
‘Long wait nothing but mental torture': Alliance Air directed to pay Rs 50,000 to consumer for six-hour delay
'The passengers were de-boarded, but no provision was made even to give the passengers water… (or a) meal. The long wait… for departure is nothing but mental torture, especially when passengers had to reach by 9.30 am. There was deficiency of service (from Alliance Air Aviation Limited)…,' said the Southwest District Consumer Disputes Redressal Commission in an order dated July 7.
Mainawati Devi, the complainant in this case, had alleged that in June 2022, she was to board a flight from New Delhi to Uttar Pradesh's Gorakhpur from Terminal 3, Indira Gandhi International Airport, New Delhi, to attend an 'urgent religious ceremony'.
Devi was at the airport by 8 am and cleared all pre-boarding formalities by 10 am. The boarding gates were opened only at noon.
As per Devi, when they boarded the flight, the air conditioning wasn't working, and no refreshment was offered to them despite them waiting for hours. They were then made to de-board the plane 'without any reason being given'.
For the next four hours, the passengers were told nothing. Finally, close to five hours after the scheduled takeoff, the passengers were again asked to board the flight, which took off at 5.30 pm.
'The question is whether the delay is for a reason beyond the control of OP, like bad weather, want of clearance from ATC, poor visibility, dense fog, etc. There is nothing on record that the delay was on account of reasons beyond the control of OP. The delay is of near about 6 hours. The information on the delay was not provided to passengers, including the complainants. There is negligence on the part of the OP in maintaining the aircraft as an engineering snag was allegedly detected,' the Commission added.
It directed the airlines to pay Rs 50,000 for mental harassment, agony, and litigation expenses within 45 days of passing the order.

Delhi HC slaps Rs 10 lakh cost on litigant for filing pleas to extort money
Agency: New Delhi, Aug 19 (PTI) The Delhi High Court has expressed shock and imposed Rs 10 lakh cost on a man for filing pleas alleging illegal constructions in the capital with the aid of his lawyer and motive to extort money. Justice Mini Pushkarna said it was dealing with cases of unauthorised constructions 'strictly with an iron hand", but had to also ensure the process of the court was not misused by anyone to extort money from the persons involved in such constructions. The court, therefore, pulled up petitioner Anil Lodhi, General Secretary of Azad Market RWA, who was found involved in cases of impersonation and extortion. The court went on to refer to the Bar Council of Delhi, the name of advocate Babu Lal Gupta, who was involved with a purported NGO named Green Gold Earth of World, to consider his conduct and assess if there were any violations of the applicable rules and regulations in relation to the matter and take requisite action. 'This court also takes note of the submission made by counsel appearing for the private respondents that Anil Lodhi, General Secretary of Azad Market RWA, has been approaching their clients for the purpose of extorting money from them. These facts are alarming and shocking, which disclose the deplorable conduct of the petitioner in filing cases for extorting money from people, by misusing and abusing the process of this court," the court said in its August 7 order. The order was directed to be tagged with all future petitions, which Lodhi or the NGO affiliated to him, could file in future. The proceeding before a court, the order said, was a 'solemn process" for furthering the cause of justice, and not for aiding unlawful objectives of certain individuals. The court noted many of Lodhi's cases were filed through the same lawyer and the address given for the NGO in which Lodhi claimed to be a trustee, was of the lawyer's chamber allotted to Gupta. The court was hearing the petitions filed by Azad Market RWA, through Lodhi, seeking directions to the authorities to take action against the illegal and unauthorised constructions in certain shops situated at Roshanara Road and Rani Jhansi Road, Jhandewalan, along with action against misuse of electricity and drinking water. The court was informed that the MCD had already initiated requisite action against them. The MCD was further directed to take action in a time bound manner in case of any illegality. The order observed the alleged illegal construction was not in the vicinity of the petitioner's neighbourhood. The petitioner was found to have filed similar pleas against illegal encroachment in the past, including through the NGO. The court referred to a report of the Registrar of Societies and said the NGO was not registered. The litigant was said to have misused the court process under the garb of social work with oblique motives and moving the court with 'unclean hands". Four armed criminals arrested in J'khand's Palamu
Agency: Last Updated: Medininagar (Jharkhand), Aug 19 (PTI) Four armed criminals were arrested in Jharkhand's Palamu district, police said on Tuesday. They were picked up from Pokhrah under Sadar police station area on Monday night. Two pistols, including one Australian-made, 50 live cartridges, four mobile phones, three motorcycles and Rs 22,000 cash were recovered from their possession, they said. Additional Superintendent of Police (ASP) Rakesh Singh said the criminals belong to one Rahul Singh gang from Latehar district, who had provided them with the weapons. The accused were identified as Sahzad Alam (30), Rohit Kumar (24), Farhan Qureshi (24) and Sahil Kumar (23). Bombay HC quashes FIR against HDFC Bank chief Jagdishan in Lilavati Trust case
MUMBAI: In a big relief to HDFC Bank chief executive Sashidhar Jagdishan, which came after many adjournments since early June as four high court judges recused themselves from hearing the case, the Bombay High Court has quashed and set aside an order passed by a judicial magistrate to register an FIR against him following a private complaint filed on the behalf of the Lilavati Kirtilal Mehta Medical Trust, which runs the Lilavati Hospital in Mumbai. The Trust accused Jagdishan of accepting a bribe of Rs 2.05 crore from an ex-trustee Chetan Mehta, for giving him financial advice and helping him to retain control over the trust's governance. The bank and Jadishan in turn said the case is fabricated as Mehata and his private company owes money to the bank and he moved the court only after the bank began recovery proceedings. Mehta further accused Jagdishan of interfering in the internal affairs of the trust by misusing his position as the head of HDFC Bank. Setting aside the lower court order for registering an FIR against the head of the second largest bank, justice Shriram Modak noted in his August 5 order (which was uploaded on the court website only on Monday), that the magistrate at the Girgaon court had issued a notice to Jagdishan without verifying the complaint and also the witnesses and even before taking cognizance of the said complaint. The FIR was ordered to be registered on May 29. Following which both Jagdishan and the bank moved the high court early June but could not take up the issue as the first judge assigned the job recused and so did the second judge. Following this Jagdishan moved the supreme court for an urgent hearing on July 2 and on July 4, the a two-judge bench of the apex refused to hear him saying the matter is pending in the HC. But again two more judges recused in the course of July and finally the case was heard on August to accept the trust's contention, as advanced by senior advocate Aabad Ponda that the provisions to section 223 of the Bharatiya Nagarik Suraksha Sanhita justify the magistrate in issuing notice to the accused, before taking cognisance of the complaint, the court said the magistrate should have first verified the complaint pertaining to defamation, before issuing notice to the proposed accused. And that under the existing law, until the verification is recorded, the stage of hearing of the accused will not come. "There is a purpose of recording the verification. It gives an opportunity to the magistrate to ascertain whether to proceed further or not," Justice Modak said granting relief to Jagdishan, the court set aside an order passed by a judicial magistrate issuing notice to him in the private complaint lodged against him by the Lilavati Trust.
