LAHAD DATU: Two men were sentenced to seven years in prison and ordered given 10 strokes of the cane, respectively by the Sessions Court, here, on Monday. Judge Suhaila Selag imposed the sentence to Adahar Zaini, 38-year-old local, and Hendrikus Herman, 28-year-old Indonesian, after they pleaded guilty to the charge against them. Adahar and Hendrikus were charged with having 32.63 grammes of syabu on March 22 by the roadside of Kampung Panji. Both of the accused were originally charged under Section 39B of the Dangerous Drug Act 1952 at Magistrate's Court on April 3. However, the charge was amended to Section 39A(2) of the Dangerous Drug Act 1952 after the chemist's report obtained the actual weight of the drugs. SANDAKAN: A 50-year-old illegal immigrant was jailed three years for being a middle person in prostitution activity. Sessions Court Judge Zaini Fishir @ Fisal meted out the sentence to Indonesian Lely Fiter, who pleaded guilty to the charge against her on Tuesday. Advertisement Lely had become the middle person for a woman for prostitution purposes at an apartment unit in Batu 5, here, July 29 this year. The court ordered Lely to serve the jail sentence from the date of her arrest and referred to the Immigration Department for deportation. In a related case, a 26-year-old woman was fined RM1,800 or three months' jail for offering sex service for RM150 per session. Zuraini Mohd Zaini pleaded guilty before Magistrate Nur Faezah Jafry, to soliciting for the purpose of prostitution at the same place and time as Lely. Advertisement The court heard that at about 3.30pm, a team of police officers from the D7 Division of the Sandakan District Police Headquarters had raided the house and found the woman in the act of providing sexual services. During the raid, the police also seized an opened packet of branded condoms, one used condom, a roll of used tissue, a mobile phone and RM150 in cash. Investigation revealed that each service was paid RM150 and the amount would be divided, RM100 Zuraini and RM50 for Lely who acted as the middle person in finding clients for the activity. Zuraini admitted to committing the act due to financial hardship. Kota Kinabalu: A 32-year-old man was sentenced to nine months jail by the Magistrate's Court for escaping from lawful police custody while at the Penampang Health Clinic, two months ago. Mohd Asroy Adonara, a freelance air-condition technician, pleaded guilty before Magistrate Marilyn Kelvin to have deliberately fled from police custody while being lawfully detained at the Penampang Health Clinic, Penampang, on June 6 this year, at 10.30pm. Advertisement Asroy, whose case came up for mention on Tuesday, changed his plea to guilty to the charge under Section 224 of the Penal Code which carries a jail term of up to two years or fine, or both, on conviction. He had on July 3 claimed trial to the charge. The fact of the case presented by the prosecution stated that on the morning of June 6, at 10.25am, Asroy was escorted by police personnel to the Emergency and Treatment Room of the Penampang Health Clinic after he complained of chest pains. Following an examination by a doctor, Asroy was placed on bed rest. Advertisement While the complainant was consulting medical staff regarding further treatment, Asroy suddenly leapt off the bed, pushed open the nearby emergency door, and ran out of the clinic compound in an attempt to flee. Police immediately pursued the accused and successfully re-apprehended him outside the clinic. Asroy was brought back into the clinic for further medical attention and handcuffed before being taken back to the Penampang police station lock-up, where he was placed in a cell without further incident. He was ordered to serve the sentence from June 6. In another case, an unemployed man was jailed seven months for having a stolen welding machine. Md Shaurey Masdi pleaded guilty to having the stolen machine at 3.30pm, on June 17, by the roadside of Kg Rampayan, Manggatal. The charge, under Section 411 of the Penal Code, carries a jail term of up to five years' imprisonment, a fine, or both, on conviction. The facts of the case, presented by the prosecution, stated that the item was stolen during a break-in at a premises in Manggatal. Kota Kinabalu: An owner of a licensed entertainment premises in Penampang was fined RM5,500 or eight months' jail for operating the premises beyond the permitted hours. Anthonio Petrus pleaded guilty to committing the offence at ON7, Donggongon Square, Penampang, at 1.50am on March 19. Advertisement The charge stated that Anthonio, who held a valid public entertainment licence issued under Section 5(1) of the Public Entertainment Ordinance 1958, was found operating the premises beyond the allowed time limit. He was charged under Section 4(1) of the same Ordinance, which is punishable under Section 11 of the same Ordinance, which provides for a fine of up to RM50,000, imprisonment for up to one year, or both, on conviction. The facts of the case presented by the prosecution stated that on the said day, the police found the ON7 entertainment premises had continued operating at around 1.50am, beyond the time permitted under its entertainment licence. During a police raid, several pieces of equipment were seized from the premises. Advertisement Anthonio, who was present during the raid and identified as the owner of the premises, was found to have breached the conditions of his entertainment licence by operating beyond the permitted hours. In another case, a 33-year-old man was fined RM100 or three days' jail for failing to explain cash deposits of RM2,350 into his bank account. Md Aidil Adha pleaded guilty to failing to explain the source of the money, which belonged to one Md Asry, deposited into his bank account in Putatan, near here, on May 15, this year. The charge, under Section 22A(1) of the Minor Offences Ordinance of Sabah, carries a penalty of RM100 fine or up to three months' imprisonment, or both, on conviction. According to the facts of the case presented by the prosecution, the victim, who was on May 8, came across a car sale advertisement on Facebook and later communicated with a man using two mobile numbers. Convinced by the explanation given, he transferred a total of RM5,850 to several bank accounts, including Aidil's account, but never received the promised vehicle, prompting him to lodge a police report.
