Repeat offender in Kuching sentenced to over five years' jail, caning for drug abuse
KUCHING (July 21): The Sessions Court here today sentenced a 40-year-old mechanic to five years and three months' imprisonment and one stroke of the cane for abusing amphetamine and methamphetamine.
Judge Iris Awen Jon meted out the sentence against Lai Muk Loi after he pleaded guilty to a charge under Section 15(1)(a) of the Dangerous Drugs Act (DDA) 1952, punishable under Section 39C(1)(b) of the same Act.
The Section provides for a prison sentence of between five and seven years, as well as up to three strokes of the cane, upon conviction.
In addition to custodial sentence, Iris also ordered Lai to undergo police supervision for two years following the completion of his prison term.
Lai committed the offence at the Narcotics Crime Investigation Department of the Bau District Police Headquarters at about 1.05pm on Jan 25, 2025 .
He has three previous convictions for the same offence in April 2015, June 2016, November 2019.

Kota Kinabalu: The court fixed Aug 28 for mention of the case involving a 42-year-old jobless charged with committing mischief and causing injury to his niece. Sessions Court Judge Amir Shah Amir Hassan set the date for Musa Matsalleh whose case was brought up for mention and fixed the date for the prosecution to serve all relevant documents to Musa. The court also granted the prosecution's application for both Musa's cases to be heard and consolidated as it involved same witnesses. On the first count, Musa is accused of committing mischief by burning the mattress and bed at 1pm on June 15 this year at a house in Kg Bambangan, Papar. The offence under Section 435 of the Penal Code carries a jail term of up to 14 years, and liable to a fine, on conviction. On the second count, he allegedly voluntarily caused hurt to his 14-year-old niece at the same place and time. Pending the date, Musa was ordered remanded further. Deputy Public Prosecutor Bryan Francis appeared for the prosecution while Musa was not represented. Meanwhile, eight illegal immigrants were jailed four months each for entering the State illegally. All the illegal immigrants aged 19 and 56, comprising Filipinos, pleaded guilty separately before Sessions Court Judge Hurman Hussain, to entering the State without their valid documents. The offence under Section 6(1)(c) of the Immigration Act 1959/1963 provides for a jail term of up to five years, or a fine of up to RM10,000, and whipping, on conviction. The illegal immigrants were arrested by the Immigration team who carried out operation in the city area this month (July). During the operation, they failed to produce their identification documents to the Immigration personnel. The illegal foreigners asked to be deported to their respective hometowns as soon as possible. The court ordered the illegal immigrants to serve the jail sentence from the date of their arrests. Duo fined for committing mischief

Kota Kinabalu: Two men were fined by the Magistrate's Court here on separate charges of committing mischief. Thomas Lai and Chew Vui Kian pleaded guilty separately before Magistrates Dzul Elmy Yunus and Marilyn Kelvin to committing the offence under Section 427 of the Penal Code. Lai was jailed four weeks and fined RM1,000 or two month's jail for damaging the driver's side window of a Toyota Land Cruiser with a knife at 9.40am, on July 17, at Taman Megarial, Luyang. Chew was fined RM1,200 or two months' jail for smashing the glass door of the Good Massage premises at Bataras Hypermarket, Inanam, using a ring spanner at 8.12pm, on July 19, causing RM350 in losses to the owner, Winsal Mursidi. In Lai's case, the court heard from the prosecution that the accused committed the offence on the vehicle after being dissatisfied with a court order delivered by the complainant's lawyer, requiring him to vacate a house. Lai approached the vehicle with a knife and stabbed its driver-side window, causing damage of about RM1,000. Unrepresented, Lai requested to be allowed, only to pay a fine saying that he was suffering from stage four nasal cancer, adding that the complainant had come to take back the house. The magistrate told Lai that because there was a court order for the complainant to take the house, he should have challenged it through legal means by hiring a lawyer instead of using a weapon. Lai said he was uneducated and did not know what to do, and claimed the complainant knew how to lodge a police report and had often threatened him before, but he never reported it. The prosecution urged the court to impose a deterrent sentence, saying Lai had used a dangerous weapon to intimidate the victim, causing damage and psychological distress. When delivering the sentence, the Magistrate said that, despite Lai's illness and age, using a knife was a serious offence that could have led to more severe consequences. The Magistrate said the court viewed the matter seriously, stressing that even if there was a dispute over the house, Lai should have sought legal redress instead of taking the law into his own hands, especially by using a sharp and dangerous weapon. Meanwhile, in Chew's case, the facts of the case presented by the prosecution stated that Chew smashed the glass door of the shop after arguing with his ex-girlfriend, who owns a shop near the complainant's shop. She informed the complainant, who then lodged a police report. Chew was arrested the next day, and police recovered the spanner used. Syabu: Duo get 7 years, 10 lashes

LAHAD DATU: Two men were sentenced to seven years in prison and ordered given 10 strokes of the cane, respectively by the Sessions Court, here, on Monday. Judge Suhaila Selag imposed the sentence to Adahar Zaini, 38-year-old local, and Hendrikus Herman, 28-year-old Indonesian, after they pleaded guilty to the charge against them. Adahar and Hendrikus were charged with having 32.63 grammes of syabu on March 22 by the roadside of Kampung Panji. Both of the accused were originally charged under Section 39B of the Dangerous Drug Act 1952 at Magistrate's Court on April 3. However, the charge was amended to Section 39A(2) of the Dangerous Drug Act 1952 after the chemist's report obtained the actual weight of the drugs.
