Samarahan online seller jailed total 36 years for drug trafficking, possession

KUCHING (July 11): The High Court here today sentenced an online seller to a total of 36 years in prison for trafficking 3.6675kg of cannabis, as well as for possession of cannabis and ketamine four years ago.
Judge Leonard David Shim handed down the sentence against Dayang Nurhanisah Awang Khalid, 39, after finding the prosecution had proven its case beyond reasonable doubt.
For the first charge, she was convicted under Section 39B(1)(a) of the Dangerous Drugs Act (DDA) 1952, punishable under Section 39B(2) of the same Act, for trafficking 3.6675kg of cannabis at a shophouse in the Samarahan Land District, Desa Ilmu, around 6pm on July 9, 2021.
The Section carries the death penalty or life imprisonment with a minimum of 15 strokes of the cane upon conviction.
For the second charge, she was found guilty of an offence under Section 6 of the DDA 1952 for possession of 18 grammes of cannabis at a house in Taman Desa Ilmu, Kota Samarahan, at 4.50pm on the same day.
The Section stipulates a maximum fine of RM20,000, or up to five years in jail, or both, upon conviction.
For the third charge, she was convicted under Section 12(2) of the Dangerous Drugs Act 1952, punishable under Section 12(3) of the same Act, for possession of 0.57 grammes of ketamine at the same location and time.
The Section provides for a fine not exceeding RM100,000, or imprisonment for a term not exceeding five years, or both, upon conviction.
Shim ordered for the prison sentences to run concurrently from the date of her arrest on July 9, 2021.
A total of 10 prosecution witnesses were called to testify in the case, while two witnesses, Dayang Nurhanisah and her daughter, were called for the defence.
Deputy public prosecutor Mohd Fillany Siji prosecuted the case, while Dayang Nurhanisah was represented by counsel Roland Thomas.

"A team from the Timur Laut criminal investigation division as well as the Pulau Tikus and Central police stations conducted an operation and detained the five Middle Eastern suspects," he said in a statement on Sunday (Aug 3). He added that police also seized multiple foreign currencies, two vehicles, and a packet of ganja. Mohd Alwi said preliminary urine tests revealed that two of the suspects tested positive for tetrahydrocannabinol (THC). He said the group's modus operandi was to approach foreign tourists for a conversation before asking them to reveal the cash in their possession. "The suspects will then take the money and leave the scene. It is reported that victims only realise their money is gone after the suspects leave," he said. He said all the suspects have been remanded for four days until Aug 6 and the case is being investigated under sections 379 and 380 of the Penal Code and sections 6 and 15(1)(a) of the Dangerous Drugs Act 1952. Alwi said they are committed to ensuring the safety of locals and tourists, and advised the public to be vigilant when dealing with unknown individuals, as well as to safeguard their valuables at all times. JITRA: Kedah police thwarted attempts to smuggle about 93.77kg of ganja valued at RM290,600 and arrested four men in separate raids around Bukit Kayu Hitam from July 30 to Aug 2. Kedah police chief CP Adzli Abu Shah said that in the first raid, at Taman Lama Ladang Rakyat Laka Temin, Bukit Kayu Hitam on July 30, they arrested an 18-year-old and seized three black plastic packets containing 55 packages of suspected ganja weighing 57,352.85g in a bush area. "In the second raid, on July 31, we found two black plastic bags containing 35 packages of ganja weighing 36,414g near the first location. No arrests were made. "We conducted a third raid at 9pm the same day and arrested a 19-year-old in a car near a petrol station in Changlun. "The fourth raid was carried out at 5pm on Saturday (Aug 2), where we arrested two more syndicate members, aged 24 and 28, at the Bukit Kayu Hitam Immigration, Customs, Quarantine and Security (ICQS) Complex,' he told reporters here on Sunday (Aug 3). The seized drugs are believed to be enough to supply over 187,000 addicts, he added. CP Adzli said three of the suspects tested positive for methamphetamine and had previous drug-related records and all the suspects have been remanded between four and six days to assist in investigations under Section 39B and Section 15 (1) (A) of the Dangerous Drugs Act 1952. — Bernama
