Judge Musli Ab Hamid convicted Tony Kuswadi Martin, 42, on his own guilty plea to a charge under Section 15(1)(a) of the Dangerous Drugs Act 1952, punishable under Section 39C(1)(b) of the same Act. The Section provides for imprisonment of not less than five years and not more than seven years, and whipping of up to three strokes, upon conviction. Tony was also ordered to undergo two years of police supervision upon his release from prison. He was tested positive for the two drugs at the Kuching Narcotics Criminal Investigation Division office at around 2pm on June 2, 2025. It was informed that the accused has two prior convictions, in 2017 and 2022, for the same offence. Md Khairul Rosli, 32, pleaded guilty before Judge Musli Ab Hamid to a charge under Section 392 of the Penal Code, which provides for imprisonment of up to 14 years, and a fine or whipping, upon conviction. He committed the offence by the roadside near Lorong Semariang Batu 12, Kampung Semariang Pinggir here at about 12.04am on May 29, 2025. According to the facts of the case, the victim and a friend had arranged to meet a man, later identified as Md Khairul, for the purpose of selling a used mobile phone. At the scene, the victim was coerced into surrendering not only the phone intended for sale but also his personal mobile phone. The victim believed that the accused had pressed a sharp object against his lower back to threaten him into handing over the items. A police report was subsequently lodged, leading to the arrest of the accused the next day. Investigations revealed that the accused had committed the robbery without the use of a weapon. Although the victim initially believed a sharp object was pressed against his back, it was later determined that the accused had used his finger to simulate the threat. An identification line-up was conducted and the victim positively identified the accused. The victim also identified the stolen phone, which was recovered and accessible using the correct password. He further recognised a blue jacket worn by the accused when executing the crime. Eyewitness testimony corroborated the victim's account and confirmed the accused's identity. The witness also identified the clothing worn by the accused, which matched the items seized during the investigation. Judge Musli Ab Hamid imposed the sentence on Tang Cheng Chong, 44, who pleaded guilty to the charge under Section 324 of the Penal Code, read together with Section 326A of the same Code. Tang committed the offence at a residential block along Jalan Sejingkat here on June 1, at approximately 10am. Based on to the case facts, Tang struck the complainant on the right cheek with a stainless steel thermos cup, causing her pain and a laceration on the affected area. The victim subsequently lodged a police report, leading to Tang's arrest the following day. Investigations revealed that the incident stemmed from an argument after Tang's beverage was accidentally spilled. The spillage occurred when the victim threw an article of clothing in his direction, inadvertently striking the cup and causing its contents to spill. In a fit of anger, Tang reacted by hitting her with the thermos cup. Section 324 of the Penal Code provides for a term of imprisonment which may extend to ten years, or a fine not exceeding RM2,000, or both, upon conviction. Meanwhile, Section 326A allows for the imposition of a sentence of up to twice the maximum term prescribed for the offence, notwithstanding any other penalty provided under the law. Kuching court fines man RM20,000 over illegal possession of nospan

Judge Musli Ab Hamid meted out the sentence against Mohd Aidit Alfian Abdullah after he pleaded guilty to the offence, which falls under Section 9(1) of the Poisons Act 1952 [Act 366] and is punishable under Section 32(2) of the same Act. Upon conviction, the provision allows for a fine of up to RM100,000 or a maximum of five years' imprisonment, or both. In delivering the sentence, Judge Musli took into account the submission by Deputy Public Prosecutor Umi Syukriah Harun, who highlighted the seriousness of the offence and its implications on public health and safety. The offence occurred on June 12, 2024, at approximately 12.10pm, at a shop located along Jalan Pelabuhan in Kuching. According to the case facts, Mohd Aidit was arrested during a raid conducted by a team of police officers. During the operation, he was questioned and voluntarily handed over a blue plastic container without a lid. Inside the container, police found 59 transparent plastic packets, each containing 12 white pills suspected to be dextromethorphan or locally known as nospan, totalling 708 pills. The items were seized as evidence, and the accused was arrested under Section 30 of the Poisons Act 1952. A chemist's report dated July 11, 2024, confirmed that the pills had a total net weight of 103.83 grammes, with dextromethorphan identified as the active ingredient. Dextromethorphan, typically found in many cough and cold medicines, is classified under the First Schedule of the Poisons Act 1952, making its possession without proper authorisation a punishable offence. Judge Iris Awen Jon imposed the sentence on the 34-year-old man after he pleaded guilty to a charge under Section 377CA of the Penal Code, which provides for an imprisonment term of between five and 30 years, as well as caning upon conviction. Iris ordered the prison sentence to take effect immediately. In delivering the sentence, Iris considered several factors, including the accused's guilty plea and mitigation; the facts of the case; the victim's age; the relationship between the victim and the defendant; the severity of the offence; and public interest. The offence was committed at a house in Serian on April 21. According to facts of the case, the complainant, who is the accused's wife, was changing their daughter's clothes while the child slept. Moments later, the victim appeared startled upon waking and did not behave normally. Concerned by the victim's condition, the complainant conducted a physical check and discovered redness around the child's genital area. The complainant suspected the child had been sexually assaulted and filed a police report, leading to a medical examination at Serian Hospital and further police action. The accused was apprehended by police at a car park near a hotel in Serian around 7.30pm on April 23. According to the police report, the victim had informed her mother that 'Ada Daddy kacau saya pakai tangan (Daddy disturbed me with his hand),' while pointing towards her private area. An examination by a clinical specialist from the Obstetrics and Gynaecology Department at Serian Hospital revealed a recent tear in the child's hymen. It is understood that the accused will also face charges in the Serian Magistrates' Court under Section 292 of the Penal Code for possessing obscene materials on his mobile phone.
