PKR'S leave to appeal bid in Zuraida's bond payment case set for hearing on June 24
PUTRAJAYA: The Federal Court will hear on June 24 an application by Parti Keadilan Rakyat (PKR) to seek leave to appeal against a Court of Appeal's decision which reduced the bond payment to be made by the party's former vice-president, Datuk Zuraida Kamaruddin, in a breach of party bond case.
PKR's lawyer, Navpreet Singh, when contacted, told Bernama that the hearing would proceed via online proceedings.
"A final case management was held before the Federal Court deputy registrar Husna Dzulkifly today (June 10), he said, adding that all parties have updated the court pertaining to compliance with pre-hearing directives relating to their submissions.
The case revolves around a civil suit filed by former PKR secretary-general Datuk Saifuddin Nasution Ismail, on behalf of the party, claiming that Zuraida, who was then the Ampang Member of Parliament, had breached the bond she had signed.
The terms of the bond, among others, required Zuraida to pay PKR RM10mil within seven days of winning an election on the PKR ticket, should she resign from the party, join another political party, or become an independent representative.
In June 2023, the High Court ruled in favour of the party and ordered Zuraida to pay the RM10mil, with the court finding the bond to be valid and enforceable.
However, in December last year, the Court of Appeal agreed with the High Court that there was a breach of bond but reduced the bond amount to RM100,000, citing that the RM10mil is not a reasonable amount of compensation. This prompted PKR to file a leave to appeal.
In her defence, Zuraida contended that she was forced to sign the bond with the party to be able to stand for election as a candidate in the 14th General Election (GE14) in 2018.
The Federal Court would now decide whether PKR can proceed with its appeal against the Court of Appeal's decision. In civil cases, litigants must obtain leave before they can proceed with their appeals in the Federal Court. – Bernama

Lorry driver fined RM6,000 for reckless driving, causing property damage
JOHOR BARU: A sand lorry driver was fined RM6,000 after pleading guilty in the Johor Baru magistrate's court today to driving recklessly and causing damage to several public properties along Jalan Johor Baru–Gelang Patah Pendas, in Iskandar Puteri, last Tuesday. The accused, Chew Ah Sing, 69, entered the plea before Magistrate Nur Fatin Mohamad Farid after the charge was read out in Mandarin by the court interpreter. According to the charge sheet, Chew had driven the sand lorry on a public road without due care and attention, with the rear bucket left raised, causing it to strike overhead electrical cables. The incident resulted in damage to the cables, three electricity poles, a traffic light pole, a closed-circuit television (CCTV) camera, and a bus stop. The offence was committed at Kilometre 30.7 of Jalan Johor Baru–Gelang Patah Pendas at around 3.20pm on June 10. The charge was framed under Section 43(1) of the Road Transport Act 1987 (Amendment 2020), which carries a penalty of up to 12 months' imprisonment and a fine of not less than RM5,000 and not more than RM10,000. For a second or subsequent offence, the punishment may include up to 12 months' imprisonment and a fine of not less than RM10,000 and not more than RM15,000. In such cases, the offender's driving licence will be endorsed by the court, and a probationary licence may be revoked upon conviction. Deputy Public Prosecutor Amirah Tasnim Saleh prosecuted the case. In mitigation, the senior citizen, represented by lawyer Sharmaine Fairuz Mohd Zulkifli from the National Legal Aid Foundation (YBGK), pleaded for a minimum sentence, citing his monthly income of RM2,000 and financial responsibility for his wife, mother, and school-going child. However, Amirah Tasnim urged the court to impose a fitting sentence, as the accused's actions had caused damage to multiple public properties. The court imposed a RM6,000 fine, in default four months' imprisonment, and endorsed Chew's driving licence. On the day of the incident, media reports stated that a sand lorry with its rear bucket still raised struck overhead power lines, causing three electric poles to fall near a school. A video of the incident, recorded around 3.20pm and widely shared on social media, showed the lorry hitting the cables before the poles came crashing down. Iskandar Puteri district police chief Assistant Commissioner M. Kumarasan was quoted as saying that the driver claimed he was unaware that the rear bucket had not been lowered.

GOF foils RM462,000 rice smuggling operation in Kelantan
KOTA BHARU: The 9th Battalion of the General Operations Force (GOF) has seized RM462,000 worth of goods, including a trailer and 28,000kg of smuggled rice, near Jalan Kampung Air Gatal in Tanah Merah. GOF Southeast Brigade Commander Datuk Nik Ros Azhan Nik Ab Hamid said the trailer was intercepted around 7.30am during 'Op Taring Wawasan Kelantan', after officers observed suspicious activity. 'A check of the vehicle uncovered a large load of white rice believed to have been smuggled from Thailand for distribution on the local market,' he said in a statement today. The trailer's driver and his assistant, both locals, were detained and are suspected of acting as couriers in the smuggling operation. The case is being investigated under Section 20 of the Control of Padi and Rice Act 1994 and the seized goods have been handed over to the Kelantan National Padi and Rice Central Storage facility.
