SC directs Centre to set up special POCSO court on priority basis
The Supreme Court on Thursday directed the Centre to set up on "top priority basis" dedicated POCSO courts to exclusively deal with cases of sexual offences against children.
A bench of Justices Bela M Trivedi and P B Varale said due to the inadequacy of the number of exclusive courts for the Protection of Children against Sexual Offences (POCSO) Act cases, the timelines mandated under the law for completion of trials weren't adhered to.
"It is therefore expected that the union of India and the state governments shall take appropriate steps to sensitise the officials associated with the investigation of POCSO cases, and also to create dedicated courts to try POCSO cases on top priority basis," the bench said.
The top court further directed filing of chargesheets within the mandatory period stipulated in law besides completing trials within the prescribed time frame.
The apex court noted while majority states, with the funding from the Centre, complied with the directions for setting up exclusive courts for POCSO cases, in Tamil Nadu, Bihar, Uttar Pradesh, West Bengal, Orissa, Maharashtra, and a few other states, more POCSO courts were required given the pendency of such cases.
The top court had previously directed senior advocate and amicus curiae V Giri and senior advocate Uttara Babbar to submit state-wise details on the status of POCSO courts.
The apex court was hearing a petition underlining the "alarming rise in the number of reported child rape incidents" in a suo motu case.
The top court asked states to set up two designated courts in districts where the number of pending cases of child abuse under the POCSO Act was more than 300.
It made it clear that its July 2019 direction to set up one court in each district with more than 100 FIRs under POCSO Act meant a designated court would only deal with such cases under the law.

Delhi: 9-year-old sexually assaulted, killed, body stuffed in bag
In a gruesome murder that unfolded on Saturday evening, a nine-year-old girl was allegedly sexually assaulted and murdered by her 30-year-old neighbour at his house near Dayalpur in northeast Delhi, after which he stuffed her body in a suitcase to hide it, police officers said on Sunday. The accused went absconding shortly after the girl's family started searching for her. Police have identified him and have initiated a search, officers said. The grisly crime led to widespread outrage in the area, with the family members of the girl and locals staging a protest. Security personnel were deployed in the area to ensure law and order, officers said. According to police and the family members, the girl, a Class 5 student at a local government school and a resident of Dayalpur, left her house at around 7pm to give 'ice to another relative who lives nearby. While on her way, the accused, who lives in a second floor flat in a six-storey building in the area, allegedly asked the girl to come to his house on the pretext of delivering his house keys which had fallen on the road, police said. Locals and her family alleged that he had deliberately thrown the keys to convince the girl to come. Around 7.30pm, when the girl did not return, the family enquired about her from the relative, but they told him that she had not come to their house. The family then began a search. The family said they did not know who the original owner of the house was. The accused took advantage of the fact and absconded, said a police officer, asking not to be named. When the family came to know about the man's disappearance, they immediately broke open the door of his house. On entering, they found a suitcase on the floor. When they opened it, they found the girl's body stuffed inside, with injury marks on her lips and face. 'She was unconscious and unresponsive. She was partially undressed, and bleeding from her genitalia. We rushed her to a nearby nursing home, where doctors declared her dead. On examination, they found that she was sexually assaulted,' the girl's 42-year-old father said. Joint commissioner of police (east) Vijay Kumar said they were informed at 8.41pm Saturday. Police reached the spot, and found the girl had been taken to a hospital by her father, where she was declared brought dead. 'Prima facie, doctors observed visible injuries on her face and alleged sexual assault,' he said. Police suspect that the girl died due to smothering or strangulation. The exact reason will be established on the basis of a pending autopsy report. A case of murder and sexual assault was registered under sections 103 and 66 of the Bharatiya Nyaya Sanhita, and Section 6 of Protection of Children from Sexual Offences (Pocso) Act. Police said the accused is mini-goods vehicle driver, married and is originally from Hapur in UP. 'Teams are conducting raids to nab the accused, who has been identified,' said Kumar. The girl is survived by her parents, grandparents and two younger brothers. The crime sparked outrage in the area — locals and the girl's relatives allegedly vandalised the house of the accused on Saturday night, while on Sunday, nearly 200 people staged a protest at Dayalpur Nala Road, disrupting traffic movement. Security personnel, including personnel from Tripura State Rifles, were deployed in the neighbourhood. Political parties also reacted to the grisly crime. The AAP criticised the ruling BJP — former chief minister Arvind Kejriwal said the law and order situation has worsened under the current regime. While Delhi BJP chief Virendra Sachdeva too condemned the crime and demanded arrest of the accused, he hit back at the AAP for politicising the issue. 'To reduce these incidents to mere law and order issues is political cunningness.'

