
Court of Appeal strikes out man's appeal for custody of child
PUTRAJAYA : The Court of Appeal today struck out a man's appeal against a High Court order granting his wife sole custody of their four-year-old daughter.
A three-judge panel chaired by Justice Azizah Nawawi made the unanimous decision in favour of the respondent, V Thevitthra, 32, on grounds that the appeal brought by her estranged husband, R Kannan, 38, was procedurally defective.
'This is the court's unanimous decision. There have been multiple non-compliances with the rules. In fact, both the notice of appeal and the record of appeal were filed out of time, and the appellant did not file any application for an extension of time.
'We therefore allow the application for the appeal to be struck out,' said Justice Azizah.
The panel, which included Justices Azmi Ariffin and Alwi Wahab, also ordered Kannan to pay costs of RM10,000 to Thevitthra.
Earlier, counsel R Renuga, representing Thevitthra, submitted that the notice of appeal had been filed three days late, on June 19, 2024.
Renuga also said the appellant had failed to submit his memorandum of appeal within the 90-day timeframe stipulated by the rules of court.
In reply, the appellant's counsel, N Sreedhara, argued that the respondent had not suffered any prejudice from short delay. He said the delay had not resulted in a substantial miscarriage of justice.
'In fact, the respondent, in her affidavit in support of the notice of motion, did not explain what form of substantial miscarriage of justice she suffered as a result of the delay,' he said.
Sreedhara also attempted to explain the delay to the court and maintained that the appeal had merit as it concerned the custody of the child, who was currently in his client's care.
When asked by the bench to whom the High Court had awarded custody, Sreedhara replied that custody was granted to the mother.
Azizah: The High Court gave custody to the father or the mother?
Sreedhara: Custody to the mother.
Azizah: And the father took the child out of the country?
Sreedhara: Yes, before the order.
The Shah Alam High Court granted sole custody of the child, K Krisha, to the respondent on May 17 last year.
In 2023, Thevitthra was granted interim custody of the child, Krisha, amid ongoing divorce proceedings.
The court order allowed Kannan, who lived separately, to meet the girl in a public place twice a month for up to seven hours on each occasion.
During a visit in September 2023, Kannan drove off from a mall in Gurney Drive, Georgetown, Penang, taking the child with him.
Later that evening, Thevitthra received a text message from her husband saying they had 'gone to KL'.
She has not seen her daughter since.

Woman nabbed after reckless driving, knife attack in Kajang

KUALA LUMPUR : Police have arrested a 24-year-old woman suspected of driving recklessly, crashing into three motorcycles, and attacking members of the public at a traffic light intersection in Kajang today. Also seen in the video were several injured motorcyclists and members of the public attempting to detain the woman.

New monitoring mechanisms for EAIC as part of rebranding
The EAIC said its new logo symbolises its sharpness and vigilance in monitoring misconduct. PETALING JAYA : The Enforcement Agency Integrity Commission (EAIC) today said it is introducing new mechanisms to monitor the progress of its probes and enhancing its standard operating procedures (SOPs) for investigations as part of the organisation's rebranding. In a statement, the EAIC said it had conducted studies on the effectiveness of enforcement agencies under its purview and participated in field operations and consultations with stakeholders to better understand the issues faced by the agencies in question. It said the rebranding marked the continuation of reforms which started last year, including the establishment of a special task force to investigate high-profile and public interest cases. Such cases include the illegal disposal of electronic waste (e-waste), abuse of power in the issuance of medical visas, and a study to identify preventive measures for deaths in custody. The EAIC also introduced a new logo, featuring elements of a tiger's eye and claw, meant to symbolise sharpness and vigilance in monitoring misconduct. 'This rebranding aims to clearly communicate the commission's mission to move forward as a leader in improving integrity, transparency, and public trust among enforcement agencies,' it said. The EAIC is a federal statutory body under the Prime Minister's Department, established in 2011 to monitor, investigate, and report on misconduct by personnel from enforcement agencies. It also handles public complaints about misconduct in enforcement agencies such as the police, immigration department, and road transport department.

Police probing Parliament scuffle that left officer injured

Fadil said the case is being investigated under Section 353 of the Penal Code for the use of criminal force to deter a public servant from the discharge of his duty, and Section 427 of the Penal Code for mischief. Section 353 provides for a jail term of up to two years or a fine, while Section 427 provides for a jail term of not less than a year and not more than five years, a fine, or both, upon conviction. In a statement, Fadil referenced a video on TikTok which saw participants of a gathering 'provoking and forcefully breaching' police officers who were on duty during the event at Jalan Parlimen. He said police respected the public's right to express opinions and to assemble peacefully, and were committed to playing their role as a facilitator at such events. '(But) these rights should be exercised responsibly and prudently,' he said. 'Firm action will be taken against individuals or groups who instigate chaos or engage in excessive provocation.' Earlier today, FMT reported that more than 100 plantation workers from Perak, Negeri Sembilan, Selangor, Kedah and Johor marched from Taman Tugu in the capital to Parliament to submit a memorandum on housing and a draft bill making it compulsory for estates to provide homes for local plantation workers. Police blocked the group from gathering at Parliament's gates but later allowed the workers to hand over the documents to deputy law and institutional reform minister M Kulasegaran and opposition chief whip Takiyuddin Hassan.
