
Overseas Investment Bill Passes First Reading
Associate Finance Minister David Seymour welcomes the passing of first reading for a Bill to make it easier for New Zealand businesses to receive new investment, grow and pay higher wages.
The Overseas Investment (National Interest Test and Other Matters) Amendment Bill has passed its first reading in Parliament today.
'New Zealand has been turning away opportunities for growth for too long. Having one of the most restrictive foreign investment regimes in the OECD means we've paid the price in lost opportunities, lower productivity, and stagnant wages. This Bill is about reversing that,' says Mr Seymour.
'In 2023, New Zealand's stock of foreign direct investment sat at just 39% of GDP, far below the OECD average of 52%. Investors are looking elsewhere, so we're showing them why New Zealand is the best place to bring their ideas and capital.
'International investment is critical to ensuring economic growth. It provides access to capital and technology that grows New Zealand businesses, enhances productivity, and supports high paying jobs.
'New Zealand's productivity growth has closely tracked the amount of capital workers have had to work with. Our capital-to-labour ratio has seen very little growth in the last 10 years, averaging approximately 0.7 per cent in measured sectors annually. That's compared to growth in the capital-to-labour ratio in measured sectors of around 2.2 percent in the previous 10 years. Unsurprisingly, productivity growth averaged 1.4 percent a year between 1993 and 2013, but only 0.2 percent between 2013 and 2023.
'The Bill will consolidate and simplify the screening process for less sensitive assets, introducing a modified national interest test that will enable the regulator to triage low-risk transactions, replacing the existing benefit to New Zealand test and investor test. If a national interest risk is identified, the regulator and relevant Minister will have a range of tools to manage this, including through imposing conditions or blocking the transaction.'
The current screening requirements will stay in place for investments in farmland and fishing quota.
'For all investments aside from residential land, farmland and fishing quota, decisions must be made in 15 days, unless the application could be contrary to New Zealand's national interest. In contrast, the current timeframe in the Regulations for the benefit test is 70 days, and the average time taken for decisions to be made is 30 days for this test,' says Mr Seymour.
'High-value investments, such as significant business assets, existing forestry and non-farmland, account for around $14 billion of gross investment each year. We're removing the barriers for these investments so that number can grow.
'The Ministerial Directive Letter will be updated to provide guidance on which assets should undergo further scrutiny and which risks may be contrary to New Zealand's national interest. This guidance will provide a degree of certainty to investors and support a flexible regime which is responsive to new and emerging risks.
'The updated system brings New Zealand up to speed with other advanced economies. They benefit from the flow of money and the ideas that come with overseas investment. If we are going to raise wages, we can't afford to ignore the simple fact that our competitors gain money and know-how from outside their borders.
'These reforms cut compliance costs, reduce processing times, and restore confidence that New Zealand is open for business. The Bill will be passed by the end of the year and the new regime implemented by early 2026. A new Ministerial Directive Letter will come into force at the same time.'

Bill to replace Three Waters passes final hurdle
By Lillian Hanley of RNZ The government's final piece of legislation to implement 'Local Water Done Well', replacing Labour's Three Waters, has passed its third reading. National MP Ryan Hamilton hailed the legislation, saying "hello localism and choice", while Te Pāti Māori MP Mariameno Kapa-Kingi called it "an atrocious piece of work." The government has said the Local Government (Water Services) Bill and the Local Government (Water Services) (Repeals and Amendments) Bill provide a "flexible" framework for local councils to address challenges related to drinking water, waste water and stormwater services. NZ First's Casey Costello led the debate, calling it the government's "urgently required" plan to "address challenges with New Zealand's water services." "Simply put, chronic underinvestment and the lack of sustainable management of local government water services has come home to roost." Costello said councils would be able to choose the best structure for "financially sustainable water services that meet regulatory requirements and local needs". "I want to keep repeating that Local Water Done Well will maintain local ownership, choice, and decision-making. That gives councils the best shot at identifying their most pressing problems and the right approach to solving them." National MP Ryan Hamilton hailed the passing of the government's Three Waters replacement. "Goodbye Three Waters, hello Local Water Done Well. Goodbye co-governance, hello locally chosen and designed options. "Hello localism and choice." NZ First's Jamie Arbuckle highlighted the removal of "co-governance" in the legislation. "Isn't it great to get rid of co-governance from this piece of legislation? Get rid of it! We are about New Zealanders. We are about Kiwis." But the opposition slammed the legislation, with Labour's Megan Woods saying it "shifts the financial risk" to councils and ratepayers. She criticised the government's response to Three Waters as it had got rid of the economies of scale and "the money that could have been saved", allowing for a "proliferation" of water service entities. "What the government said was 'Oh no there's two few entities, there's not enough room for local decision making under the previous government plans'." But the changes had led to an average increase in water charges for households, she said. Tangi Utikere, Labour's spokesperson for local government, said there was no adequate financial support to those councils for the changes the government was seeking to implement. Te Pāti Māori's Mariameno Kapa-Kingi criticised the government for "ignoring the role of Māori in the delivery of water services." "Removing these provisions is not progress, it is reform, it is regression and it is deeply and only racist." She said the bill in its thinking and design ignored and dismissed how "tangata tiriti get to live here", referencing Te Tiriti o Waitangi. She implored the government to "get the education" and concluded by saying "what an atrocious piece of work."