Private school managements threaten to withhold admissions until payment of pending fee reimbursement
Private unaided school managements' associations in Andhra Pradesh have said they will withhold admissions under Section 12 (1) (C) of the Right of Children to Free and Compulsory Education Act, 2009, until the government implements the provisions of the Act in letter and spirit. The clause mandates unaided private schools to reserve 25% of their entry-level seats for children belonging to the economically weaker section and disadvantaged groups. In a letter addressed to the State Project Director of Samagra Shiksha, representatives of various associations like Independent Schools' Management Association (ISMA) and Andhra Pradesh Private Unaided Schools' Management Association said they were not against implementation of the Act, but insisted that it be done in its true spirit. They said, along with Section 12 (1) (C), Section 12 (2) of the Act, which mandates determining the per-child expenditure (PCE) incurred by the State government as per the rules and reimbursing either the school fee or the PCE, whichever is lower, as clearly stipulated in the RTE Rules (G.O. Ms. No. 20, Section 10), should be implemented. They also raised the issue of ineligible applicants (who are not underprivileged as defined in the Rules) securing admissions, possibly by using others' Aadhar cards, leading to altered residence and income details. They said, besides violation of the rule pertaining to the distance of the selected school from the applicant's residence, there were issues of incorrect date of birth entries, misuse of caste category, sibling category being claimed through cousin's children, misuse of orphan category through grandparents' details and multiple applications. 'It is unfortunate that schools are being pressured to admit every allotted student without undergoing proper verification process,' said ISMA president K. Sreekanth Babu. He pointed out that schools had not received any fee reimbursement from the State government for Section 12 (1) (C ) admissions over the past three years, and that as per the rules, fee reimbursement should be paid directly to the school's account in two instalments — in September and January every year. The representatives were upset that the authorities concerned had not yet determined, or notified the fee reimbursement for the upcoming academic year 2025-26, which should have been done prior to admissions as per the Act and Rules. They clarified that they were unwilling and unable to admit the allotted students without proper verification and until the fee reimbursement was duly notified and implemented as per Section 12 (2) of the Act and Section (1) of the RTE rules. They said they would also be unable to continue accommodating students admitted in their respective schools under this Act unless payment of the pending fees was made to them.

Fingerprint scanners in districts: Centre's revised procedure for foreigners ID portal
After facing technical issues in uploading biometrics of detected illegal migrants on Foreigners Identification Portal (FIP) of the National Automated Fingerprint Identification System (NAFIS), the Centre has revised the procedure for the portal and asked states/UTs to now use fingerprint scanners available in districts under districts police module (DPM) of Immigration Visa Foreigner Registration Tracking system (IVFRT). The MHA in a communication earlier this month said that it has decided to review the tools of DPM and FIP for the deportation of illegal migrants with all stakeholders and found that several states/UTs were facing issues regarding digitization of fingerprints captured on paper and sending it to the NCRB for digitization. An official said that this led to 'certain gaps between data of taking fingerprints on paper by manual scanning as compared to digital record'. The official said, 'It has been decided by the Centre that the infrastructure and equipment of NAFIS will not be used for collecting of biometrics of detected illegal migrants on the FIP portal… Now onwards, the fingerprint scanners available at district under DPM of IVFRT will be used.' To facilitate deportation of illegally staying Rohingyas, the MHA had launched a portal in 2018 to collect biographic and biometric details after giving access to all states/UTs, the communication said. 'The DPM was rolled out in 2023 to enhance the capabilities for identification of overstaying foreigners and later the portal was upgraded into a comprehensive portal — FIP to cover illegal migrants from all countries. It was then decided that for capturing biometrics of illegal migrants in FIP, NAFIS machines provided by the NCRB, will be utilised and that biometric data will be captured in the standardised format for inter-operable use,' the official said. The NCRB three years ago had implemented the NAFIS project, providing equipment to all districts, police commissionerates, state fingerprint bureau, the central fingerprint bureau and central law enforcement agencies to establish a national repository of criminal fingerprints. Also, the fingerprint identification system of all States/UTs has been integrated with NAFIS, creating a national repository of 1.06 crore criminal fingerprint records till October 31 last year. Later, the database of FIP was also added in the NAFIS. After reviewing, it has been decided that fingerprint, scanners, computers and webcams will also be provided to police stations, especially in the identified hotspots, in the holding (detention) centres and also in the Border Out Posts (BOPs) manned by the Border Guarding Forces for collection of biometrics of detected illegal migrants, and uploaded by agencies concerned on the FIP. '…the Ministry of External Affairs will take further action for getting nationality verification of the cases of illegal migrants, referred to them on the FIP Portal by the Foreigners Registration Office (FROs),' an official said. 'The Bureau of Immigration has been made the nodal authority at the Central level through Foreigners Regional Registration Office (FRROs) for the FIP and they have to ensure two things: the migration data from the FIP to IVFRT system and data will not be transferred to the NAFIS now onwards,' a senior official said.
