Supreme Court slams TN for suspending ADGP, says it's demoralising

on Wednesday disapproved of Tamil Nadu govt's decision to suspend additional director general of police (ADGP) H M Jayaram after Madras HC ordered his arrest in an abduction case and asked it to inform the court within 24 hours "why the suspension be not withdrawn".
When Jayaram's counsel Aditya K Choudhary said the IPS officer had an unblemished 28-year service record and that he was not involved in the abduction case, a partial working day bench of Justices Ujjal Bhuyan and Manmohan asked TN govt's counsel, "why have you suspended him? He is a senior police officer, and he has joined the investigation. Such suspension orders are very demoralising".
TN govt counsel Misha R Mohta informed the court that Jayaram had not been arrested and was released after questioning.
However, he was placed under suspension, she accepted, asking the court for time to obtain instructions from state govt on whether the suspension order, issued following the HC's directive, would be withdrawn.
Jayaram has been accused of aiding and abetting the kidnapping of a 19-year-old youth, whose brother had married a woman without the approval of her family members. When the couple eloped and could not be traced, the police allegedly kidnapped the youth, transported him in Jayaram's vehicle and tortured him to reveal the couple's whereabouts.

On Monday, Justice P Velmurugan of Madras HC directed the police to arrest Jayaram, saying "a strong message should go to public that no one is above law". This order was passed during the hearing of an anticipatory bail plea filed by legislator K V Kuppam, who is also an accused in the case. The high court denied the MLA relief and ordered him to cooperate with the investigators probing the case.

Bhopal: In a demolition operation that lasted nearly six hours, joint teams of district administration, police and municipal corporation on Thursday demolished the mansion of the "Machhli family" in Anantapura, Kokta Hathaikheda. The alleged illegal property, built over 15,000 square feet of govt land, was razed with the help of six earth mover machines amid heavy police deployment. Two members of the Machhli family including Shahwar Ahmed and Yasin Ahmed were arrested by the crime branch of Bhopal police for allegedly running an MD drugs supply racket in the city. They were also booked on charges of rape, molestation, extortion and assault. According to official sources, the mansion was built in 1990 and the three-storey mansion had more than 30 rooms, large halls, marble flooring on the terrace, a park, garage, playroom for children and luxury amenities spread over an acre of land. The market value of the razed property has been estimated at Rs 20 to 25 crore. However, after the deployment of additional women police personnel to control the protestors, the protest subsided and the illegal mansion was brought down by 5 pm. According to district administration officials, the Machhli family had illegally occupied nearly 70 acres of govt land near Anantpura and constructed three farmhouses, a warehouse, a factory, a madarsa and shops. In a previous demolition drive carried out on July 30, several of these structures were demolished. With Thursday's action, all seven illegal constructions have now been razed, freeing govt land valued at nearly Rs 100 crore. On July 31, the family's lawyer had managed to halt the demolition, citing Supreme Court guidelines requiring 15 days notice before demolishing residential structures. This time, however, despite fresh objections from the defence lawyer, officials went ahead with the operation, asserting that due notices had already been served. "The accused had encroached upon govt land and constructed large illegal buildings. Notices were duly served earlier. Thursday's action has ensured the recovery of govt property worth crores and restored it to official possession," said an officer of the district administration present at the site. Bhopal: A division bench of Madhya Pradesh High Court observed that "the trial courts in the state are consistently failing to perform their duties as a judge despite regular training at the National Judicial Academy". While acquitting a person convicted to 20 years of rigorous imprisonment for raping a 17-year-old girl under POCSO Act on the ground that the survivor may be an adult and not a minor, the bench of Justice Vivek Agarwal and Justice A K Singh said, "It is surprising to note that despite regular training in the Madhya Pradesh State Judicial Academy, trial courts are consistently failing to perform their duties as a judge. Though the DNA report was exhibited after closure of the prosecution evidence, but, trial court did not deem it proper to record supplementary statements of accused under Section 313 of CrPC and confront him to the circumstances which appeared against him in view of DNA test report despite referring to it in its judgment. " The case in question involved the acquittal of a person, who was previously sentenced to 20 years of rigorous imprisonment for the rape of a 17-year-old girl. The high court's decision to overturn the conviction was based on several procedural and evidentiary oversights by the trial court. The high court noted that the ossification test indicated the victim's age could range between 17 to 19 years, suggesting she might not have been a minor at the time of the incident. The court emphasised that while ossification tests are not entirely precise, they offer a more reliable basis for age determination when other evidence is lacking. The judgment also pointed out the failure to exhibit the x-ray report ordered by Dr Geeta Barmate, which could have further supported the defence case. The court underscored the importance of such medical evidence, referencing the textbook of medical jurisprudence and toxicology by Modi, which discusses the fusion of the iliac crest in females as occurring between 17 to 19 years of age. The court's decision to acquit the accused was also influenced by the lack of documentary evidence from the survivor's parents regarding her date of birth. This absence of evidence, combined with the ossification test results, led the court to extend the benefit of doubt to the accused.