Coalition accepts Consumer NZ's 'Price it Right' supermarket petition

The petition, signed by 25,000 people, was presented to Willis on the steps of Parliament this morning. Willis wrote to the major supermarkets in June, warning them against misleading promotional practices and pricing errors. Consumer NZ chief executive John Duffy said supermarkets had had plenty of opportunity to sort it out for themselves. "It's time for the government to step in and make supermarkets price it right, and tens of thousands of New Zealanders agree. "People want clear pricing rules, automatic compensation and stronger penalties when supermarkets get it wrong." "If supermarkets can't get their pricing right, they - rather than shoppers - should face the consequences," Duffy said. Consumer NZ's petition asked the government to introduce a mandatory supermarket pricing accuracy code: "We know that all the problems in the supermarket sector won't be fixed overnight, but new rules like those in our proposed code will help put money back in the pockets of New Zealanders," Duffy said. Willis told RNZ she had received assurances new processes were in place after putting major supermarkets on notice in June. (File photo) Photo: RNZ "They then wrote back to me and pledged that they are going to have refund policies in place from now on, in the case of Foodstuffs that hadn't previously been the case. "Now, if a pricing error is found, you get your money back and you keep to you get to keep the goods. "They've also pledged that they will advertise these refund policies and they have pledged that they are investing significant sums and better training for their staff and better systems to stop these errors happening in the first place." Willis said they were important commitments and the government would hold major supermarkets accountable to them. "I have been consulting on strengthening the infringement regime in the Fair Trading Act, strengthening penalties and potentially introducing civil proceedings so that it is easier to prosecute supermarkets when they do the wrong thing," she said. "I will consider the submissions on that consultation before taking recommendations to Cabinet." Asked if it was fair the onus was still on consumers to notice price discrepancies, Willis said it wasn't. "I do worry that for every person who's noticed it, there are other New Zealanders who've been ripped off and haven't had the opportunity to get redress. "So that's why we are strengthening our approach in this area, we think it's time that the supermarkets pulled up their socks." 'Carnival's over': Peters celebrates Mallard's early exit
By Russell Palmer of RNZ Foreign Minister Winston Peters is celebrating former Speaker of the House Trevor Mallard being replaced as Ambassador to Ireland. Mallard was appointed for a three-year term in Dublin in 2022. But in a statement this afternoon Peters named Angela Hassan-Sharp for the role. Asked about Mallard, he said: "You know that famous song from The Seekers? Carnival's over". He said Mallard was "coming home and he's coming home early". Asked if he had a reason to bring Mallard home, he replied: "Yes, I do". "It's a circus where instead of looking at the national interest, you've got people like Jacinda Ardern appointing politicians to important jobs - and that should not be happening. "Their performance will never be up to scratch for goodness sake. You people surely understand that you train people, you give them decades of experience to get into important jobs, and all of a sudden you put a politician there with no training at all." No politicians should ever be assigned to diplomatic roles, he believed. "I'm saying, that we should not be having politicians in diplomatic jobs, full stop. I've opposed it in all my career, and soon I'll have corrected it for a third time." Asked the last time he spoke to Mallard, he said: "I can't remember ... it's got to be, oh, five years ago." "I cannot believe that Jacinda Ardern sent somebody like him after the way he behaved with respect to the protesters out here, turning up the noise, putting cold water over young children at night. This is a disgrace, and you guys should have been calling it out, not me," he told reporters. In 2022, Peters criticised Mallard's appointment to the role, saying it should never have happened and Mallard did not have the diplomatic judgement required to be an ambassador. "Mr Mallard has never demonstrated any understanding of the most fundamental elements of diplomacy itself," he said at the time. The former Speaker had Peters trespassed from Parliament's grounds after the then-former Deputy Prime Minister attended the protest occupation of Parliament's grounds. Peters sought a judicial review over the matter, and Mallard admitted at the High Court that issuing the trespass warning was "unreasonable and irrational" and that Peters had not acted in a way which would justify the move. Adrian Rurawhe as Speaker apologised to Peters on Mallard's behalf over the trespass when Mallard resigned to take up the role of ambassador. RNZ has sought comment from Mallard.
