
SC stays proceedings against Karnataka BJP MLC for ‘obscene' remarks about Congress minister
The Supreme Court on Monday stayed the criminal proceedings against Karnataka MLC and Bharatiya Janata Party CT Ravi in a case related to the allegedly derogatory remarks he made about Congress minister Laxmi Hebbalkar in the state Assembly, Live Law reported.
A bench of Justices MM Sundresh and Rajesh Bindal was hearing a petition against a May 2 order of the Karnataka High Court, which refused to quash the criminal case against the BJP leader.
On December 19, Hebbalkar, the state women and child development minister, accused Ravi of repeatedly calling Congress leader Rahul Gandhi a 'drug addict' amid ruckus in the Karnataka Assembly.
In response, Hebbalkar called Ravi a 'murderer', referring to his alleged involvement in a 2019 road rage incident. This led the BJP leader to use an alleged sexually derogatory slur against her, escalating the chaos on the floor of the House.
Hebbalkar filed the first information report against Ravi. He was booked under provisions of the Bharatiya Nyaya Sanhita related to sexual harassment and outraging the modesty of a woman through words, gestures or actions.
On Monday, the Supreme Court issued notice in the matter and stayed the proceedings in the trial court, Live Law reported.
In his petition, Ravi said that his statements were made during the parliamentary proceedings in the Legislative Council in December and was hence protected under the immunity granted to MPs during their conduct in the House, according to Live Law.
The petition added that provisions under the Civil Procedure Code also barred the arrest of members during parliamentary sessions and for up to 40 days after the sessions, PTI reported.
Ravi was arrested in Belagavi on the evening of December 19 and granted bail two days later.

Supreme Court grants interim protection from arrest to MP Journalist alleging police assault
The Supreme Court on Monday directed two Madhya Pradesh-based journalists, who have accused the Bhind superintendent of police and other officers of custodial assault and harassment, to approach the Madhya Pradesh High Court for relief. The court granted them interim protection from arrest for two weeks to allow time to file their plea. A bench comprising Justices Prashant Kumar Mishra and Manmohan told the petitioners—Shashikant Jatav and Amarkant Singh Chouhan—that it was not inclined to entertain their plea under Article 32 of the Constitution. However, noting the gravity of the allegations, the bench permitted them to seek remedy before the High Court. 'We are not entertaining the plea. However, looking at the allegations, we permit the petitioners to move the concerned high court within two weeks from today. Till the time the petitioners move high court …the petitioners shall not be arrested,' Justice Mishra said. The journalists have alleged that they were targeted by police due to their reporting on alleged corruption related to sand mining. In their plea, they sought protection from coercive action by the MP Police and claimed they feared for their lives. The petition also accused a senior police officer and his subordinates of kidnapping, custodial assault, and using casteist slurs against them. The bench previously questioned why the Bhind superintendent of police had not been made a party to the petition. "It is very easy to say all kinds of things against an IPS officer without making him a party. Whatever comes to your mind, just put it in black and white against the IPS officer," the bench remarked. The court also asked why the National Human Rights Commission (NHRC) and the National Capital Territory (NCT) of Delhi were named as respondents. The counsel for the journalists said the NHRC had been included because a complaint had been filed there, but agreed to remove it from the petition. On the inclusion of NCT of Delhi, it was submitted that both petitioners are currently residing in the national capital. Meanwhile, on May 28, the Delhi High Court had granted Chouhan interim protection for two months after he claimed that the Bhind SP had threatened him following an alleged assault in his office. The Supreme Court has listed the matter for further hearing on June 9.

