Bombay HC sets aside man's conviction, death penalty for rape of 2-year-old girl

The Bombay High Court on Wednesday set aside a February 2022 trial court verdict that convicted and sentenced a labourer to death for raping a two-and-a-half-year-old girl in Pune district in February 2021.
It directed the fast-track trial court to re-hear arguments based on additional evidence and decide the case afresh, in accordance with law and 'without being influenced' by the high court's order.
'Since this is a case of capital punishment, the court has to ensure that all opportunities are afforded to the accused to defend himself. The accused must get one opportunity to argue all aspects with respect to additional evidence before the trial court itself, so that he does not lose one forum,' the High Court said.
A bench of Justices Sarang V Kotwal and Shyam C Chandak passed the order while considering the state government's plea seeking confirmation of the death sentence awarded to Sanjay Baban Katkar, along with Katkar's appeal challenging his conviction.
According to police, in February 2021, the girl was kidnapped from outside her home while she was playing in the front yard. The investigation relied on the account of a rickshaw driver who had dropped a man and a child nearby, and a local woman who directed police towards the route taken by the man.
The girl was found dead inside a cement pipe next to a bridge, and medical examination revealed she was raped. Police arrested a brick-kiln worker, who was convicted and sentenced to death under Section 6 (aggravated penetrative sexual assault) of the Protection of Children from Sexual Offences (POCSO) Act. However, he was not sentenced for the offence of murder.
In his interim application appealing the conviction, among other claims, the worker argued that the forensic experts who prepared key DNA reports were not examined during the trial, denying him the chance to challenge their findings. He also sought lab records and worksheets to scrutinise the evidence. The high court, in July last year, had directed the trial court to comply with these requests, after which the record and proceedings were sent to the high court.
Advocate Rebecca Gonsalves, representing the accused worker, argued that the matter needed to be remanded to the special court in light of a Supreme Court judgment in another case with 'strikingly similar' facts and issues.
The high court referred to the SC judgment and found it 'necessary to remand back the matter.' It added that the trial court can consider additional evidence and ascertain its cumulative effect with other evidence. However, the trial court should not conduct a full re-trial or re-record all evidence.
'If this course is not adopted, then the accused would lose his valuable right to having the entire evidence appreciated by the first forum, i.e., the trial court. We are ensuring that this does not happen and he gets full opportunity to raise all grounds based on additional evidence before the trial court,' the bench noted.

The FIR was filed after a preliminary investigation and legal review of both the video message and a letter written by the deceased on July 22, addressed to the superintendent of police (SP), Datia. In the letter, ASI Paawan made similar allegations of harassment, illegal sand operations, and caste-based abuse. The ASI, who was posted at Godan police station for a year, died by suicide in the early hours of July 22. Just before taking the extreme step, he sent videos to his son and posted them on social media, accusing senior officers and a local sand mafia member of mentally harassing him after he stopped a vehicle involved in illegal sand transportation. In the video, Paawan alleged that the tractor he intercepted belonged to Bablu Yadav, a resident of Godan village, who was allegedly involved in the sand mafia and also operated gambling dens. He claimed that shortly after the vehicle was seized, Godan police station incharge Arvind Singh Bhadoria and constable Roop Narayan Yadav -- allegedly a relative of Bablu Yadav -- had the vehicle released and began harassing him. He also named Thorat police station in charge Hasan, alleging that he too was acting under pressure from Bablu Yadav due to the gambling activities in his jurisdiction. Paawan also stated that he was subjected to caste-based abuse and was being prevented from reaching senior officers. When his son tried to contact him after receiving the videos, Paawan did not respond. The family alerted police, who broke into his govt quarters and found him hanging in his room. Following the incident, SP Datia Suraj Kumar Verma removed Godan police station in charge Bhadoria from his post and assigned the probe to DSP AJK Umesh Garg. Speaking to TOI, DSP Garg said, "A case for abetment to suicide and under relevant sections of the SC/ST (Prevention of Atrocities) Act was registered against the incharges of Godan and Thorat police stations, a constable posted at Godan, and a local named by the deceased in the video, after a detailed probe on Friday night. Arrests are yet to be made."

New Delhi: The Supreme Court has set aside an order of the Jharkhand High Court which granted anticipatory bail to a man on a condition that he would resume conjugal life with his wife and maintain her with dignity and honour. A bench of Justices Dipankar Datta and Augustine George Masih noted that the man was an accused in a case registered under various sections of the erstwhile Indian Penal Code and under the Dowry Prohibition Act, 1961. "While considering the application for pre-arrest bail of the appellant, the court ought to have assessed whether the discretionary relief sought by the appellant for pre-arrest bail deserved to be granted within the settled parameters… but a condition such as the one impugned before us ought not to have been imposed in view of several decisions of this court," the bench said in its July 29 order. It said the high court should have considered the prayer for pre-arrest bail entirely on its own merit instead of imposing a condition, which is not traceable to section 438(2) of the erstwhile Code of Criminal Procedure. The lawyer contended that the man cannot now turn around and take a different stand. The bench said the counsel was partly right in the sense that the man had indeed agreed to resume conjugal life. "However, the respondent no.2 (woman) insisted for imposition of a further condition to which we do not find the appellant (man) to have agreed. The spouses seemingly, at one point of time, had drifted apart and resided separately for some time. Imposing a condition that the appellant would maintain the respondent no.2 with dignity and honour is beset with risk in that it can generate further litigation," the bench said. It said an application for cancellation of bail on the ground that such condition has not been complied with, if filed later, is bound to meet opposition from the man and could place the high court in further difficulty. "The impugned judgment and order, accordingly, stands set aside. The appeal is allowed," the bench said. It restored the anticipatory bail application on the file of the high court and asked it to decide it afresh on its own merits, as early as possible. The bench said till such time the matter is decided finally by the high court, the interim protection granted to the man by the top court earlier would continue. In its interim direction passed earlier, the top court had said the man be not arrested in connection with the case subject to his joining investigation as and when called upon to do so by the investigating officer.
