
Human rights group loses challenge over jet part exports amid Gaza conflict
In September last year, the Government suspended export licences for weapons and military equipment following a review of Israel's compliance with international humanitarian law in the conflict.
But an exemption was made for some licences related to parts for F-35s, which are part of an international defence programme.
The DBT defended the challenge, with its barristers telling a four-day hearing in London that the carve-out is 'consistent with the rules of international law'.
In a 72-page ruling on Monday, Lord Justice Males and Mrs Justice Steyn dismissed the legal challenge.
The senior judges said that 'the conduct of international relations' is a matter for the executive, rather than the courts, and that it would be unnecessary to decide whether there was a 'significant risk' that the carve-out could facilitate crimes.
They added: 'The grave risk to life in the ongoing military operations in the Gaza Strip is not created by the F-35 carve-out, and would not be removed by suspension of the export from the UK of F-35 parts into the F-35 programme.'
The High Court was previously told that the decision to 'carve out' licences related to F-35 components followed advice from Defence Secretary John Healey, who said a suspension would impact the 'whole F-35 programme' and have a 'profound impact on international peace and security'.
The F-35 programme is an international defence programme which produces and maintains the fighter jets, with the UK contributing components for both assembly lines and an international pool.
Israel is not one of the 'partner nations' of the programme, the court heard, but is a customer and can order new F-35 aircraft and draw on a pool for spare parts.
The two judges later said they agreed with barristers for the DBT, who said it was not possible for the UK to 'unilaterally' ensure that UK-made parts did not reach Israel.
Lord Justice Males and Mrs Justice Steyn said: 'In short, the Secretary of State reasonably concluded that there was no realistic possibility of persuading all other partner nations that F-35 exports to Israel should be suspended.'
'Accordingly he was faced with the blunt choice of accepting the F-35 carve-out or withdrawing from the F-35 Programme and accepting all the defence and diplomatic consequences which would ensue,' they added.
The two judges also said the case was about a 'much more focused issue' than the carve-out itself.
They continued: 'That issue is whether it is open to the court to rule that the UK must withdraw from a specific multilateral defence collaboration which is reasonably regarded by the responsible ministers as vital to the defence of the UK and to international peace and security, because of the prospect that some UK manufactured components will or may ultimately be supplied to Israel, and may be used in the commission of a serious violation of international humanitarian law in the conflict in Gaza.
'Under our constitution that acutely sensitive and political issue is a matter for the executive which is democratically accountable to Parliament and ultimately to the electorate, not for the courts.'
Following the ruling, Al-Haq director general Shawan Jabarin said the long-running case had caused a 'significant impact'.
He continued: 'Despite the outcome of today, this case has centred the voice of the Palestinian people and has rallied significant public support, and it is just the start.
'This is what matters, that we continue on all fronts in our work to defend our collective human values and work towards achieving justice for the Palestinians.'
A Government spokesperson said: 'The court has upheld this Government's thorough and lawful decision-making on this matter.
'This shows that the UK operates one of the most robust export control regimes in the world. We will continue to keep our defence export licensing under careful and continual review.'

Joanna Cherry could be called in Moira Salmond legal case
The former First Minister raised a compensation claim of £3million against SNP ministers almost two years ago over a flawed sexual misconduct investigation by the Scottish Government. A Holyrood committee investigated the mishandling of the complaints and also found that there were serious shortcomings. The legal case concerns possible "misfeasance" - a civil law term meaning the wrongful exercise of lawful authority - by officials while Nicola Sturgeon was First Minister and was paused following Mr Salmond's sudden death in October last year. READ MORE: On Sunday, it emerged that Mrs Salmond's resolve to proceed with the case was strengthened by attacks on her late husband in Ms Sturgeon's memoirs, Frankly, published last week. Writing on X, Ms Cherry, who was a close ally of Mr Salmond and is a prominent critic of Ms Sturgeon, welcomed the report that the case is to resume. "It's important that this action continues," wrote the former SNP MP on X. "Misfeasance in public office is a very serious matter. The Scottish Parliament inquiry was hamstrung and partisan politicians had the wool pulled over their eyes. A court of law will be very different." Ms Cherry revealed last week that she is writing a book about her time in frontline politics when Ms Sturgeon was First Minister. The manuscript is due to be completed this autumn with the book due to be published next year. Referring to Ms Sturgeon's government's policies on gender self-declaration, which she opposed, she wrote: "I have a lot more to say about this in the book I'm currently writing although my take is slightly different." She later continued: "In her political afterlife as in her political life Nicola evades scrutiny. For those hoping to understand better what was really going on behind the scenes during her leadership, this memoir will disappoint. It will be left to others to spill the beans." A family friend told the Sunday Mail that Mrs Salmond was "upset and angered by the continued attempts to smear Alex in the book" with "ridiculous and inaccurate" allegations. "It has only