Following the accident between a school van and a train at Cuddalore railway crossing on Tuesday that killed three students, a case has been filed against gatekeeper Pankaj Sharma, with charges including culpable homicide not amounting to murder, causing death by negligence and endangering personal safety of others.The charges under Sections 105, 106, and 125 of the Bharatiya Nyaya Sanhita (BNS) and Section 151 of the Railways Act was in connection with the accident that took place on Tuesday at Gate Number 170, a manned but non-interlocked level crossing at Semmankuppam near Cuddalore.advertisementThe Railways had earlier suspended Sharma, who was later arrested for the accident. A new gatekeeper, Anandraj, who is a Tamil speaker, has also been appointed in Sharma's place. The appointment follows remarks by DMK leader TKS Elangovan, who attributed the tragedy to a language barrier. The leader alleged that the gatekeeper's inability to understand Tamil may have contributed to the accident.
On Tuesday morning, a school van carrying five students and the driver was hit by the Villupuram–Mayiladuthurai passenger train, dragging the vehicle nearly 50 metres. Three students died in the incident, while others were seriously injured.A preliminary railway statement claimed the accident occurred while the gatekeeper was closing the gate and that the van driver insisted on crossing. The injured van driver and one student, however, disputed the Railways' account, claiming the level-crossing gate was open and unattended at the time of the crash. 'The gate was open, there was no signal. I didn't even see the gatekeeper,' said Shankar, the van driver. Injured student Vishwesh echoed this, stating, 'The gatekeeper didn't come out even after the van was hit.' Following the accident, the Railways and local police launched a joint probe. Tamil Nadu Chief Minister MK Stalin expressed grief over the deaths, announced Rs 5 lakh ex gratia for the families of the deceased and Rs 1 lakh for the injured, and directed authorities to ensure quality medical treatment for survivors.- Ends

Hyderabad: The Asifnagar police booked a case against a group of students for dancing with swords during birthday celebrations organized at Syedaliguda in Asifnagar on Monday night. The celebrations turned chaotic as attendees brandished weapons and disrupted the neighbourhood with loud DJ music. The video of the students cutting cakes with swords and dancing with them in the colony went viral on various social media platforms. This prompted the police to take suo motu cognizance of the incident and register a case under relevant provisions of BNS. Though the incident occurred on Monday night, it came to light on Wednesday as the video of the students dancing with swords went viral on social media. In all, over 10 youngsters, mostly students, participated in the birthday celebrations of a student. Police registered a First Information Report (FIR) against the organiser of the birthday party, Mohammed Fazal, under multiple charges. Asifnagar Inspector N Anand said a FIR has been issued and further investigation was on. 'As most students were minors, the police are seeking legal opinion before initiating necessary action against them as per rules.'

BENGALURU: The High Court of Karnataka on Wednesday stayed further proceedings against energy minister KJ George, Bescom MD Mahantesh Bilagi and another official in the case pertaining to a special court directing the Lokayukta police to submit a report on a private complaint filed by three BJP MLAs over the alleged irregularities in inviting tenders for supply of smart meters. Justice MI Arun passed the interim order staying the proceedings till August 20 and issued notice to the complainants after hearing the petitions filed by George, Bilagi and another Bescom official questioning the legality of the order passed by the special court. Their counsel argued that the order passed by the special court is against the law as no prior sanction was obtained from the competent authority to prosecute the petitioners, who are public servants, as mandated under Section 17A of the Prevention of Corruption Act. The complainants, MLAs Ashwath Narayan CN, SR Vishwanath and Dheeraj Muniraj, approached the Lokayukta police on April 21. Before the Lokayukta police initiated action, the complainants filed a private complaint before the special court, which registered it for offences under the provisions of BNS and the Prevention of Corruption Act.

Two workers were killed and four others injured as a powerful explosion ripped through an industrial gas supply unit in Mohali's Phase 9 on Wednesday morning when oxygen cylinders were being loaded onto a truck. (SANJEEV SHARMA/HT) Police have registered a case of death due to negligence against the supervisors of the unit, Hi-Tech Gases, which deals in the supply of oxygen cylinders, industrial gas tanks, and special gases. According to officials, the impact of the blast was so severe that nearly 40 cylinders were hurled across the yard and the victims bodies left severely dismembered. The deceased have been identified as Devinder Kumar, 27, and Mohammad Asif, 25, both residents of Uttar Pradesh. The injured are Sarvesh, 45, Sachin, 24, Ashok, 44, and Akbar, 50. They are under treatment at the Phase 6 civil hospital. The families of the deceased were in an inconsolable state and staged a nearly two-hour protest at the site, demanding a thorough probe and compensation. Asif's father, Akbar Ali, who works at the same unit, said, 'We have been working here for a long time. Nothing like this has happened before. I don't know whose fault it is but they must be held accountable. I have lost my son. This pain is unbearable.' Devinder's brother Pawan said, 'My brother had been working here for two-and-a-half years. This morning, he had stayed back after his shift for an extra ₹200. His body has been so badly mutilated that we have only found his head.' Deputy superintendent of police, City -2, Harsimran Bal said the factory supervisors have been booked under Section 106 (death by negligence) of the Bharatiya Nyaya Sanhita at Phase 11 police station. Mohali senior superintendent of police (SSP) Harmandeep Hans, who oversaw the rescue operations, said, 'The unit supplied nitrogen and oxygen cylinders to various firms and hospitals. Around 9 am today, two men were loading cylinders onto a truck when one exploded. The two workers died on the spot. We are investigating all possible causes, including human error. It is too early to comment on the exact reason.' Deputy commissioner Komal Mittal said the administration had taken cognisance of the incident. 'A police inquiry has been marked to DSP City II, Mohali, and he has been asked to submit a report within a week. While the exact cause cannot be confirmed as of now, preliminary investigations suggest that the cylinder may have suffered an impact during loading, triggering the blast,' she said.
