Centre notifies rules for compounding of offences under Drugs & Cosmetics Act

New Delhi: The union health ministry has notified the Drugs & Cosmetics (Compounding of Offences) Rules 2025 to allow minor offences to be settled by fine or penalties.
This is applicable to any pharmaceutical company, or any other person(s) involved in manufacture, import, sale, distribution or other activity covered under the Act.
Any company or person can file an application for compounding offence—a mechanism that allows companies to avoid legal proceedings and settle the matter by paying a fine. However, only a first-time offenders will be considered for penalty, and repeat offenders have to pay a fine and face imprisonment.
Under the application, along with the name and address of the applicant, he/she has to furnish other details like name and composition of the product, manufacturing license, manufactured or imported by, exported or import code, brief facts of the case and particulars of the offence, details of show cause notice, whether it is a first time offences etc.
This follows the notification of the Jan Vishwas Act 2023 which converts several fines to penalties of up to ₹ 5 lakh, meaning legal prosecution is not necessary. It also removes imprisonment as a punishment for many offences.
The stated objective of the Act is to de-criminalize certain offences to promote ease of doing business.
'The Drugs & Cosmetics (Compounding of Offences) Rules 2025 have been notified so as to avoid legal proceedings in the court for small offences. Relevant penalties have been defined in the Jan Vishwas Act. A Compounding Authority will be constituted to look after the matters Compounding Authority having rank of officer,' said a government official.
'Offences like misprinting in labels of the medicine packaging, or over-writing, or logistic issues, or not displaying all the list of medicines etc, will be considered as minor offences and a person cannot be put in jail for this – basically, an offence which is unintentional in nature, but quality and safety of the medicines should not be compromised,' the official added.
The compounding authority has been empowered to grant immunity to a company or a person from prosecution and withdraw the same on certain conditions.
The immunity can be withdrawn if the person or company fails to pay the penalty, or is found to have concealed any particular material or given false evidence.
This assumes importance as the pharmaceutical sector is expected to reach $100 billion by 2025 owing to the robust domestic manufacturing base with over 10,500 manufacturing facilities.
Queries sent to the health ministry spokesperson remained unanswered.

