The duty is to select and appoint judges of integrity and ability with appropriate training or qualifications in law, without improper motives and discrimination.

The basic principles do not also impose a duty on member states, including Malaysia, to select and appoint judges based on seniority to lead the judiciary.
Accordingly, seniority is not a requirement for the position of Chief Justice (CJ), President of the Court of Appeal (PCA), and Chief Judges of the High Court of Malaya (CJM) and Sabah and Sarawak (CJSS).
Seniority is not a requirement under the basic principles and, importantly, under the Federal Constitution.
Let's be clear that the Federal Constitution does not specify requirements for a superior court judge to become CJ, PCA, CJM and CJSS.
Article 123 of the Federal Constitution only states that to serve as a judge of the superior courts, a person must be a Malaysian citizen with at least 10 years of experience as a lawyer or lower court judge.
So let's welcome and celebrate the announced appointees for the top offices of the judiciary.
After months of uncertainty and speculations, Malaysians must move forward with the judiciary under its new leadership.

Youth leaders over 30 may stay in office until next election, but not be renominated, says Hannah Yeoh
KUALA LUMPUR, July 22 — Youth leaders who exceed the age of 30 after the youth age limit takes effect on Jan 1, 2026 may continue to hold their positions until their organisation's next election at the general meeting, said Youth and Sports Minister Hannah Yeoh. However, Hannah said these leaders cannot be renominated, as stipulated under Section 6 of the Youth Societies and Youth Development (Amendment) Act 2019 (Act A1602). 'For youth members, starting from Jan 1, 2026, in line with the amendment to Act 668 through Act A1602, ordinary members who do not hold office in youth organisations and have reached or exceeded the age of 30 will no longer be eligible as ordinary members. They will also lose their right to vote or be elected at annual general meetings. 'However, they can still be involved as advisors, mentors, facilitators, mobilisers, youth workers, or alumni, subject to the organisation's constitution. In this regard, the Ministry of Youth and Sports (KBS) has engaged with the Registrar of Societies (ROS) to facilitate the transition for youth organisations, office bearers, or members who reach the age of 30 to join other associations registered under ROS,' she said during a question-and-answer session in the Dewan Rakyat today. She was responding to a supplementary question from Dr Kelvin Yii (PH-Bandar Kuching), who asked what would happen if youth leaders exceeded the age of 30 after the law comes into force on Jan 1, 2026. In response to Yii's original question, Hannah said KBS has taken several initiatives to ease the transition of the youth age limit from 40 to 30 years old. She said these include the formation of a Transition Working Committee chaired by Deputy Youth and Sports Minister Adam Adli Abdul Halim, the implementation of Bicara Transisi Belia (Youth Transition Dialogues), Governance Workshops, Organisational Management Programmes (PPO), the Kembara Jumpa Orang Muda Programme (Kembara JOM) and the certification of youth work professionalism. According to her, the Department of Statistics Malaysia data shows there are 9.5 million youths aged 15 to 30, making up 27.9 per cent of the national population, while the number of office bearers in youth organisations this year stands at 99,271, with 53.99 per cent (or 53,606 individuals) under the age of 30. 'The enforcement of the Youth Societies and Youth Development (Amendment) Act 2019 will affect the administration and leadership of 8,272 youth organisations registered with the Registrar of Youth Societies (ROY),' she said. Yii had asked what steps the ministry has taken to ensure a smooth transition for the enforcement of Act A1602 on Jan 1, 2026, and how many youth organisations have amended their constitutions in preparation. — Bernama

