your National Insurance record and may not be getting the full amount of state pension that you're entitled to. HRP was replaced by National Insurance credits from 2010 onwards. MSE reader Cilla wrote into the money-saving website to explain her success at claiming backpay. Her story was published in the latest MSE newsletter. She said: " I've just received 15yrs' back pay from HMRC of £31,674 for underpayment of my pension. Thank you." Latest figures from HMRC shows 370,000 women have been contacted regarding potential underpayments, with the Department for Work and Pensions ( DWP) paying back £7,859 on average per person, so far. Of those who responded to the letters, HMRC identified 5,344 cases of underpayments between January 8 and September 30, 2024, totalling approximately £42million in arrears. It's believed 43,000 of those who are estimated to be affected by the historic error are now deceased, but their families can claim on their behalf. Those over pension age are being prioritised and contacted first by HMRC. If you suspect you have missed out, you should first check your state pension and your National Insurance record. If there are gaps in your National Insurance record between 1978 to 2010, and you took time off work to care for someone during this time, then you may be missing HRP. You can make a claim for missing HRP by using the online service on or by filling out this form and posting it back to HMRC.