strengthened her resolve to make sure the full truth comes out and Alex's name is cleared," they told the paper. Now executor of Mr Salmond's estate, his widow has assembled a legal team including a KC and two junior counsel and has raised money to fund the case. The friend added: "Her case against the government is now live, the legal team is in place, the finance in place and this will be going ahead, no question of that. "Alex may not be here to defend himself but his family are determined to stand up to those who continue to attack him." Ms Sturgeon's book includes strongly disputed claims Mr Salmond opposed gay marriage, failed to read the 650-page independence white paper and that he or an aide acting on his behalf may have been responsible for the leak to the Daily Record about the Scottish Government investigation into complaints against him. She also denied there had been any "conspiracy" to ruin Mr Salmond's reputation - a claim the former Alba Party leader maintained until his death at the age of 69. Ms Sturgeon said her former mentor "would have rather destroyed the SNP than see it succeed without him". She also claimed he "impugned the integrity of the institutions at the heart of Scottish democracy - government, police, Crown Office", adding: "He was prepared to traumatise, time and again, the women at the centre of it all." Ms Sturgeon and Mr Salmond fell out dramatically in 2018 after it emerged her government had investigated misconduct complaints made against him by two female civil servants. Mr Salmond had the probe struck down at the Court of Session as unfair, unlawful and "tainted by apparent bias", and was awarded £512,000 in legal costs. He was later cleared of 13 sexual assault charges at the High Court in Edinburgh in 2020. He launched the Alba Party as a rival to the SNP a year later. The former First Minister, who admitted he could have behaved better towards women on occasions, had always denied any criminality. He sued the Scottish Government in November 2023 alleging there had been misfeasance by various civil servants under Ms Sturgeon and sought damages of around £3million. Promising a "day of reckoning", he said at the time: "Not one person has been held accountable. With this court action that evasion of responsibility ends." In a Court of Session hearing last August, Mr Salmond's lawyer said the police were probing whether one senior civil servant "gave a false statement under oath" to a Holyrood inquiry that was probing how the sexual harassment claims were handled. The civil action was frozen when Mr Salmond suffered a fatal heart attack in North Macedonia. But Mrs Salmond's legal team is now reactivating proceedings. A spokesman for the Scottish Courts and Tribunals Service told The Herald that the case had been "sisted" until 19 September. He added: "Following this date the parties would advise the court, if they are ready to proceed or if they are requesting a further sist to the case." The Scottish Government has previously vowed to defend itself "robustly" in court. Last night a Scottish Government spokeswoman said: 'It would not be appropriate to comment on live litigation.' Home Office to return Iraqi migrants to 'deter small boats'
The deal, signed by Home Office minister Dan Jarvis, will set up a formal process to return Iraqis who have arrived in the UK with no right to stay in the country. It comes after an £800,000 deal last year with Baghdad to help the country crack down on smuggling networks and organised crime. Earlier this year, Keir Starmer and Iraq's prime minister Mohammed Shia Al-Sudani agreed to strengthen co-operation on migration. The Home Office said the accord would allow the 'swift' return of "illegal" migrants. Home Office statistics said that since previous deals, the number of Iraqis arriving in the UK by small boat has fallen to 1900 in the year to March 2025, down from 2600 in the previous year. Jarvis said: 'By working together on security, development and migration challenges, we are building stronger relationships that benefit both our countries whilst tackling shared challenges like organised crime and irregular migration.' What is the Home Office's policy on small boat returns? The returns deal is the latest as part of the Home Office's policies to stop small boats crossing the channel. Similar agreements have already been made with Albania and Vietnam since Labour came into power. Another deal with France recently came into force, where people who have arrived over the English Channel from the French coast can be returned to the country. The person will then be exchanged for a "legitimate asylum seeker" in France who can demonstrate a genuine family link to the UK. The number has been capped, but it is hoped it will act as a deterrent to those crossing the Channel. The latest figures from the Home Office showed 116 people arrived aboard two small boats on August 15. Jarvis said: 'This visit reinforces the strength of the UK-Iraq partnership and demonstrates our government's commitment to serious diplomacy that delivers real results. 'As someone who served in Iraq, I understand first-hand the importance of building enduring relationships in the region, and the new agreement we have signed is a testament to the trust and co-operation we've built with our Iraqi counterparts.' He said: 'Over 50,000 illegal immigrants have crossed the Channel in Labour's short time in power, the worst illegal immigration crisis in our history. 'Labour has surrendered our borders, and the consequences are being felt in our communities, from rising crime to shocking cases of rape and sexual assault by recent arrivals. 'Now they boast about a measly returns deal with Iraq, but barely any small boat arrivals are Iraqi, and most would qualify for asylum anyway. It's a sham designed to look tough while crossings keep soaring. 'Labour has scrapped Conservative deterrents and created the conditions for chaos, leaving the British people to foot the bill. Only the Conservatives will stop the crossings and restore control of Britain's borders.'
