The Senate parliamentarian is asking the Senate Commerce Committee to rework its 10-year moratorium on enforcing state artificial intelligence laws, according to ranking member Maria Cantwell.
The parliamentarian had asked Commerce Chair Ted Cruz (R-Texas) to rewrite the language in the GOP megabill to make clear it wouldn't impact $42 billion in broadband funding, Cantwell (D-Wash.) told POLITICO.
'That's what was a last night request from the parliamentarian,' Cantwell said. 'Yeah, that's what's going on.'
Cruz's communications director Macarena Martinez said in a statement to POLITICO Thursday, 'Out of respect, we are not going to comment on private consultations with the Parliamentarian,' and added, 'The Democrats would be wise not to use this process to wishcast in public.'
What's the problem? At issue is the scope of funding that will be conditioned on states complying with a 10-year pause on enforcing their AI laws.
Cruz has said enforcing the moratorium would be required for states to tap into a new $500 million fund for building out AI infrastructure.
The parliamentarian approved that language, a narrowed version of an earlier proposal to tie the moratorium to the $42 billion Broadband Equity, Access, and Deployment program.
Democrats have argued that the latest moratorium would still affect all $42 billion.
Talking points circulated by Cruz on Wednesday saying his bill 'forbids states collecting new BEAD money from strangling AI deployment with EU-style regulation' only added to the confusion, suggesting the provision could apply to the entire broadband program.
Cruz's office told POLITICO Wednesday that the Congressional Budget Office 'has confirmed this applies only to the unobligated $500M.'
The Senate parliamentarian is under fire after striking major pieces of Medicaid policy from being included in the megabill on Thursday. Majority Leader John Thune has said the GOP would not seek to override decisions from the Senate's rules referee.
Republican doubts: The AI moratorium has divided Republicans. A group of GOP senators, including Sens. Marsha Blackburn of Tennessee, Josh Hawley of Missouri and others, sent a letter to Thune on Wednesday urging the removal of the moratorium language, according to a person familiar with the matter.
'States should not be punished for trying to protect their citizens from the harms of AI,' Blackburn said in a post on X on Thursday.
Sen. Kevin Cramer (R-N.D.) said he is concerned about the scope of the provision and needs to 'get clarity' on if it would apply to the whole BEAD program.
'There's some communication challenge here about whether we're talking about a $500 million pot, or whether we're talking about the entire $40 billion — and the difference is significant. It matters,' Cramer told POLITICO. 'If I can't get assurances that it's not just the smaller pot, it'd be hard for me to get to yes.'
The Article 3 Project, a prominent conservative advocacy group, said it would 'fully support these bold and fearless Republican Senators and their effort to protect America's children, creators, and foundational property rights.'
Arkansas Gov. Sarah Huckabee Sanders, who served as White House press secretary in the first Trump administration, came out against the moratorium language in The Washington Post on Thursday.
She warned it would lead to 'unintended consequences and threatens to undo all the great work states have done to protect our citizens from the misuse of artificial intelligence.'
Tech support: The tech industry has lent broad support to the moratorium. The National Venture Capital Association praised it in a letter to Thune on Thursday.
'The current fragmented AI regulatory environment in the United States creates unnecessary challenges for startups, stifles innovation, and threatens our dominance in the industry,' wrote Bobby Franklin, the organization's president.
Other major tech groups, including the Business Software Alliance, the Consumer Technology Association and NetChoice, have also strongly supported the language.