A critical test for institutions
The Supreme Court stopped short of instituting an internal probe into the conduct of Justice Shekhar Kumar Yadav, a sitting judge of the Allahabad High Court, following a March letter from the Rajya Sabha secretariat raising issues of jurisdiction, this newspaper reported Monday. The letter reiterated the process as referred to by Rajya Sabha chairperson and Vice-President Jagdeep Dhankhar previously in February in Parliament — that only Parliament and the President have the jurisdiction to proceed against the judge, who is in the dock for alleged hate speech against Muslims delivered in December 2024. Even as the Supreme Court took note of that speech, a group of 55 opposition MPs filed a notice in the Rajya Sabha seeking Justice Yadav's impeachment for 'grave violation of judicial ethics'. As per the law, the removal of a high court or Supreme Court judge for 'proved misbehaviour or incapacity' must go through Parliament. The chairperson will now have to decide on the admissibility of the motion and if an inquiry needs to be held. The Rajya Sabha chairperson, who has been vocal about judicial integrity and institutional probity, should ensure that the complaint against the judge is now processed in a transparent manner and concluded before the judicial officer retires in April next year. A timely closure in the matter is necessary to ensure that there is no reputational damage to the judiciary, Parliament, or the concerned judge, in case he is found innocent of the alleged hate speech. Interestingly, while Justice Yadav, reportedly, regretted his conduct and assured the Supreme Court collegium that he will render a public apology in a closed-door meeting with it in December, he has not issued one and instead defended his speech, delivered in a meeting of Vishwa Hindu Parishad activists in Prayagraj, as reflecting India's cultural ethos. A judge is bound by oath to protect constitutional values, not articulate majoritarian sentiments or populist views, even if they are part of some perceived cultural ethos. Any deviation is a violation of the oath and compromises the integrity of the judiciary. The Justice Yadav case presents a critical test. It is not merely about the conduct of one judge but will have wider implications for the principle of separation of powers and commitment of public institutions to constitutional ideals. How this matter is now handled by the Rajya Sabha will set an important precedent for the future of India's democratic institutions.

Mumbra train tragedy: Call for automated doors, more trains after at least 4 dead due to overcrowding
Speaking to the media, Central Railway Chief Public Relations Officer Swapnil Nila said that the guard of the Kasara-bound train reported at 9.30 am that some injured passengers were lying along the tracks near the control room at CSMT. He, however, did not know from which train the passengers had fallen. The Central Railway officials said that prima facie, the passengers on the footboard of the down train towards Chhatrapati Shivaji Maharaj Terminus (CSMT) collided with those standing on the footboard of a Kasara-bound train headed in the opposite direction on the parallel track. Mumbai: At least four passengers died, whereas over a dozen suffered injuries after falling off a crowded moving train near Mumbra station in Thane district Monday morning. Visiting the site later, Shiv Sena MP Shrikant Shinde said that at least five people died in the incident even as the police said four people died. At least a dozen persons injured in the incident are now under treatment at different hospitals in Mumbra and Thane. 'It is not a collision of trains. People travelling on the footboard of a local train towards Kasara and those similarly travelling on a train going towards CSMT collided with each other and fell,' he said. 'The distance between the two trains was 1.5-2 metres, but at curves, a slight tilt happens, which could have been another reason for the incident.' According to railway officials, the train was overcrowded, and hence, people stood on footboards. A police team and railway officials immediately rushed to the spot, and an investigation is currently underway. How to prevent such accidents The railways, soon after the incident, decided to provide automated doors for all new and existing Mumbai suburban train rakes shortly, Swapnil Nila told the media. Currently, the Mumbai suburban trains have open doors. Many passengers during peak hours stand on the footboard. Chief Minister Devendra Fadnavis said to the media, 'The incident in which a total of eight passengers fell from a local train between the Diva and Mumbra stations, resulting in some fatalities, is extremely unfortunate. I offer my heartfelt condolences to the deceased.' He added: 'The local administration is coordinating efforts on the ground. I pray to god for the swift recovery of the injured. The railway department has initiated an investigation to determine the exact cause of the incident.' Speaking to the media, MP Shrikant Shinde acknowledged that many people now lived in Kalyan on the Dombivali side. With that, he said, 'The availability of trains needs to go up and should be done quickly.' There have been sharp political reactions to the incident. Congress state president Harshwardhan Sapkal, in a statement to the media, said, 'These deaths are not by accident. These people became victims at the hands of the government. For the past 11 years, the people of Maharashtra and Mumbai have been listening to empty promises about improved infrastructure and smoother commutes for Mumbaikars.' 'In the name of development and facilities, it has become a game of awarding tenders and collecting commissions. The ruling officials and contractors have grown richer through this nexus, while ordinary citizens are paying for this corruption with their lives.' Shiv Sena UBT and NCP(SP) have expressed anguish over the incident, too. Sharad Pawar, in an X post, said that the growing population of Mumbai needed appropriate facilities. 'On an average 6-7 people die every day after falling off from local trains. It is not right to blame the passengers for this incident. Central Railway should plan well and take timely action against this. The trains on important routes should be increased. Fitting automated doors on trains should be done timely,' wrote Sharad Pawar.
