Delhi HC dismisses Rs 1,300 cr damages appeal by Kalanithi Maran & KAL Airways against SpiceJet

A Division Bench of Delhi High Court has dismissed the appeal filed by KAL Airways and businessman Kalanithi Maran seeking damages of more than Rs 1,300 crore from SpiceJet , said the low-cost airline in a statement. These assertions were already previously rejected by the Arbitral Tribunal and then the Delhi High Court.KAL Airways and Kalanithi Maran initially sought damages of more than Rs 1,300 crore during the arbitration proceedings. These claims were thoroughly examined and subsequently rejected by a panel of three retired Supreme Court judges. Following this, KAL Airways and Kalanithi Maran appealed to the Single-Judge Bench of the Delhi High Court, seeking the same amount in damages, which was also rejected by the court.The incident dates back to January 2015, when Singh, the previous owner of the airline, repurchased it from Maran following a prolonged grounding due to financial constraints. The tribunal ruled that Maran owed Singh and the airline Rs 29 crore in penal interest, while Singh was instructed to reimburse Maran Rs 579 crore along with interest.Established in 2016 as per the Delhi High Court's directive to settle the share transfer dispute, the tribunal determined that there was no violation of the share sale and purchase agreement made between Maran and the current promoter Singh in late January 2015.The tribunal rejected Maran's appeal for damages of Rs 1,323 crore from SpiceJet.In February 2015, Maran of the Sun Network and Kal Airways, his investment vehicle, had transferred their 58.46 per cent stake in SpiceJet to Singh for Rs 2 (Rs two only) along with Rs 1,500 crore debt liability, after the airline was grounded due to a severe cash crunch.Singh was the first co-founder of the airline and is now its chairman and managing director.As part of the agreement, Maran and Kal Airways had claimed to have paid Spicejet Rs 679 crore for issuing warrants and preference shares.However, Maran approached the Delhi High Court in 2017, alleging SpiceJet had neither issued convertible warrants and preference shares nor returned the money.After today's development, the shares of SpiceJet were trading at Rs 44.97 a piece on the BSE, up by 2.60 per cent as of 10:55 am on Monday.

'For Diehl Defence, the collaboration with Reliance Defence is part of the company's commitment to the Indian market and to the 'Make in India' initiative of the Indian government,' the statement said. Paytm, Mobikwik shares tumble after finance ministry rules out MDR on UPI transactions

Investors sold Paytm and Mobikwik shares on Thursday, a day after the Finance Ministry denied reports of charges on UPI transactions. Paytm shares dropped 10% in trade today, before recovering later. The stock was trading 6.56% lower at Rs 897.20 as of 2:30 p.m. The company's market capitalisation dropped as much as Rs 6,123 crore to an intraday low of Rs 55,123 crore, but later returned to Rs 57,233 crore. Meanwhile, Mobikwik shares fell 3% to an intraday low of Rs 273.05 per share. As of 2:35 p.m., the counter was down 2.68% at Rs 273.95. The company's market value dropped to Rs 2,121 crore, before recovering slightly to Rs 2,128 crore. On Wednesday media reports claimed that the government was planning to levy a Merchant Discount Rate (MDR) on transactions exceeding Rs 3,000 via the Unified Payments Interface (UPI). Over the last few months, the digital payments industry has been abuzz about MDR coming back on UPI. 'Speculation and claims that the MDR will be charged on UPI transactions are completely false, baseless, and misleading. Such baseless and sensation-creating speculations cause needless uncertainty, fear and suspicion among our citizens. The Government remains fully committed to promoting digital payments via UPI,' a Finance Ministry post on X said. UPI and RuPay debit card payments have been exempted from this charge since the presentation of Union Budget 2019-20 to promote digital transactions. However, banks and fintechs have called the incentives insufficient and want MDR brought back for such transactions to sustain infrastructure and maintenance costs. Scale of UPI UPI processed 18.68 billion transactions worth Rs 25.14 lakh crore in May, marking a 33% increase over the year-ago period. The average daily transaction amount stood at Rs 81,106 crore, with 602 million daily transactions. For the fiscal year ended March 2024, UPI accounted for 80% of India's retail digital payments.
