Cosatu defends B-BBEE policy amid criticism from Solidarity and FMF

The battle for the scrapping of "race laws" in South Africa went a notch up on Thursday as the Congress of South African Trade Unions (COSATU) shot down a call to review and drop South Africa's Broad-Based Black Economic Empowerment (B-BBEE) policy.
This comes as trade union Solidarity and the Free Market Foundation (FMF) on Thursday released a report claiming that B-BBEE has caused serious damage to the country's economy and to its population while only enriching a small, politically-connected elite.
The report draws on data from the B-BBEE Commission, Stats SA, the JSE, and international comparisons to assess the real costs of compliance across the key BEE scorecard elements: ownership, skills development, enterprise and supplier development, management control, and socio-economic development.
According to the report, the annual cost of BEE compliance is between R145 billion and R290bn per year. It claimed that this has resulted in an annual reduction of 1.5% to 3% in economic growth, and to an annual loss of between 96 000 and 192 000 jobs.
'Our findings show that BEE, as currently designed, is enriching a small elite while throttling economic dynamism and deepening unemployment,' said Dr Morné Malan, FMF senior associate and co-author of the report, speaking at the joint press conference.
The study compares South Africa's model with global 'affirmative action' policies in Malaysia, India, Brazil, the US, and Namibia, showing that South Africa's version is the most intrusive and economically damaging.
At the media briefing, the organisations claimed that B-BBEE benefits largely captured by politically-connected elites as South Africa now ranks 139th in GDP per capita, down from 87th in 1994.
Executives of both organisations said the people most affected by the current economic programme are people that work poor people and those that are beneficiaries are the elite.
"That is why we will engage with Cosatu trade unions Numsa and others to find alternatives to the current racial legislation," said Theuns du Buisson, economic researcher at the Solidarity Research Institute, and co-author of the report.
"In the second place we will continue to litigate and in the third place we will also put pressure on SA via the international world and continue to put pressure on South Africa with the outside world especially the G20 that comes."
However, Cosatu's Parliamentary spokesperson Matthew Parks said the report provided no breakdown backed up by actual research as to any financial burden to the state nor how B-BBEE has been an obstacle to growing the economy and reducing unemployment.
Parks said the report strangely cited statistics related to real and potential growth overall, but no evidence of the relationship between those and B-BBEE. He said it may as well have blamed constitutional democracy for South Africa's economic challenges.
"No reference is made to the need to overcome our still prevalent racial divides as evidenced by countless employment equity studies confirming that most senior positions in the private sector are held by White males or that economic ownership, including shares on the JSE remain largely White-held," Parks said.
Johann Rossouw, an economist at Altitude Wealth, said a more sensible empowerment model as an alternative to B-BBEE policies was Black Economic Skills Transfer (BEST), which would help with job creation and carry the economy into the future.
"At the moment all the arguments are about how many ways to cut the existing pie instead of growing the pie that we have for the future. Black empowerment is not a policy of the government of national unity," Rossouw said, commending that the study was evidence based and drew comparison with other countries.
"It is important that the GNU makes its own policies that will benefit the average poor."
However, independent economist Duma Gqubule said the study and the report was fake news on steroids, which lacked the fundamental understanding of the objectives of transformation.
Gqubule said the report lacked empirical evidence and was premised on companies counting upskilling workers for an example as a transformation contribution when both the worker and the company benefited from the exercise.
"I would call on black business to come up with a coherent response to this. It is a dangerous agenda. We need another citizen dialogue on black empowerment for the new circumstances as the situation in the 1990s when the policies were crafted were critical," Gqubule said.

