Police move court as Juvenile Justice Board junks plea to try Porsche case accused as adult

Hindustan Times3 days ago
Pune, The Pune police have approached a sessions court, challenging the Juvenile Justice Board's decision to reject their request to try a 17-year-old accused in the deadly Porsche car crash here as an adult for the trial in the case, an official said on Tuesday. Police move court as Juvenile Justice Board junks plea to try Porsche case accused as adult
The boy, son of a well-known real estate developer, is accused of driving the luxury car in Kalyani Nagar area of Pune in an inebriated state and fatally knocking down two motorcycle-borne IT professionals, Anish Awadhiya and Ashwini Costa, in May last year, an incident that attracted nationwide attention.
The Juvenile Justice Board last month rejected the Pune police's plea to treat the juvenile accused as an adult, stating the offence does not qualify as a "heinous crime".
An officer from the crime branch on Tuesday said that after obtaining necessary permission from the district collector, the Pune police approached the sessions court here and challenged the JJB order on August 4.
Advocate Sarthi Pansare, who is assisting Special Public Prosecutor Shishir Hiray in the Porsche car crash case, said that while moving the application in the sessions court, the prosecution argued the juvenile was in full knowledge about the consequences if he drives the car in an inebriated condition.
"Our demand is to conduct a psychological assessment of the juvenile and it can be done only after he is declared an adult in the case. We argued that this is an exceptional case and the juvenile should be treated as an adult," Pansare said.
Defence counsel Prashant Patil, representing the boy, had cited a Supreme Court Judgement in the Shilpa Mittal Vs State case in which the SC has defined what is a heinous crime.
The guidelines decided by the Supreme Court are binding on everyone, however, the plea by prosecution is contrary to the apex court's judgement, Patil said.
The defence demanded that since the plea is contrary to the Supreme Court's guidelines, it is not maintainable, he said.
To define a certain crime as heinous, the prosecution must have a section in which minimum punishment is seven years, he said.
The JJB, in its order, stated the child should not be subjected to preliminary assessment under Section 15 of the Juvenile Justice Act, 2015. The provision of preliminary assessment is only for heinous offences.
The teenager got bail hours after the horrific accident on May 19 last year.
The lenient bail terms, including asking the minor to write a 300-word essay on road safety, triggered a nationwide firestorm, following which he was sent to an observation home in Pune city three days later.
On June 25 last year, the Bombay High Court directed that the boy be released immediately, saying the Juvenile Justice Board's orders remanding him to an observation home were illegal and the law regarding juveniles must be implemented fully.

Stepfather convicted of sex assaults after 10-year-old's bold testimony in Thane

Thane: A 10-year-old girl's courageous testimony against her stepfather led to his conviction for sexual assaults and exploitation, with a Thane court sentencing him to ten years of rigorous imprisonment (RI) on Monday. Additional Sessions Judge DS Deshmukh convicted the 35-year-old stepfather under the Pocso Act after the victim consistently described how he sexually assaulted the girl multiple times in their home at a chawl in Thane. The incident came to light in April 2019 when neighbours noticed the child had gone missing for two days along with her elder brother. When she returned on April 11, 2019, concerned neighbours questioned her about her whereabouts, leading to the shocking revelation. The girl told the court that her stepfather sexually assaulted her. She also revealed that he committed similar heinous acts earlier when her mother was ill, showing a pattern of abuse that was ongoing. The child's mother died after giving birth to her younger brother, leaving her vulnerable to the predatory behaviour of the man who was supposed to protect her. Medical evidence from the hospital strongly supported the child's testimony. The court observed that the medical officer's testimony, combined with the victim's consistent statements throughout the proceedings, established the case beyond a reasonable doubt. The court, calling it a heinous act and a blot on the father-daughter relationship, noted that instead of being a protector, the accused became a predator who sexually exploited the child. The judge said that such a stringent punishment would send a clear message to society about the consequences of child sexual abuse. He was also convicted of using minors for begging and exploitation under the Juvenile Justice Act, receiving a one-year sentence, which will run concurrently. The court imposed a total fine of Rs 12,000 to be paid to the victim as compensation, with all sentences running concurrently. Actor Darshan, Prajwal Revanna refuse to attend Independence Day celebrations in jail

Kannada superstar Darshan, who was arrested in the sensational fan murder case, and Prajwal Revanna, former JD(S) MP convicted in the obscene video and rape case, did not participate in the 79th Independence Day celebrations held at the Bengaluru Central Prison, sources said on Friday. Darshan was arrested on Thursday (August 14) following the Supreme Court's cancellation of his bail, while Prajwal Revanna, grandson of former Prime Minister H.D. Deve Gowda, has been in prison for over a year, and the Special Court on August 1 convicted him to a life term until his death. Sources stated that both are in a state of depression following these developments and chose to remain in their barracks. Sources further stated that Darshan did not sleep throughout the night in the prison. According to sources, all accused, including Darshan, have been assigned remand prisoner numbers. Darshan's prisoner number is 7314 and Darshan's partner Pavitra Gowda's number is 7313. Pavitra Gowda is the first accused in the fan murder case. The last time Darshan was arrested, many fans had created tattoos with his prisoner number, which sparked controversy and even led to police cases being filed. Currently, Darshan and the other three accused have been placed in the same barrack. Meanwhile, film actress Ramya, who faced brutal trolling from Darshan's fans after she posted that the family of the deceased man Renukaswamy in the fan murder case should receive justice, reacted to the media by saying that Darshan should have kept better company. 'I have acted in films with Darshan. He had shared his story with me, and I had felt proud of his progress,' she said. 'Darshan had grown from being a stage light boy to becoming a star. However, his recent conduct has disappointed me. He has spoiled his life. 'When one reaches a certain stage in life, there comes responsibility. I don't know if he had good company around him. He could have very well moved forward in life with grace,' Ramya added. Talking about the judgment, Ramya said it has brought relief. 'Society is moving in the wrong direction. My post on the protection of women and honour-based issues was trolled. This judgment will help society get back on the right track and sends a strong message that everyone is equal before the law,' she stressed. Ramya also noted that Renukaswamy's family, who hail from a humble background, have finally received justice through the Supreme Court's verdict.