Facing the prospect of losing control of the House of Representatives during next year's midterm elections, Trump has pressured several red states to immediately redraw their congressional districts to give Republicans an advantage. The maps are usually redrawn once every 10 years, after the census is completed, and not mid-decade. On Monday, Newsom sent the president a letter asking him to call off the 'unprecedented, mid-decade, hyper-partisan gerrymander to rig the upcoming midterm elections.' 'If you will not stand down, I will be forced to lead an effort to redraw the maps in California to offset the rigging of maps in red states,' he wrote. 'But if the other states call off their redistricting efforts, we will happily do the same. And American democracy will be better for it.' Newsom then followed up Tuesday with a trolling all-caps post saying Trump had 24 hours to respond to his letter, and when that failed, he went full MAGA, writing in a social media post: 'DONALD 'TACO' TRUMP, AS MANY CALL HIM, 'MISSED' THE DEADLINE!!! CALIFORNIA WILL NOW DRAW NEW, MORE 'BEAUTIFUL MAPS,' THEY WILL BE HISTORIC AS THEY WILL END THE TRUMP PRESIDENCY (DEMS TAKE BACK THE HOUSE!).' Among Wall Street traders, the president's flip-flopping on tariff policy earned him the nickname 'TACO' for Trump Always Chickens Out. Newsom's post further announced a 'BIG PRESS CONFERENCE THIS WEEK WITH POWERFUL DEMS AND GAVIN NEWSOM — YOUR FAVORITE GOVERNOR — THAT WILL BE DEVASTATING FOR 'MAGA.' Facing record-low polling numbers, Trump launched a redistricting arms race last month when he asked Texas for 'just a simple redraw' of its congressional maps to help Republicans pick up five seats in the Lone Star State. Democrats vowed to retaliate in states like California, New York and Illinois, prompting Republicans to eye states like Republican-controlled states such as Ohio and Indiana. Unlike Texas, though, California has an independent commission that draws political maps, and Newsom will need to push through a special ballot measure in November to carry out his redistricting plans. During an interview Tuesday with Fox News, Florida Gov. Ron DeSantis claimed California's commission was a 'ruse' and the state map is already gerrymandered. 'The Thirst Queen has emerged,' Newsom's office hit back on social media. 'We will not be lectured on democracy by someone who lost to a cartoon mouse with gloves.' Florida became locked in a battle royale with The Walt Disney Company in 2022 when Disney's former CEO Bob Chapek vowed to work to overturn a 2022 state law—colloquially known as the 'Don't Say Gay' law—that prohibited classroom discussion of sexuality. DeSantis retaliated by working with Republican lawmakers to pass a measure revoking Disney's self-governing status. Disney sued, and the case was settled in 2024. Gavin Newsom's press office called out 'idiot' White House Communications Director Steven Cheung for his attempted online attack of the California governor. Cheung, in a profane post on X, claimed the Democrat was 'too chicken s--t to take questions from the press' after his speech Thursday about congressional redistricting to counter similar GOP moves in Texas and other red states. Except that's exactly what Newsom did. Less than 15 minutes after Cheung called Newsom a 'coward' and 'beta cuck,' the governor's press office shot back in the replies. 'Questions are streamed here you idiot,' they wrote, linking to a question-and-answer session in which the governor fielded nine questions from reporters. The Newsom account highlighted Cheung's mistake in another post—this one directed to the public. 'Steven Cheung (incompetent Trump staffer) doesn't know how to use his computer. SAD!' they wrote, adopting Donald Trump's style of posting. The White House did not immediately respond to the Daily Beast asking if Cheung plans on deleting or editing his post. The recent trend by Newsom's press team of imitating Trump's tone was the topic of one of the questions Newsom responded to in the Q-and-A. 'I hope it's a wake-up call—the president of the United States, sort of following his example,' Newsom said. 'If you've got issues with what I'm putting out, you sure as hell should have concerns about what he's putting out as president,' he continued. 'So, to the extent it's got some attention, I'm pleased, but I think the deeper question is: how have we allowed the normalization of his tweets and Truth Social posts over the last several years to go without similar scrutiny and notice.' For days, that account has been aiming to make Trump aware of the purpose of Newsom's speech Thursday: announcing a November special election to vote on proposed new maps to nullify GOP-friendly redistricting in red states. Newsom reiterated to reporters Thursday that if states like Texas, Florida, Missouri, and Indiana call off their 'unprecedented, mid-decade, hyper-partisan gerrymander to rig the upcoming midterm elections,' then California's redistricting effort won't be necessary. But there don't appear to be signs of Republicans backing down. 'Gavin Newsom's latest stunt has nothing to do with Californians and everything to do with consolidating radical Democrat power, silencing California voters, and propping up his pathetic 2028 presidential pipe dream,' National Republican Congressional Committee spokesperson Christian Martinez said.

President Donald Trump has taken aim at MSNBC host Nicolle Wallace in a bizarre social media rant. The drama started when 79-year-old Trump kicked off his Sunday morning with a cryptic post on Truth Social. 'Bela,' he wrote, leaving his followers to debate the meaning of the word. In a reply, one user posted a doctored photo of Wallace with a 'Karen' haircut and a red nose alongside the text, 'Typhoid Mary Nicole Wallace,' 'Clown news,' and 'Nicole Wallace is afraid of losing her job. Get her a Waaambulance.' A fake news ticker showed the MSNBC logo alongside the word 'misinformation.' Wallace, who now hosts Deadline: White House on MSNBC, was former White House communications director under President George W. Bush. But the president has since changed his tune, saying achieving peace will require territorial concessions from Ukraine. He is slated to meet with Ukrainian President Volodymyr Zelensky on Monday. 'It's incredible how the Fake News violently distorts the TRUTH when it comes to me,' he raged. 'There is NOTHING I can say or do that would lead them to write or report honestly about me. I had a great meeting in Alaska on Biden's stupid War, a war that should have never happened!!!' In a second post, Trump added, 'If I got Russia to give up Moscow as part of the Deal, the Fake News, and their PARTNER, the Radical Left Democrats, would say I made a terrible mistake and a very bad deal. That's why they are the FAKE NEWS!'
