Excess fare: warrants issued against MD of TNSTC, Coimbatore, and RTO, Coimbatore North

The District Consumer Disputes Redressal Commission, Coimbatore, has issued warrants against the Managing Director, Tamil Nadu State Transport Corporation, Coimbatore, and the Regional Transport officer, Coimbatore North, for failure to comply with an order passed on February 15, 2018, in a case of collection of excess fare lodged by Coimbatore Consumer Cause.
An execution petition filed by K. Kathirmathiyon, secretary, Coimbatore Consumer Cause, during November 2023, cited the dismissal of an appeal made against the order by the State Consumer Commission and also a review petition in 2023.
During 2018, three years after he had filed a case before the District Consumer Disputes Redressal Forum, Coimbatore, the complainant was refunded the excess fare of ₹6 charged from him for to and fro travel between Vadavalli and Railway Station, along with ₹6,500 towards legal expenses.
The petitioner had called for deposit of the excess fare collected during the three-year period in the Chief Minister Relief Fund.
The TNSTC, Coimbatore, and the Regional Transport Officer, Coimbatore North, had paid the costs and the TNSTC, Coimbatore, had also deposited the fine of ₹ 10,000 along with interest at 9% for three years amounting to ₹ 7,532 to the Chief Minister's Public Relief Fund.
A copy of the order was sent to the Chief Secretary and to the Transport Commissioner of Tamilnadu Government to stop such excess collection.
However, the TNSTC had claimed that the details of collection from 2015 to 2018 had been destroyed, and, hence, could not file the statement of excess collection.
The Hon'ble Commission had, in its verdict cited the Government Rule mandating all the State Transport Corporations to preserve money value documents at least for a minimum period of 8 years as stipulated in the Companies Act 1956. The TNSTC, Coimbatore, had violated the Rule and the order of this Commission, Mr. Kathirmathiyon had contended in his executive petition.
The bailable warrants were issued under Section 72 of Consumer Protection Act 2019.

TENKASI: The state-level executive committee meeting of the Tamil Nadu State Transport Corporation (TNSTC) Workers' Federation, convened in Shengottai of the district on Saturday, expressed dissatisfaction with the manner in which the recent talks for the 15th wage revision agreement were held. In the meeting chaired by federation president R Ashokan in the presence of general secretary R Radhakrishnan, members criticised the conduct of the final round of negotiations for the 15th wage revision agreement, which was held in Chennai in the presence of Minister for Transport S S Sivasankar. The committee alleged that the minister had unusually convened a separate meeting with representatives of the DMK-affiliated association and CITU ahead of the negotiations, and called it an unfair practice. While the agreement is said to have been implemented with effect from September 1, 2023, the payment of arrears has been scheduled only from September 1, 2024. As a result, workers have lost a year's worth of arrears.

1 2 3 Madurai: Expressing serious concern at the authorities of Tamil Nadu State Transport Corporation (TNSTC) adopting unfair labour practices by harassing a driver who approached the inspector of labour and court seeking conferment of permanent status, Madras high court has directed the corporation to pay a compensation of 25,000 to the driver. The court was hearing the petition filed by S Selvaganapathy, who was appointed as a crew driver in 2013. After working continuously for a period of 480 days, the petitioner claimed regularisation as per Section 3(1) of the Tamil Nadu Industrial Establishments (Conferment of Permanent Status to Workmen) Act, 1981. Since his services were not regularised, he filed an application before the inspector of labour. In 2015, the inspector of labour directed the authorities to confer permanent status to the petitioner. The corporation challenged the order in HC; however, the petition was dismissed. The petitioner stated that the then general manager and checking inspector, for their personal vengeance, adopted unfair labour practices against him, even though he was eligible for conferment of permanent status. Hence, he filed the present petition in 2019. Justice B Pugalendhi observed that considering the number of litigations and the manner in which the applications were filed by the corporation, the court is of the view that the authorities adopted unfair labour practices against the petitioner. Since unnecessary litigations were filed even after the orders of the division bench of this court, the court is of the view that the petitioner was victimised. The petitioner made certain allegations against the then general manager and then checking inspector before their retirement. In all fairness, the authorities ought to have considered the same; however, they did not take proper action on the petitioner's representation and allowed them to retire. The judge observed, "The mighty TNSTC is capable of filing a number of petitions including reopening petitions and at the same time, the petitioner suffered due to the conduct of the transport corporation." Hence, in the interest of justice and in view of the decision of the Supreme Court, the judge directed the corporation to pay the compensation to the petitioner for dragging him into unnecessary litigations, within eight weeks. The petition was disposed of.

1 2 Coimbatore: Coimbatore Consumer Cause, a consumer forum, has appealed the chief minister not to consider the proposed shift to monthly electricity billing, stating the same does not offer any benefit to consumers. In a letter to chief minister M K Stalin, the forum said the Tamil Nadu Power Distribution Corporation Ltd was planning to implement monthly billing after replacing static meters with smart meters in all domestic connections across the state. "Whether the billing is done monthly or bi-monthly, domestic consumers pay the same amount for the total number of units consumed. A monthly billing cycle will only increase the burden on consumers. For example, if a domestic consumer uses 800 units over two months, the total bill will be Rs4,770. If the billing is done monthly for 400 units each, the consumer will have to pay Rs2,385 each, which still totals Rs4,770. Hence, not even a paisa is saved by switching to a monthly billing cycle," the fourm said.
