
HC frees Margadarsi from criminal liability in 18-yr-old case
A division bench comprising Justice P Sam Koshy and Justice K Sujana ruled that the case stood abated following the death of Ramoji Rao last year. The court held that in the absence of the main accused, further prosecution of the company could not continue effectively.
The ruling thus brings a long-pending legal battle to a close, nearly 18 years after the original case was filed.

The AP govt had alleged that Margadarsi collected public deposits without legal permission, violating provisions of the Reserve Bank of India (RBI) Act.
The firm, however, argued that it was functioning as a Hindu joint family business, which is not prohibited under law, and that the restrictions cited in the RBI Act applied only to non-banking financial companies.
The RBI opposed this argument, asserting that the charges were against the corporate entity, not just Ramoji Rao. It said the business operations of Margadarsi Financiers were still active, and the legal question of whether it had accepted deposits in violation of the RBI Act remained unresolved.

Therefore, it argued, the case should not be dismissed on the grounds of the founder's death.
However, Justice Koshy, announcing the court's decision, stated that prosecution could not move forward in the absence of the key individual accused and allowed the company's plea.
Margadarsi was represented by a team of senior advocates, including S Nagamurthy, Mukul Rohatgi, and Siddharth Luthra. The RBI was represented by senior counsel L Ravichander, and the AP govt by public prosecutor Palle Nageshwar Rao.
The high court also closed the petitions filed by the current management of the company seeking to be made parties in the case. Since the main petition was allowed and the criminal cases quashed, their applications were declared closed.

HC lauds successful relocation of hawkers in Meghalaya
Agency: PTI Shillong, Aug 5 (PTI) The Meghalaya High Court on Tuesday lauded the 'peaceful and successful" implementation of the relocation of roadside vendors from Khyndailad area here. The court's observation was based on a report submitted by Special Officer Subhasis Chakrawarty, who was appointed by it to supervise the process. 'It appears from this report and the submission made before us that the exercise has been peaceful and successful," a bench headed by Chief Justice I P Mukerji said. According to government records, a digital survey conducted between December 2023 and January 2024 identified 1,400 street vendors across 23 locations in Shillong. Of these, about 760 vendors were found to be eligible under the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014. In the Khyndailad area alone, 457 vendors were surveyed and 407 declared eligible. The Shillong Municipal Board has since begun relocating the licensed vendors to designated vending zones in various parts of the city. As part of the rehabilitation process, the state government has sanctioned Rs 20,000 per relocated vendor as compensation, and on Tuesday, the first installment of Rs 10,000 was disbursed to hawkers, who had shifted to the new vending zones. However, the Shillong Roadside Hawkers' Association submitted representations on July 25 and August 1, alleging that several eligible vendors were arbitrarily left out of the final list and denied vending certificates. Taking note of the complaints, the Special Officer wrote to the Chief Executive Officer of the Shillong Municipal Board on July 29, seeking a response. The Board's counsel assured the court that a detailed affidavit would be filed. The case will be heard again on August 13. Man sentenced to 20 years of rigorous imprisonment for setting nephew ablaze
The Thiruvananthapuram Additional Sessions Court on Tuesday sentenced a 63-year-old man to 20 years and seven months of rigorous imprisonment for setting his 11-year-old nephew ablaze over a false accusation of theft in 2014. Additional Sessions Judge Shibu M.P. who found the accused, George Titus of Kulathoor, guilty of the crime also slapped a fine of ₹1,55,500. He was found guilty for crimes under Section 307 (attempt to murder), 326A (voluntarily causing grievous hurt by use of acid, etc), 341 (wrongful restraint) of the Indian Penal Code, and provisions of the Juvenile Justice (Care and Protection of Children) Act, 2020. According to the prosecution led by Special Public Prosecutor Ajith Prasad J.K., the incident occurred on May 22, 2014 under the Pozhiyoor police station limits. Hands tied George, a cousin of the survivor's mother, falsely accused the then Class VI student of stealing money from a neighbour. He then tied the hands of the child, dragged him to the kitchen, poured kerosene on him, and set him on fire. The child sustained grievous burns and was hospitalised for several months during which he underwent multiple surgeries. The court observed that the assault resulted in permanent disfigurement and disability for the child. The survivor, now a young adult, suffers from fused fingers, arms fused to the shoulders, and neck fused to the chest, rendering him unable to lift his head. Considering the brutality of the act and the lifelong suffering inflicted upon the survivor, the court ruled that the convict did not deserve any leniency in sentencing. The prosecution presented 12 witnesses and produced 18 exhibits.