Expert calls for post-mining strategy as global investment interest in South Africa's mining sector continues to fall. It is time for South Africa to develop a post-mining economic activities strategy, as the sector's international investment attractiveness is declining. This is the view of mining expert David van Wyk, who was reacting to the latest annual survey of mining companies from the authoritative Canadian Fraser Institute, stating that out of 82 investable mining jurisdictions, the country is rated at 68. The attractiveness index is a combination of perceptions of mineral potential, where the region's geology encourages exploration investment and perceptions of mining policy. Expert calls for post-mining strategy The report stated that investors were concerned about the country's political stability, socioeconomic agreements and its geological database. Be that as it may, Van Wyk believes that the country's mining policies did not cause the decline. 'We need to repurpose and reengineer the mines for post-mining economic activities,' he said. 'Minerals are not renewable; mining is therefore not sustainable. We should be looking at planning towards diversification and the evolution of a post-mining economy.' Mining not sustainable Van Wyk said some of the biggest mining firms had registered huge profits because mining was not sustainable. He said the country's mining police was not the main thing driving potential investors away. However, DA spokesperson on mineral and petroleum resources James Lorimer shared the same view as the study and said the current mining policy was not creating a favourable condition for the investors. Lorimer said despite the mining investors' negative perception, Mineral and Petroleum Resources Minister Gwede Mantashe continues with his plans to introduce an amendment Bill that is unpopular with mining companies. 'The DA will be submitting public comments on the draft mineral resource amendment to fight back against over-regulation, excessive ministerial power and disastrous B-BBEE [broad-based black economic empowerment] regulation. Lorimer said South Africa needed investment-friendly mining legislation and regulation that would involve a wholesale rewriting of mining law and the abolishment of the effect of B-BBEE on the sector, to facilitate investment in the sector. Need for international investors National Association of Artisanal Miners spokesperson Zethu Hlatshwayo said as there was a need for international investors, it was also essential to give local mining companies a chance to venture into the industry. Hlatshwayo said small-scale miners could play a vital role in growing the country's economy.

ANC defends B-BBEE as DA pushes to dismantle empowerment policies
African National Congress (ANC) stands firm in defending B-BBEE policies, highlighting their role in empowering millions and urging beneficiaries to protect transformation gains against the DA's push to dismantle these initiatives. Image: IOL / Independent Newspapers The African National Congress (ANC) has accused the Democratic Alliance (DA) of seeking to dismantle South Africa's transformation policies, which the ANC says have brought tangible change to the lives of the majority. The party has called on all beneficiaries of Broad-Based Black Economic Empowerment (B-BBEE) to defend the gains made under democracy. This comes after the DA announced a set of reform proposals aimed at empowering state-owned entities (SOEs), which it claims offer a better alternative to B-BBEE, employment equity, and the Expropriation Act, policies the party insists must be scrapped. Speaking at a media briefing in Johannesburg, DA leader John Steenhuisen said the three laws are major obstacles to economic growth. 'BBBEE and racial quotas have failed, and together with expropriation without compensation, create an environment that deters investment, growth and job creation for the majority of South Africans,' he said. Steenhuisen added that the DA is not against transformation, but argued that current empowerment policies have failed ordinary South Africans. 'These policies are simply not fair. They don't help the millions of South Africans who just need the government to get out of the way. These policies must go,' he said. He called for the replacement of B-BBEE and employment equity with measures based on need and merit. In response, the ANC said that transformation policies must be continuously evaluated and discussed by all South Africans to ensure they remain aligned with the goals of democracy, social justice, and equality, as outlined in the Constitution. 'The ANC recognises that these conversations and debates must be held among all South Africans, particularly to address concerns that such policies may be unintentionally creating a new form of elitism,' said ANC spokesperson Mhlengi Bhengu-Motsiri. 'To effectively tackle any unintended consequences, the ANC believes that the discussion must be guided by scientific findings.' The ANC said it supports the BEE Commission's call for focused evaluation studies to assess the impact of B-BBEE, stating that such research will help ensure the policy achieves its intended purpose of building a more equitable society. The party highlighted the recent findings of the 2023–2024 Analysis of Major B-BBEE Transactions report, which it says confirms that B-BBEE is delivering measurable benefits to ordinary South Africans. According to the ANC, companies invested R7.2 billion in enterprise development, enabling thousands of black-owned and managed small businesses and cooperatives to grow. Supplier development reached R40.7 billion, while R64 billion was spent on skills development, with a focus on young people, women, and rural learners. Bhengu-Motsiri said B-BBEE is rooted in the democratic framework and is designed to benefit 'black South Africans, that is Africans, Coloureds and Indians, and further extends benefits to white women, who were also historically marginalised in economic participation.' 'These empowerment measures have opened pathways for millions of South Africans into business ownership, corporate leadership, and skilled employment,' she said. 'We call on all South Africans who have benefitted from these measures, including those appointed to various positions in the private sector, to stand in defence of their own gains and reject any political agenda aimed at reversing the progress made.' As the leader of society, the ANC added that it will continue to evaluate all transformation policies to ensure they serve their intended purpose. 'Where these policies are found not to benefit those who were previously oppressed and marginalised, they will be reviewed and strengthened,' the party said. Will DA suffer because of its B-BBEE stance?
