Puncak Borneo MP urges Sarawak cultural associations to unite

KUCHING (Aug 10): Puncak Borneo MP Datuk Willie Mongin has called on Sarawak's cultural associations to work together and support one another.
Willie said such cooperation would strengthen unity among the state's diverse communities.
'All cultural associations in Sarawak must work together and help each other. There is no room for conflict, because ultimately, we will be the ones to suffer the consequences.
'Far-sighted individuals who share information and accept the need to collaborate are the hallmarks of successful communities and people,' he said when speaking at the Ngarom Bisamah 2025 dinner at the Dayak Bidayuh National Association (DBNA) multi-purpose hall here last night, organised by Persatuan Segu Bunuk Penrissen (PSBP).
Willie emphasised the importance of sustaining association activities beyond their formative years.
In that spirit, he urged associations like PSBP to assist smaller or less active cultural-based associations to ensure their objectives and continuity are preserved.
'I don't want to see our association display the 'hangat-hangat tahi ayam' spirit, where we are enthusiastic at the start, but that fades and eventually sinks over time.
'We must keep moving forward together and helping each other,' he said.
Willie also reminded that various forms of assistance and facilities are available from both the Sarawak and federal governments for cultural associations such as PSBP.
He cited the Sejati Madani programme, an initiative aimed at stimulating economic activities at the community level and increasing income by providing funds ranging from RM50,000 to RM100,000 to deserving communities.
'Don't just watch from the sidelines. Seize the opportunities available to help your community,' he added.

Judge in Sarawak DAP chief's defamation case ordered to produce judgment

KUCHING: The Court of Appeal has ordered the trial judge in the defamation trial of Stampin MP and Sarawak DAP chairman Chong Chieng Jen to provide the written grounds of judgment within one month from today. This is to enable the hearing of Chong's appeal to be heard. The hearing of the appeal today had to be postponed as the written judgment was not available. "As directed by the Court of Appeal, my lawyers will also be writing to the Chief Judge of Sabah and Sarawak on this matter," Chong said. He hoped to receive the grounds of judgment soon for the appeal to proceed. Chong said the trial had concluded four years ago and "yet there is still no grounds of judgment from the trial judge". In 2012, Chong criticised the state's budget, pointing to what he described as a recurring line item titled "government's contribution towards government-approved agencies trust fund". He argued that this allocation acted as a "black hole" since it lacked transparency as substantial sums in billions of ringgit were transferred without disclosure of the actual recipients or their uses. In 2013, the then Sarawak government and State Financial Authority (SFA) filed a defamation lawsuit against him following his published claims, including in leaflets and news outlets, that RM11 billion in public funds had gone into this "black hole". The suit was filed in the Kuching High Court, and the trial started on Jan 7, 2021. On August 30, 2022, the judge ruled in favour of the state government, determining that Chong's "black hole" remark was defamatory, and that his defences — justification, fair comment, and qualified privilege — did not hold. The judge ordered Chong to pay RM150,000 in damages and RM50,000 in legal costs, and issued an injunction preventing him from repeating the statement. Chong said the trial judge then did not provide the grounds of judgment. "After almost three years from the decision of the High Court judge, or four years after the conclusion of the trial, the judge has not provided the grounds of his judgment. "Over the years, we have written five times to the High Court to request the grounds of judgment, but all to no avail," Chong said. He said because there were no grounds of judgment, his appeal, which was to have been heard today, had to be postponed. Chong filed the appeal on Sept 12, 2022, arguing that allowing the government to sue individuals for defamation was a dangerous erosion of freedom of speech and that the judgment posed a threat to democratic rights across the Commonwealth. The judge who presided over the trial was a judicial commissioner at the time.

Najib's royal addendum bid: Apex Court to rule on A-GC appeal tomorrow

KUALA LUMPUR: The Federal Court will decide tomorrow whether Datuk Seri Najib Razak can press ahead with his bid to confirm the existence of a royal "addendum" that could see him serve the rest of his sentence at his home. The decision marks the Attorney-General's Chambers' (A-GC) final throw of the dice to block Najib's judicial review, which seeks to compel the government to reveal and enforce the alleged order said to have been issued by the 16th Yang di-Pertuan Agong. Najib insists the addendum, made alongside the partial pardon that halved his jail term from 12 to six years, allows him to serve his remaining time under house arrest. If the apex court allows the A-GC's appeal, the former Pekan member of parliament's judicial review bid over the alleged royal addendum would come to an abrupt end before High Court judge Hayatul Akmal Abdul Aziz. If the A-GC's appeal fails, the case will proceed to be heard on its merits at the lower court. During the last proceeding, Senior Federal Counsel Shamsul Bolhassan said A-GC did not dispute the existence of the royal addendum but challenged the procedure by which it was introduced as new evidence in Najib's judicial review. Meanwhile, Najib's lawyer, Tan Sri Muhammad Shafee Abdullah, argued that the A-GC should not claim the decree is speculative at the leave stage of a judicial review if it truly embraces the principles of honesty, transparency, and openness. The senior lawyer had said the obligation to be truthful in this judicial review does not require his client to procure a copy of the addendum decree. He said it is the Attorney-General's responsibility to confirm or deny the existence of the addendum decree at the leave stage if they dispute its existence. On Jan 6, a three-judge panel of the Court of Appeal, in a split decision, allowed Najib to initiate a judicial review to determine the existence of an addendum allegedly issued by the former Yang di-Pertuan Agong. The Court also permitted Najib to file additional affidavits in support of his application. Najib is currently serving a six-year prison sentence for misappropriating RM42 million from SRC International Sdn Bhd. The High Court originally sentenced him to 12 years in prison and fined him RM210 million. The decision was upheld by both the Court of Appeal and the Federal Court. However, following a petition for royal pardon on Sept 2, 2022, his sentence was reduced to six years and the fine lowered to RM50 million. Subsequently, Najib filed an application claiming the existence of an addendum order, allegedly signed by the 16th Yang di-Pertuan Agong, which would allow him to serve the remainder of his sentence under house arrest. The High Court had previously dismissed this application.
