Odisha: BJD leader booked for allegedly raping girl, terminating pregnancy

Bhubaneswar, Jul 24 (PTI) A leader of the opposition BJD in Bhubaneswar was on Thursday booked on the charge of raping a girl, police said.
The case was filed under the BNS sections 64(2) (rape), 89 (committing miscarriage without woman's permission), 296 (obscene act), and 352 (criminal intimidation), besides section 6 of the POCSO Act, at the Laxmisagar police station, where the survivor lodged a complaint on Wednesday, they said.
The survivor, who is now 19, underwent medical examination at the Capital Hospital.
In her complaint, she alleged that the Bhubaneswar Municipal Corporation corporator built a physical relationship with her under the 'false promise" of marriage and made her pregnant when she was a minor.
She also alleged that the corporator forced her to terminate the pregnancy and promised her marriage after getting a divorce from his wife.
'When I asked him to marry me, he threatened and asked me to leave Bhubaneswar," she claimed.
The corporator is yet to be arrested.

Pune: The Bombay high court has declared that a wife's allegations of impotency against her husband during divorce proceedings do not constitute defamation and that such claims, when made to protect a woman's interests, are a necessary part of the legal process. Dismissing a man's defamation complaint against his estranged wife and her family, Justice S M Modak in his July 17 order, made public on Friday, noted that under the Hindu Marriage Act, allegations of impotency are 'very much relevant' and can be a legitimate ground for divorce. Justice Modak stated that a wife is 'justified in making those allegations to support her interest' and to prove that she suffered cruelty in the marriage. The man had argued that his wife's claims, made in her divorce and maintenance pleas and in a separate FIR, had become part of the public record and therefore damaged his reputation. The allegations of impotency being a ground for divorce are necessary, it said. 'This court feels that when litigation between spouses arises in a matrimonial relationship, then the wife is justified in making those allegations to support her interest,' the court said, adding the same cannot be held as defamatory. The man had stated that his estranged wife had, in her pleas seeking divorce and maintenance and also in her FIR against him and his parents, claimed that he was impotent. These documents were part of the public record and hence defamatory. The woman, her father and brother had moved the high court seeking to quash a sessions court order, directing a magistrate's court to conduct an inquiry into the man's defamation complaint. The woman, in her plea to the high court, said that her husband's impotence was one of the grounds for dissolving the marriage. (PTI)

BAREILLY: A 50-year-old unidentified man who was mistaken for a "drone thief" -- someone who is presumed to use a drone to recce an area before targeting houses for burglary or arson -- was lynched by a mob in Bhojipura area of Bareilly district around 8.30 pm on Thursday. Police said six to eight locals were involved in the brutal assault which left the victim -- a mentally-ill beggar from some other village -- unconscious with severe head injuries and bruises all over the body. Hospital authorities later declared him dead. The incident is said to be the "first such death in the state caused by drone-related rumours". There has been rising paranoia around "drone-aided thefts" in several parts of UP. Villagers have been conducting night patrols armed with sticks, torches and even airguns in response to low-flying drone sightings -- some of them rumours while a few others cases of unmanned aerial vehicles operated by govt departments for surveying or welfare work. "The man, who was shabbily dressed, was slapped, kicked and punched several times by the locals. He was initially allowed to go, but again stopped by the same group when he didn't reveal his identity. When they again started assaulting him, a security guard alerted cops. However, by the time local police arrived, the man was already unconscious. We're trying to collect more details about him," Bhojipura SHO, Praveen Solanki, said on Friday. A local villager said that the man, with 'Ram' inscribed on his head, was spotted roaming in Memaura village under Bhojipura thana on Thursday evening. Fearing a potential theft due to recent rumours -- much of it unsubstantiated -- that thieves have been using drones to map an area or individual property before targeting them, villagers raised an alarm and gathered to thrash him. The merciless assault eventually saw him collapse. SP (north) Mukesh Mishra told TOI: "Four accused — Nirdesh Kumar (34), Harprasad Singh (36), Charan Singh (28) and Vikas Kumar (29) — were arrested on Friday. An FIR under BNS sections 103 (murder), 115-2 (provoke breach of peace), 352 (criminal intimidation), 126 (wrongful restraint), among others, were registered against six named and two unnamed persons." The victim's body has been kept in a mortuary, Mishra said, adding, "We'll wait for 72 hours, as per norms, for someone to turn up and claim the body. If no one comes, we will conduct his postmortem and cremate him." Last month, too, a 20-year-old man was thrashed by a mob in Bareilly's Sirauli area after being mistaken for a "done thief". He was rushed to hospital and managed to survive. Similar incidents have been reported from several villages in Ghaziabad. Locals there took matters into their own hands, and armed themselves with rods and sticks after a string of circulated videos sparked fears of burglary recces being carried out with drones. TOI extensively reported some of these incidents. Sensing a law and order issue, UP police have now launched night patrols from 11 pm to 3 am in some areas, along with awareness drives with village heads, and created a "drone register to identify legitimate drone operators". Police clarified that drone use at night has been barred entirely to prevent further panic. The decision was taken at CCEA meeting chaired by PM Modi. It will increase the existing network of Indian Railways by about 574 kilometres. In a significant step which will help decongest the railway network and reduce logistics cost, the Cabinet Committee on Economic Affairs on Thursday approved four multitracking projects covering 13 districts across six states, with Prime Minister Narendra Modi stating that the decision is part ofthe government's efforts to provide next-generation infrastructure. He said these projects will benefit people of Maharashtra, Madhya Pradesh, West Bengal, Bihar, Odisha, and Jharkhand. 'In a boost to our efforts to provide next-generation infrastructure, 4 major rail projects worth over Rs. 11,100 crore have been approved by the Cabinet," PM Modi said in a post on X. The decision was taken at CCEA meeting chaired by PM Modi. It will increase the existing network of Indian Railways by about 574 kilometres. The projects are expected to generate direct employment for about 229 lakh human-days during construction. Briefing the media after the cabinet meeting, Information and Broadcasting Minister Ashwani Vaishnaw said that the projects include Itarsi – Nagpur fourth line; Aurangabad (Chhatrapati Sambhajinagar) – Parbhani Doubling; AluabariDangoaposi– Jaroli third and fourth line. Atmanirbhar" by way of comprehensive development in the area, which will enhance their employment/ self-employment opportunities. The projects are planned on the PM-Gati Shakti National Master Plan with a focus on enhancing multi-modal connectivity & logistic efficiency through integrated planning and stakeholder consultations. 'These projects will provide seamless connectivity for movement of people, goods, and services," the release said. The proposed multi-tracking project will enhance connectivity to about 2,309 villages, which have a population of about 43.60 lakh. 'These are essential routes for transportation of commodities such as coal, cement, clinker, gypsum, fly ash, containers, agricultural commodities, and Petroleum products.
