A Delhi court has allowed 1997 Uphaar fire tragedy victims to assist the Delhi Police in prosecuting realtor Sushil Ansal in a case accusing him of fraudulently getting his passport renewed.
The order was passed by chief judicial magistrate Shriya Agrawal of the Patiala House Court on Monday, allowing a plea moved by Association of Victims of Uphaar Tragedy (AVUT) under Section 302 of the Criminal Procedure Code (CrPC), which allows a court to grant permission—other than to a police officer below the rank of Inspector— to conduct the prosecution in a case. The section essentially ensures that a complainant could participate in the prosecution through their counsel and assist the prosecutor, representing the police.
The court said, '…it is observed that the association at the instance of which, the law was set into motion in the present case ought to get a right of assisting the prosecution, to which liberty, there is no bar in law…as opposed to being given the reigns of the prosecution itself, the Association is at liberty to assist the prosecution in the present case'.
Sushil Ansal, 77, one of the convicts in the case pertaining to the Uphaar fire mishap, is also accused of getting his passport renewed by concealing his criminal antecedents and not obtaining the requisite no-objection certificate from the court. Following a writ petition filed by AVUT in the Delhi High Court, a case of cheating was lodged by the Delhi Police Crime Branch in 2019.
In November 2007, a decade after the tragedy that killed 59 people, a trial court convicted realty tycoons Gopal Ansal and his brother Sushil Ansal, among others, and sentenced them to two years in prison, the maximum sentence the law provides for causing death due to negligence under Section 304A of the Indian Penal Code (IPC). In December 2008, the Delhi High Court upheld the conviction but reduced the sentence to one year.
In February 2017, the Supreme Court directed the two of them to pay a fine of ₹30 crore each, for the construction of a trauma centre. While Sushil, who spent a little over five months in jail, was let off for the period already served on account of his age (then 77), then 68-year-old Gopal Ansal was directed to undergo one year of imprisonment.
In July 2022, a Delhi court convicted the brothers in another case pertaining to the fire, related to tampering with and destroying evidence. The brothers were let off by the court in the case for the period already served by them during the pendency of the case.
The case pertaining to passport forgery, where only Sushil Ansal stands as an accused, is currently at the stage of arguments on framing of charges at the Patiala House Courts.
In its plea, AVUT, led by Neelam Krishnamoorthy, who lost her two children in the tragedy, represented by senior advocate Vikas Pahwa, highlighted that the victims had been at the forefront of the battle for justice and had closely tracked and assisted all hearings in the previous two cases against the Ansals.
The plea also pointed out several grievances in the Delhi Police's investigation and filing of the charge sheet.
Meanwhile, Sushil, through his Advocate Gautam Khazanchi, opposed the plea, stating that AVUT had no locus standi to address arguments on charge and prosecute Ansal as they were mere complainants.

Patna: BJP's Bihar unit spokesperson Danish Eqbal on Thursday renewed the attack on Jan Suraaj founder Prashant Kishor for the 2020 election data "theft". The case pertains to the alleged theft and misuse of election campaign data and intellectual property from a Congress member. Eqbal, addressing the media and also releasing a video statement, said: "Prashant Kishor has been exposed. Those who preach morality are themselves involved in serious crimes under IPC Sections 467, 468, 471, 420, 406 and 120B. These are charges of forgery, fraud, and conspiracy. In Patliputra PS Case No. 94/2020, his role resembles that of a professional criminal." Eqbal further attacked Kishor, accusing him of misleading the public with his "Baat Bihar Ki" campaign, which he claimed was based on stolen content. "The people of Bihar now recognise these masked leaders. They are not leaders, but thieves," he said. Eqbal also shared the document related to the case. The case was filed by Congress worker Shashwat Gautam on February 25, 2020, alleging that he had been developing an election campaign titled 'Bihar Ki Baat' at his Patliputra Colony office. The campaign involved data collection, strategy planning, graphic design, and branding, all of which were reportedly stored on an office laptop. Gautam alleged that Osama Khurshid, a volunteer who had previously contested Patna University elections on a JD(U) ticket, came to the office and took the laptop containing the data. While the laptop was later returned, Gautam claimed the data was misused. According to the FIR, Prashant Kishor launched a similar campaign named 'Baat Bihar Ki' on February 18, 2020, allegedly using the stolen materials. The domain for Kishor's campaign was registered on February 16, just two days before its public announcement. The complainant accused Kishor and Khurshid of conspiring to misappropriate intellectual property. The anticipatory bail application for Prashant Kishor was filed during the COVID-19 pandemic under relaxed procedural rules. The case is pending before the Court of Sub Judge XII-cum-ACJM, Patna. Kishor's lawyer, Arun Kumar, argued that his client is innocent, has no criminal antecedents, and was falsely implicated for political reasons. Kishor's lawyer emphasised that the data allegedly stolen was publicly available and multiple similar domain names had been registered in recent months, weakening exclusivity claims. Kishor is a professional election strategist, and any resemblance in campaign themes is coincidental or a result of standard practices in the industry. It was also submitted that Osama Khurshid, not Kishor, was directly accused of taking the data. When approached for comment, a senior Jan Suraaj official and media coordinator declined to respond to the allegations. "Prashant Kishor will answer on this matter in the future," he said.

Thane: A court in Maharashtra's Thane district on Thursday sentenced three persons to life imprisonment in the case of murder of the son of a local NCP (SP) functionary 18 years ago, and acquitted 10 others. Additional Sessions Judge, Kalyan court, PR Ashturkar, held that the prosecution successfully proved the charges against the three accused. The court in its order noted that charges against 10 others, including Shiv Sena functionary Mahesh Patil, have not not been proved. Hence, they were given the benefit of doubt and acquitted. The prosecution told the court that on April 10, 2007, the accused opened fire at Vijay Patil, son of local NCP (SP) leader Vandar Patil, and killed him inside the gram panchayat office at Golavli in Kalyan area of Maharashtra's Thane district. One person was also injured in the attack. The Manpada police then registered an FIR under various sections of the Indian Penal Code and the Arms Act against the accused. Additional public prosecutors Bamre Patil and Sachin Kulkarni urged the court to give maximum of punishment to the accused. The court convicted Vijay Bakane, Sunil Bhoir and Sajid Sheikh, and sentenced them to life imprisonment. As many as 24 prosecution witnesses were examined to prove the charges, said court constable AR Gogarkar who assisted the prosecution in the trial.
