Ludhiana: A local court has sentenced Bobby, a 57-year-old man from this city's Old Quarter near the civil hospital, to 12 years of rigorous imprisonment and fined him Rs 1 lakh after police seized 3,000 intoxicant tablets from him.
If the fine is not paid, he will face an additional year of imprisonment, the special court judge Harvinder Singh ruled.
On May 28, 2020, Division Number Two police booked Bobby under the Narcotic Drugs and Psychotropic Substances (NDPS) Act following a police operation at Old Jail Road near the civil hospital. Assistant sub-inspector Sukhwinder Singh and other officers spotted Bobby returning on foot from Brown Road carrying a white plastic bag on his right shoulder.
When he noticed the police, Bobby attempted to discard the bag, which was later found damaged, revealing red pills and blue capsules inside.
Police apprehended Bobby on the spot and seized 3,000 capsules along with an additional 1,760 capsules, later. Despite attempts, no independent witnesses were available to be included in the police party at the time of recovery. Bobby was arrested and charged formally after police filed a chargesheet.
During the trial, Bobby claimed he was implicated falsely and rejected all allegations of possession. However, the court found no evidence to support his defense. The judge noted that Bobby had neither claimed any enmity with the cops nor reported any false implication to higher authorities or provide the court with any private witnesses to prove his innocence.
"Had the accused been innocent, he would have raised hue and cry against his false implication to the higher police officer," the court said. The evidence and testimonies confirmed Bobby's guilt, leading to his conviction and sentencing under applicable sections of the NDPS Act.

Duo held in 2024 pharma drugs seizure discharged due to lack of evidence

MUMBAI: The sessions court on Monday discharged two men who were named as accused in a 2024 pharmaceutical drug seizure case under the Narcotic Drugs and Psychotropic Substances (NDPS) Act, observing that the prosecution failed to establish a prima facie case against them and had not produced any corroborative evidence to show their involvement in the alleged crime. (Shutterstock) On June 12, 2024, the Azad Maidan Unit of the Anti-Barcotics Cell seized 2,160 tablets and 74 strips containing pheniramine maleate from a parked handcart close to a rickshaw stand in front of the Kismat Hostel near Masjid Station. Three men were booked in the case, out of which accused No. 3, in his statement to the ANC, had admitted that the contraband material belonged to him. While hearing the plea of Saddam Sheikh and Imran Khan, the owners of the handcart seeking to be discharged from the case, additional sessions judge RB Rote said, 'I find that the evidence as collected during the investigation, and as relied on by the prosecution, is not sufficient to frame charges against accused No. 1 and 2.' While the seizure itself was not disputed, the court noted that the prosecution failed to prove that Sheikh and Khan were the owners of the recovered contraband material. Moreover, the prosecution primarily relied on witness statements recorded under Section 161 (process of examination of witnesses by police during an investigation) of the CrPC and the seizure panchnama. Even there, the court noted that the witnesses who spoke about the accused were not present at the scene and their information was based on hearsay. 'Such type of statements cannot be the basis for framing charges against the accused persons,' said additional Sessions Judge R B Rote while discharging the two. The court further highlighted the absence of forensic evidence or any chemical analysis linking the seized drugs to the accused. Regarding the nature of the substance, the court noted that the recovered pheniramine maleate did not qualify as a commercial quantity under the NDPS Act, which further weakened the case. 'The seized contraband in the present matter is of non-commercial quantity and there is no material on record to show that the accused persons were found in possession of the said contraband or they were the owners of the said contraband.' The judge concluded that mere recovery of drugs was insufficient to frame charges under the NDPS Act without establishing conscious possession or ownership. 'The only material on record is that some contraband was recovered from a place, but the link of the accused persons with the said contraband is not established. Therefore, I find that the evidence, as collected during the investigation and as relied on by the prosecution, is not sufficient to frame charges against the accused persons,' the court stated.

Ghose panel faults KCR and team

Hyderabad: The Justice PC Ghose Commission of inquiry into the Kaleshwaram project has held former chief minister K Chandrashekhar Rao, former irrigation minister T Harish Rao , former Finance minister E Rajender and a bunch of senior officials, including the then Irrigation special Chief Secretary SK Joshi, responsible for the colossal waste of public money in the construction of the Kaleshwaram project. The Commission has observed in its report that Rao was directly and indirectly responsible for the irregularities in the project, right from its planning and construction to operation and maintenance of the barrages which are part of the project, sources said. The Commission pointed fingers also at former irrigation minister T Harish Rao, a nephew of KCR. A committee of experts had advised against taking up the Kaleshwaram project, but the BRS regime had 'intentionally suppressed' the report, they said. The sources said the officials had prepared a 60-page summary of the report, which runs into 665 pages. The summary mentioned the names of KCR 32 times, Harish Rao 19 times and former minister Eatala Rajender five times. Rajender is now a BJP Lok Sabha member. The report found Rajender, who was finance minister during the BRS regime, to be negligent, the sources said. Briefing the press after the Cabinet meeting, the Chief Minister, apparently enthused by the damning evidence against former chief minister K Chandrasekhar Rao and ex-ministers, said that since the report was prepared by an independent judicial commission, the question of resorting to politics of vengeance did not arise. Going by the findings of the Commission highlighted in the report, the government will initiate action against those who were involved in the 'embezzlement of public money in the construction of the Kaleshwaram project.' Amplifying the key findings, Revanth Reddy said that former chief minister K Chandrashekhar Rao redesigned the Pranahita -Chevella project and constructed Medigadda, Annaram and Sundilla barrages which were damaged within three months of the construction of the Kaleshwaram project. Although an expert committee had submitted a report against Kaleshwaram, KCR chose to go ahead with the construction of the barrages 'without any planning'. The Chief Minister recounted that, ahead of the Assembly elections, the Congress had promised that, if voted to power, the government would order a probe into the collapse of the Kaleshwaram project. Accordingly, the state government constituted a judicial commission to investigate the misuse of Rs one lakh crore in the construction of the project. Revanth Reddy said that the cabinet reviewed the 665-page Ghose Commission report as well as a summary of the report submitted after vetting by a three-member official committee.
