NST Leader: Subscription squeeze - Regulating the auto-renewal trap

THERE was a time when entering into a contract was as simple as ABC. The company handed you a contract and you sign off if the terms were acceptable. When you wanted to end the service, you pay the current bill and that was it.
But with competition getting intense, businesses have become creative by inventing the subscription contract that comes with a self-renewal clause, unless terminated with notice. And the auto-renewal clause comes with a termination penalty. As high as RM58,000 for quitting a wellness programme, as one complainant told the National Consumer Complaints Centre (NCCC).
Herein lies a trap. When you try to unsubscribe from the service, it is like searching for a needle in a haystack. If you managed to do so, you end up paying a hefty penalty.
Is this legal? Here, we come face to face with the "on the one hand and on the other hand" argument of lawyers. As a general legal principle, a contract is an agreement between parties. Were the terms made explicit to the consumer? If so, then the consumer's case ends there, except if the penalty is excessive, like the RM58,000 imposed by the wellness company.
In such cases, it is best to proceed to the Tribunal for Consumer Claims. Vigilance is the key. But being vigilant isn't easy in a business environment where companies push the concept of consent to the edge of the law.
Complaints to the NCCC tell us that the subscription contracts need regulatory intervention. Not that Malaysia doesn't have laws. It has several, but unlike the United Kingdom, not specific to subscription contracts.
Do we need one? Certainly, but first, let's look at what we already have. The Contracts Act 1950 (CA) is one of several. Subscription agreements are contracts, they clearly fall under it. The CA makes consent of the parties a critical element.
Another, and perhaps more relevant, is the Consumer Protection Act (1999), which specifically addresses unfair contract terms. Astronomical penalties, either made known or hidden, are likely to be treated as such. So will deceptive auto-renewals.
Finally, the Communications and Multimedia Act 1998 (CMA). Interestingly, the CMA imposes a duty to act reasonably on all service providers. If the auto-renewals and penalties are not made known to and agreed by the consumer, then the service providers could be found to have failed in their duty to act reasonably.
A point needs to be made, though. Despite scores of complaints to the NCCC, there has been no litigation on such issues. Neither have the regulators acted on the complaints, Perhaps, they are waiting for the consumers to lodge a report with them.
A report from the consumer shouldn't be the only way for regulators and enforcement agencies to act. Even the police are using viral videos to launch their investigations. The regulators must go where the complaints are: consumer associations, NCCC and media reports.
Malaysia needs a specific law such as the UK's Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Proper consent of the consumer, together with a cooling-off period of 14 days, is a pillar of these regulations.

KUALA LUMPUR: The Summit Hotel Subang USJ will undergo a major refurbishment and rebranding exercise costing up to RM45 million, following the appointment of Exsim Hospitality Bhd's unit as the new hotel operator and project manager. In a filing with Bursa Malaysia, Exsim Hospitality said its wholly owned subsidiary Mana Mana Holdings Sdn Bhd accepted the letter of offer from Maybank Trustees Bhd, acting on behalf of AmFIRST Real Estate Investment Trust, on Aug 6. The refurbishment works are expected to be completed and the hotel re-opened within 15 months, subject to mutually agreed adjustments. "The board, after having considered all aspects of the letter of offer, is of the opinion that the appointment is within the ordinary course of business of Exsim Hospitality and the acceptance is in the best interest of the company," it said. It added Mana Mana will receive a RM220,000 fee for its role as project manager and will enter into a tenancy agreement with the landlord. Under the agreement, the company will pay a base rent of RM600,000 per month, plus additional rent based on revenue sharing above a defined threshold. The tenancy will be effective for an initial term of three years, with automatic renewals for two further three-year periods unless terminated in advance. Exsim Hospitality said the appointment is expected to contribute positively to its net assets, earnings per share and gearing.

MIRI (Aug 6): Contractors who complete their projects within the stipulated time frame or ahead of schedule deserve to be considered for future tenders, said Dato Sri Lee Kim Shin. The Transport Minister stressed that the same consideration should not be extended to contractors whose performance is poor with delayed projects or quality that falls short of expectations. 'There have been cases where projects faced serious delays and cost overruns due to the failure of contractors. In such situations, we have had to appoint 'rescue contractors' to complete the works, which leads to further expenses,' he told reporters after visiting several project sites under Senadin constituency here today. Lee said it is important for Miri City Council (MCC) to have a clear evaluation system, whereby contractors with proven track records are prioritised for future tenders, while those with poor performance must improve their standards to remain competitive. He cited the example of the Sungai Dalam Road upgrading project, which was completed ahead of schedule. 'The RM300,000 project began on June 9, 2025 and was completed on July 28, compared to its scheduled completion date of Aug 8, this year. The original four-metre-wide road in this suburban area has now been widened, and two other roads in the vicinity have also been upgraded and completed early. 'During my visit, residents expressed satisfaction with the quality of work done by the contractor,' he said. KUALA LUMPUR: Unchecked urbanisation could 'hollow out' city centres and push out low-income residents due to market pressure, says Minister in the Prime Minister's Department (Federal Territories), Dr Zaliha Mustafa ( pic ). She warned that failure to address this issue will worsen economic inequality and mobility, creating a city only for the rich and eroding the city's social character. Dr Zaliha made these remarks in her opening speech at the groundbreaking ceremony of Residensi Aman Madani, officiated by Prime Minister Datuk Seri Anwar Ibrahim in Bandar Sri Permaisuri on Wednesday (Aug 6). Also present was Bandar Tun Razak MP Datuk Seri Dr Wan Azizah Wan Ismail, who is also the Prime Minister's wife. 'In the Federal Territories, we have targeted 80,000 affordable units by 2028. As of today, we have achieved 73,200 units — or 91.5% of the target — comprising completed homes, homes under construction, and those with approved development orders." She noted that Kuala Lumpur, home to nearly two million people in just 240 square kilometres, now has a population density exceeding 8,100 people per square kilometre. 'Behind this rising number, however, lies a growing spatial gap between the city centre and its residents. 'This spatial inequality forces key city workers — public servants, technicians, nurses, small traders, and more — to live far from their workplaces, commuting two to three hours daily. This affects the cost of living, productivity, and ultimately, their family well-being.' She added that as urban housing becomes increasingly unaffordable to middle- and lower-income groups, the city risks losing fair wealth distribution. 'Residensi Aman Madani is part of this initiative — offering 3,500 housing units, each 900 square feet. Despite a gross development value of RM1 billion, each unit is sold at only RM300,000 — made possible through strategic cooperation between the government, local authorities, and developers. 'This project is strategically located near hospitals, schools, and the upcoming MRT3 line. It will reduce commute times, giving families more quality time. Parents can send their children to nearby schools and return home earlier, without having to commute daily from Semenyih, Rawang, or Nilai.' She emphasised that Kuala Lumpur should no longer be a city exclusive to the affluent. 'We envision a unifying city, not a divisive one. But even in our push for affordable housing, I've stressed to the Federal Territories Department and Kuala Lumpur City Hall (DBKL) that all projects must meet quality standards, ensure access to utilities, healthcare, education, and include well-designed public spaces.' Dr Zaliha said Residensi Aman Madani also incorporates hawker stalls for micro-entrepreneurs, rainwater harvesting systems, and solar panel installations — making it one of the most sustainable housing projects aligned with the ministry's 'CHASE City' vision. CHASE City, which stands for Clean, Healthy, Advanced, Safe and Eco-Friendly, is an urban transformation plan under the Federal Territories Department launched earlier this year.
