New Delhi [India], June 16 (ANI): A review petition has been filed before the Supreme Court against its recent judgment mandating three years of practice as a lawyer for the entry posts in judicial service (post of Civil Judge-Junior Division).
The review petition was filed against the judgment delivered by a bench of Chief Justice of India BR Gavai, Justice Augustine George Masih and Justice K Vinod Chandran on May 20.
The top court had also ordered that the requirement of minimum years of practice shall not be applicable in cases where the High Court had already initiated the selection process for the post of Civil Judge (Junior Division) prior to the date of the judgment.
Advocate Kunal Yadav filed the review petition stating that fundamental rights under Articles 14 and 16 stand infringed due to the imposition of the condition.
He has urged the court to implement the mandatory three-year practice rule only from 2027 to avoid the unjust exclusion of recent graduates (2023-2025) who prepared under the previous eligibility criteria.
The plea said that the judgment suffered from apparent errors on the record, warranting a review.
It said that direction mandating a minimum of three years of legal practice disproportionately impacts aspirants from economically weaker sections and socially disadvantaged communities, particularly Scheduled Castes (SC), Scheduled Tribes (ST) and Other Backward Classes (OBC).
There was no comprehensive data placed before the court to establish that fresh law graduates or candidates without three years of Bar experience are underperforming in judicial roles, said the review petition. (ANI)

SC stays Calcutta High Court's suo motu contempt proceedings against police officials
New Delhi, June 16 (UNI) The Supreme Court today stayed the Calcutta High Court's order initiating suo motu criminal contempt proceedings against several West Bengal police officials in connection with the alleged assault on lawyers at the Howrah District Court complex in April 2019. A bench comprising Justice Ujjal Bhuyan and Justice Manmohan was hearing special leave petitions (SLPs) filed by the implicated police personnel and a connected plea by the State of West Bengal challenging the maintainability of the High Court's suo motu contempt action after a five-year delay. Senior Advocate Chander Uday Singh, appearing for the petitioners, questioned the legality of the High Court's decision, arguing that under Section 20 of the Contempt of Courts Act, 1971, a one-year limitation applies even to suo motu contempt proceedings. He relied on the Supreme Court's precedent in Maheshwar Peri v. High Court of Judicature at Allahabad (2016), which held that the limitation period applies uniformly, whether contempt is brought to court by a private party or taken up on the court's own motion. ' The apex court, after hearing preliminary submissions, issued notice and ordered that a notice be issued, returnable in six weeks. "In the meanwhile, further proceedings pursuant to the order dated May 2, 2025, shall remain stayed," the judges said. The case pertains to the incident of April 24, 2019, when lawyers at the Howrah District Sadar Court were allegedly assaulted by police personnel who reportedly entered the court premises without authorisation. Following public outcry, the Calcutta High Court took suo motu cognisance of the incident and, in May 2019, appointed former judge Justice K. J. Sengupta as a one-man commission to conduct an inquiry. However, the High Court revived the matter only recently, based on the findings of the Sengupta Commission. In its May 2, 2025 order, the High Court proceeded to initiate contempt action against the concerned police officials. The petitioners argued that the contempt proceedings were barred by limitation under Section 20 of the Contempt of Courts Act. However, the Calcutta High Court, in its order, took a different view. It stated, 'The bar of limitation as in Section 20 of the 1971 Act, according to us, is in respect of proceedings initiated by individuals bringing to the notice of the Court an act of contempt. The whole object of such limitation is to ensure diligence on the part of the complainant. But the powers under Article 215 of the Constitution, where the Court itself initiates suo motu proceedings, cannot be curtailed by Section 20, particularly in view of the Court's inherent powers.' Despite this interpretation by the High Court, the Supreme Court has now intervened and stayed the operation of the May 2 order, pending further consideration. The case will be heard next after six weeks. UNI SNG SSP

Nicosia [Cyprus], June 16 (ANI): Cyprus President Nikos Christodoulides and Prime Minister Narendra Modi on Monday viewed the mountains near Nicosia, which are under Turkish occupation, and engraved on the mountains are words which remind the Cypriots that a large part of their country has been under occupation since 1974. PM Modi, who visited Cyprus in the first leg of his three-nation visit, reiterated India's support for Cyprus's unity and for a peaceful resolution of the Cyprus Question based on UN Security Council resolutions, international law, and the EU Acquis. India has reiterated its unwavering and consistent support for the independence, sovereignty, territorial integrity, and unity of the Republic of Cyprus. A joint declaration released after meeting between the Cyprus President and PM Modi said that both sides emphasized the need to avoid unilateral actions as essential for creating a conducive environment for the resumption of meaningful negotiations. The two countries expressed their strong commitment to the resumption of UN-facilitated efforts to achieve a comprehensive and lasting settlement of the Cyprus Question on the basis of a bizonal, bicommunal federation with political equality, in accordance with the agreed UN framework and the relevant United Nations Security Council Resolutions,' the statement said. It said that the United Nations has in several resolutions of the General Assembly and the Security Council demanded respect for the independence, unity and territorial integrity of Cyprus, the return of refugees to their homes and the withdrawal of foreign troops from the island. All of these resolutions have been consistently ignored by Turkey and the Turkish Cypriot leadership. Prime Minister Narendra Modi's visit to Cyprus, the first by an Indian Prime Minister in 23 years, is being viewed as a diplomatic signal to Turkey, which has occupied one-third of the island since 1974 and had backed Pakistan during Operation Sindoor last month. Cyprus has backed India on the issue of terrorism. Cyprus forms part of the energy corridor that will connect India with Europe and strengthen East-West connectivity through the India-Middle East-Europe Corridor (IMEC). In the joint declaration released on Monday, Cyprus and India unequivocally condemned terrorism and violent extremism in all its forms and manifestations, including international and cross-border terrorism, and reaffirmed their shared commitment to countering hybrid threats that undermine peace and stability. Cyprus expressed solidarity and unwavering support to India in its fight against cross-border terrorism. The two leaders strongly condemned the gruesome killing of civilians in the recent heinous terrorist attacks in Pahalgam, Jammu and Kashmir. They reiterated their zero-tolerance approach to terrorism, rejecting any justification for such acts, under any circumstances. They emphasized that those responsible for the attacks should be held accountable. PM Modi and Cyprus President urged all states to respect the sovereignty of other nations and condemned cross-border terrorism in all its forms. They called for the disruption of terrorism financing networks, elimination of safe havens, dismantling of terrorist infrastructure, and bringing perpetrators of terrorism to justice swiftly. Emphasizing the need for a comprehensive, coordinated, and sustained approach to combatting terrorism across borders, they underscored the importance of working collaboratively, bilaterally and with the multilateral system. Both leaders reaffirmed their commitment to strengthening multilateral efforts to combat terrorism and called for the expeditious finalization and adoption of the Comprehensive Convention on International Terrorism within the UN framework. They urged for concerted actions against all UN- and EU-designated terrorists and terrorist entities, associated proxy groups, facilitators, and sponsors, including terrorists under 1267 UNSC Sanctions Committee. They reiterated their strong commitment to continue taking active measures to disrupt terrorist financing channels including through the UN and Financial Action Task Force (FATF). Acknowledging emerging challenges within the international security environment, the leaders stressed the importance of enhancing strategic autonomy, defence readiness, and defence capabilities. (ANI)
