‘I am entitled to the winter fuel payment but my husband isn't – what will we get?'

Write to Pensions Doctor with your pension problem: pensionsdoctor@ Columns are published weekly. Dear Charlene, I was initially very happy with the winter fuel announcement, but I'm now confused about whether my husband and I will get it. The new rules talk about an income of over £35,000 per person ruling someone out, but I've also read that it will be paid per household like it was before last year's changes. My husband David is already 80 and I am about to turn 78. We both get a state pension and I have a small annuity paid to me each month from an old work pension meaning I'm well under £35,000. But my husband has a final salary pension of around £3,300 a month (before tax) putting him above the £35,000. I stand to inherit 50pc as a widow's pension if he passes away before me – would that also count? Our savings are mostly in cash split between Premium Bonds, some joint savings accounts and cash Isas. We don't pay any tax on our Isas and my interest is all tax-free thanks to the personal income allowance and the extra savings allowances. My husband pays tax through his pension. Is it all his (or our household) income that counts towards the £35,000 or does his £12,570 personal allowance count too? I'm sure we aren't the only ones confused – please can you explain for people like us? Many thanks, – Joy Dear Joy, I'll start by explaining who will get the winter fuel payment (WFP) this winter, before looking at what makes up that £35,000 and how it might work for couples such as yourself and David. In fewer than 12 months, we've seen two changes as to who is eligible for WFP. This week's announcement is that it will be paid to all pensioners but if an individual's income is over £35,000 it will be clawed back. As you've found, the rules can get confusing as the payment has previously been made to households, but how much depends on the age and eligibility of individuals. Who can get it? The payment is made to those over the state pension age on September 21 2025. To put it another way, people born on or before September 21 1959 will qualify this year. For England and Wales, the payments will be £200 per household or £300 where at least one person is aged 80 or over. Your household would receive the shared payment of £300, but £200 of this would be treated as being paid to David and £100 to you. If you were both over 80, it would be split equally. What counts towards the £35,000? The income test relates to taxable income, so payments that are automatically tax-free will not count towards the limit. Income from cash and investments held in Isas, pension credit or any benefits that are always tax-free do not need to be counted. Prizes on your Premium Bonds are also tax-free. Some income might not be paid with tax deducted but counts in taxable income calculations. The most common example is the state pension itself. Other types of income such as savings interest and dividends from cash and investments not held in Isas will also be included in the test against the £35,000 limit. For your husband, his state pension, final salary pension and any income from savings or investments outside of Isas will count towards the £35,000 limit. Although the personal allowance means he can get £12,570 of income before tax applies, and if he also gets the full personal savings allowance of £1,000 for interest, I'm afraid these do not reduce his income for the £35,000 test. If David passed away before you, any widow's pension you then receive would count as your own taxable income. This still might not tip you over the £35,000 WFP limit but could mean you start to pay some interest on your savings. This is because you probably benefit from the starting rate for savings interest, as well as the personal savings allowance. Clawbacks The payments will be made automatically, so there will be no need to fill out paperwork to make a claim. But for those over the income threshold, this will involve a clawback. In your case, £200 will be clawed back from your husband meaning you'd benefit from £100 overall. Clawbacks will be made using the methods through which you already pay tax. For example, through PAYE on pension income or self-assessment tax returns for those who already must file one. Ministers were keen to point out that nobody will have to register for self-assessment to do so, like the current process for clawing back child benefit. In your case, the clawback from David via PAYE is unlikely to happen until later in the tax year, or even after April 2026. Pensioners will be able to opt out to avoid having to go through the clawback, although we don't have the full details exactly how they can do this at the time of writing. We also don't know how the scheme for people in Scotland and Northern Ireland will work just yet either. A full about-turn would have been simpler The Government originally hoped to save around £1.4bn by restricting the WFP to those receiving pension credit, a measure it said was required to repair public finances. We've seen a drive to ensure more people claim pension credit and, with 58,800 extra successful claims since last July, the net saving from the whole exercise is likely to be miniscule. Given the confusion over the limits, the chaos it could cause HMRC and the meagre taxpayer savings on offer, it may have made sense for the Government to take the political embarrassment of an about-turn on the chin and make the payment to all pensioners.