While the DA might not lose support with its stance on B-BBEE, it's unlikely to gain votes either Despite suggestions that the DA will lose black voters because of its stance on broad-based black economic empowerment (B-BBEE), analysts believe this may not be the case. On Monday, the DA revealed its plan to reform South Africa's economy. Part of the plan is scrapping B-BBEE, the Employment Equity Act and the Expropriation Act. Will black voters support DA? The DA's stance on these laws led to speculation on whether it will continue to receive support from black voters. Political analyst Professor Ntsikelelo Breakfast believes that the party will not suffer huge blows because of their policy positions. 'There is nothing new in terms of their line of argument in line with their policies. My prediction is that their electoral performance will not be affected. 'But I am also not implying that they will have an upward trajectory, nor do I think that they will have a downward electoral trajectory. I think it will stay the same,' he said. He also said it is unlikely to lose more black party members. He said the party has rooted itself in not seeing colour as part of its tradition. 'There is nothing new with what the DA is saying. Those that have issues have left, I therefore cannot say there will be an exodus of black people in the party,' he said. Breakfast said even though some black people in the party have issues with the party's position of not seeing colour when it comes to crafting its policies, some chose to remain silent. 'There have been black people who have been content about the policy direction of the party. Many of those who constituted the black caucus of the party, like Mmusi Maimane, they left because of the policy direction,' he said. Discontent from black DA leaders Breakfast said some of those who are unhappy with the DA's view of not seeing race believe that the party is ignoring the social injustices of the past. He said those that remain in the party do so with full knowledge of what the party stands for. 'Those guys that remain, they will not question Helen Zille. You know what happens when you question. You are kicked out and sometimes there is propaganda machinery against you, your career dies a natural death on the spot, so the guys that are holding position, they will not question this B-BBEE thing because they know what happens,' he said. Following Mmusi Maimane's departure as party leader, the party has returned to its core constituency, according to Breakfast. 'Helen Zille thought that having Mmusi Maimane as party leader, they might take strategic advantage of the failures of the ANC. But Tony Leon then said this is a project gone wrong and that is when they said now let us go back to our core constituency,' he said. What is the problem with B-BBEE? Another political analyst, Theo Neethling, believes there is nothing wrong with the principle of B-BBEE. However, he said over the years implementation of this policy has led to problems. 'I think if it is well-defined, it won't be a problem. It should not lead to overboard enrichment of a few well-connected elites. 'Some entrepreneurs and well-connected politicians and those connected to certain parties or role players became stinky rich. 'So, if the DA can explain and clarify this well, I don't see a problem. It should never be about making millions and sheer material benefits but about empowerment of as many as possible,' he said. 'The recently released 2023–2024 analysis of major B-BBEE transactions report confirms that B-BBEE continues to deliver measurable benefits to ordinary South Africans, workers, small enterprises, and communities, who were historically excluded from economic participation. 'Over the reporting period, companies invested R7.2 billion in enterprise development, enabling thousands of black-owned and managed small businesses and cooperatives to expand and thrive. 'Supplier development commitments reached R40.7 billion, giving black suppliers significant access to value chains across multiple industries,' said the party.