Kota Iskandar showdown brews as Amanah challenges Umno in Johor state polls
JOHOR BAHRU, July 22 — The Iskandar Puteri Umno division is prepared to take on Parti Amanah Negara (Amanah) following the latter's intention to stake their claim on the Kota Iskandar state seat for the upcoming state election. Iskandar Puteri Umno information chief Datuk Abdul Aziz Sapian said the division is geared to contest against Amanah, irrespective of whether it's a straight fight or multiple cornered contest in Kota Iskandar. He said the Iskandar Puteri Umno division will not be intimidated by any political manoeuvring made by Amanah or their allies in Pakatan Harapan (PH). 'We are ready to face any form of challenge. 'If Amanah chooses to split votes among themselves, Umno sees this as evidence of PH's weakness in failing to manage internal issues. 'The people will judge who is sincerely looking after their interests and who is simply pursuing power,' he said in a statement today. Abdul Aziz was responding to an earlier statement by Iskandar Puteri Amanah division that laid claim on both Kota Iskandar and Skudai for PH. The former two-term Nusajaya assemblyman (prior to renaming to Kota Iskandar in 2018), said Umno respects the right of any political party to contest and determine their candidate in any seat. However, he explained that Umno determines its candidates and strategies based on the people's priorities, the strength of its grassroots and the need to ensure political stability for the continued development of Johor. 'For Umno, all negotiations and decisions on seat distribution are the prerogative of the party and coalition's highest leadership,' he said, adding that the final decision is not based on the wishes of Umno members at divisional levels. Abdul Aziz said Umno remains committed to strengthening Johor's political stability, especially in the strategic area of Kota Iskandar where where continued development and public well-being are priorities. 'As the Barisan Nasional (BN) elected representative, represented by Umno, in Kota Iskandar, we will continue to serve until the term ends without being distracted by Amanah's political rhetoric. 'Rest assured that the Iskandar Puteri Umno division will continue to ensure that the area remains under a credible and stable leadership that serves the people, and not just a slogan,' he said. Earlier, the Iskandar Puteri Amanah division declared it is prepared for PH to contest solo in Skudai and Kota Iskandar, setting up a possible clash with BN that is incumbent in the latter seat. Its division chief Dzulkefly Ahmad said PH's official decision to contest in both of the state constituencies under the Iskandar Puteri federal seat was the result of the party division's annual general meeting on Sunday. Dzulkefly, who is also Johor Amanah deputy chairman, said the party is prepared for any outcome, including a three-cornered contest, if necessary, by bringing the people's agenda of unity, institutional reform and sustainable development. Kota Iskandar is a highly coveted seat as it is also the location for Johor's administrative capital with the same name. The state constituency was helmed by PH under Amanah after the watershed 2018 general elections. However, PH lost the seat to BN in the 2022 state election, where Umno maintains a strong presence. Skudai has traditionally been under PH and is a known DAP stronghold since 2008. Both state constituencies make up the Iskandar Puteri federal constituency.

(Bernama pic) PETALING JAYA : Malaysia's halal certification standards are among the non-negotiable issues in ongoing tariff negotiations with Washington, says investment, trade and industry minister Tengku Zafrul Aziz. He said if the US wanted to have its halal certification recognised, it must comply with the guidelines set by the Islamic development department (Jakim), Berita Harian reported. 'The guidelines we've drawn up reflect lessons from past experiences,' he told the Dewan Rakyat during question time. 'If their halal standards are in line with Jakim's requirements, and the process is consistent with what we accept from other countries, then we can agree (to it), but Jakim must recognise it.' Tengku Zafrul was responding to a question from Syahir Sulaiman (PN-Bachok), who asked about the clear boundaries or 'red lines' Prime Minister Anwar Ibrahim recently said would not be crossed during the negotiations. The Office of the US Trade Representative (USTR) previously cited Malaysia's halal import rules and Bumiputera equity requirements as barriers leading to the 24% tariff initially imposed on April 2. In its 2025 National Trade Estimate Report on Foreign Trade Barriers, the USTR said Malaysia's halal standards exceeded international norms, requiring dedicated halal-only facilities and involving complex registration processes, which raised costs and delayed exports. Tengku Zafrul also said Malaysia's negotiation approach would be shaped by past experiences, taking into account both local sensitivities and US concerns. He emphasised that the government remains open to fair and constructive dialogue, but certain matters were not up for compromise. 'These include the Bumiputera policy in terms of local ownership and participation in strategic sectors, as well as the preference for local and Bumiputera companies in government procurement. Those are red lines,' he added. Tengku Zafrul reiterated that Malaysia would not yield on matters of trade sovereignty, national interest, or socioeconomic policy, whether in talks with the US or with multinational corporations. 'All of this is to protect Bumiputera interests and ensure balanced national economic development,' he added.