Police spokesman said that Srinagar police have attached orchard land measuring 3 kanals and 18 marlas, valued at approximately ₹1 crore, belonging to designated terrorist Asif Maqbool Dar who is presently operating from across the border. 'The property is located at Bandi Payeen, district action has been taken in connection with FIR No. 107/2020, registered at Police Station Parimpora, under Sections 124A, 153A, 295A IPC and Sections 13, 18 & 38 of the Unlawful Activities (Prevention) Act - UAPA. Proceedings were initiated under Section 25 of the UAPA, which empowers authorities to attach property used or intended to be used for terrorist activities. The attachment was carried out in the presence of the concerned Executive Magistrate,' the spokesman said. Police said that the property is formally held in the name of his father, Mohammad Maqbool Dar of Bandi Payeen, Baramulla, presently residing at HIG Colony, Bemina, investigations have established that Asif Maqbool Dar is an active stakeholder. 'He (Asif) has been involved in facilitating terrorism, spreading anti-national propaganda, and inciting disaffection against the government through various social media platforms for several years,' the spokesman said, adding that the Ministry of Home Affairs, Government of India, has already designated Asif Maqbool Dar as a terrorist. 'The attachment of his property is part of a larger and ongoing strategy aimed at disrupting the financial, logistical, and operational ecosystem of terror networks and their cross-border sponsors. This decisive action by Srinagar Police is intended to send a clear and strong message: those engaged in anti-national and terror-related activities will face strict legal consequences, including forfeiture of their assets.' Meanwhile Anantnag Police also attached immovable property of an active terrorist in Bijbehara south Kashmir. Police spokesman said that Anantnag Police, in its continued crackdown on the terror ecosystem, has attached immovable property belonging to an active terrorist under relevant provisions of law. 'The land falling under Khasra No. 165 MIN, situated at Guree, Bijbehara, and owned by Adil Hussain Thoker of Guree, Bijbehara, an active terrorist, has been attached under Section 83 of CrPC. The action has been taken in connection with FIR No. 11/2023 registered under Sections 20, 38 of the Unlawful Activities (Prevention) Act (UAPA) and Sections 2/3 of the EIMCO Act.' The spokesman said that this attachment is part of lawful measures aimed at dismantling the support structure of terrorism in the district. A professor from a Delhi University (DU) college, booked earlier this year for allegedly sexually harassing and abusing a minor student, may now be terminated from service with the college's Internal Complaints Committee (ICC), which has been probing the matter since last December, recommending his dismissal. The recommendation is currently under consideration by the Vice-Chancellor, The Indian Express has learnt. Sources at DU said the process of termination of the professor – booked under the Protection of Children from Sexual Offences (POCSO) Act and the Bharatiya Nyaya Sanhita (BNS) – is in motion. 'The ICC has recommended that the professor be removed. The final nod is awaited from the Vice-Chancellor. Before making a decision, the administration has said that the case documents should be studied in detail,' said a senior DU official. The survivor, a minor student, had submitted a complaint to the ICC in December 2024, alleging sexual harassment and assault. According to official DU sources, while its probe was at the preliminary stage, the ICC recommended that the accused be kept off campus and barred from interacting with students until the inquiry was completed. Earlier this year, the Delhi Police had booked the professor. A senior police officer had told The Indian Express in May, 'He has not been arrested yet, but the police will soon call him in for questioning.' Officers said the college administration has been asked to provide all details related to the professor. This January, after day-long protests by student bodies on the campus, the professor had stepped down from his administrative responsibilities. In a letter to the Vice-Chancellor, he had written, 'Due to these allegations, I am finding it extremely challenging to continue my additional duties.' The same month, the college had confirmed that he had been suspended for six weeks. The principal of the college declined to respond to queries from The Indian Express. This case adds to a troubling pattern of allegations against the same professor. It is learnt that three prior complaints of misconduct had been filed against him with the ICC in 2016, 2020, and 2023. 'Each time, the complaints were buried. No action was taken… There was always pressure not to escalate,' said an official. Student groups, meanwhile, have alleged institutional negligence in dealing with repeated complaints against the professor.

Madurai: on Tuesday directed the commissioner of Madurai corporation to constitute special teams to verify the correctness of the property tax assessments of all buildings in Madurai city. Tired of too many ads? go ad free now Pursuant to an earlier order, a special investigation team (SIT) headed by deputy inspector general of police, Madurai range, Abhinav Kumar, was formed, and a probe is underway into the property tax scam in Madurai corporation. On Tuesday, the state submitted that the investigation in the case was accelerated by the SIT. The SIT officials also sought the past 10 years' data from the director of municipal administration about the property tax assessment of buildings within Madurai corporation limits. The investigation is being conducted from all angles. A division bench of justice S M Subramaniam and justice G Arul Murugan observed that it was brought to the notice of the court by the petitioner that the undervaluation of buildings for assessing the property tax is also a concern, which should be investigated by the police to initiate appropriate actions for misappropriation of corporation funds. Hence, the judges directed the corporation commissioner to constitute special teams to verify the correctness of the property tax assessments of all buildings in Madurai city to ensure that correct assessments are made for all properties in accordance with the Act rules. The court then adjourned the hearing to Wednesday (Aug 20) for the commissioner to file a report regarding the constitution of special teams. The court passed the order while hearing a public interest litigation filed by T Ravi, AIADMK councillor of ward 83 of Madurai corporation. The petitioner stated that a huge scam in the assessment of property tax in the corporation came to light in 2024. He alleged that several corporation officials, in connivance with the zonal chairpersons, were involved. Tired of too many ads? go ad free now Ravi further alleged that the scam resulted in a loss of more than 200 crore revenue to the corporation. He stated that police took action only against low-profile people and have not taken action against the real culprits who have political influence. Hence, the petitioner moved court seeking a CBI probe into the scam. During the earlier hearing, the court observed that a scam of this magnitude had to be investigated by an IPS officer, which should be monitored by higher authorities to ensure there are no lapses and no higher-level people are left out from the ambit of prosecution. All responsible and accountable for causing a huge loss to the corporation should be prosecuted. Hence, the court directed the constitution of an SIT.
