
SC takes 30 years to implement its own judgment on SC/ST quota
The judgment in R K Sabharwal case was delivered by a five-judge bench on Feb 10, 1995, during the tenure of 26th CJI A M Ahmadi, but it will be implemented now during the tenure of 52nd CJI in Justice B R Gavai, the second Dalit to head judiciary after Justice K G Balakrishnan.
CJI Gavai told TOI, 'The judgement in Sabharwal case recommended implementation of 200-point roster system for identification of posts for the SC and ST candidates in each category of posts.
The identification process is completed and from now onwards vacancies against each reserved post would be filled from the candidates belonging to that category of backward class candidates.'
Asked about non-inclusion of OBC quota in direct recruitments, the CJI said, "I have asked the SC Registry to initiate steps for amendment of the relevant Rules for inclusion of reservation for OBC candidates." After the Indra Sawhney judgment of 1992, a 27% quota in government jobs was introduced for candidates belonging to OBC communities, but the SC had capped the cumulative reservations at 50% of vacancies.
For the 200-point roster system, the SC has enumerated 1280 posts, majority of which comprise junior court attendants (600 posts) and junior court assistants (437). Of the total 1,280 posts, 191 has been earmarked for SC candidates and 93 for STs while the rest 996 posts would be for general category.
Since the judgment is of Feb 1995, and the central government circular is of July 1997, it is but natural that there would have been a huge backlog in filling the posts as per the roster system that intends to effectuate 15% and 7.5% quota for SCs and STs respectively.
CJI Gavai said, 'The backlogs will be gradually filled. This would mean sometimes the reservations in direct recruitments would cross the cumulative 22.5% mark.'
In the Sabharwal judgment, a five-judge SC bench led by Justice Kuldip Singh had said, 'The only way to assure equality of opportunity to the Backward Classes and the general category is to permit the roster to operate till the time the respective appointees/ promotees occupy the posts meant for them in the roster...
As and when there is a vacancy whether permanent or temporary in a particular post the same must be filled from amongst the category to which the post belonged in the roster.
'
'The cadre-strength is always measured by the number of posts comprising the cadre… Once the total cadre has full representation of the SCs/STs and Backward Classes in accordance with the reservation policy then the vacancies arising thereafter in the cadre are to be filled from amongst the category of persons to whom the respective vacancies belong,' it had said.

Haryana revises salary rates of part-time and daily wage employees
Haryana government on Wednesday said that the salary rates of part-time and daily wage employees have been revised and the increased rates will be effective from January 1, 2025. Similarly, if the salary of an employee has been fixed at ₹ 24,100 by the Nigam, then his daily wage has been fixed at ₹ 927 while per hour at ₹ 116. (File) A notification regarding this was issued by Haryana chief secretary Anurag Rastogi. Two salary slabs have been created as per the revised rates. Under the Haryana Kaushal Rozgar Nigam, if the monthly salary of a part-time or daily wage employee is ₹ 19,900, then his daily wage has been fixed at ₹ 765, and hourly wage at ₹ 96. If an employee works one hour a day in a month, he will get a salary of ₹ 2,487 per month. Similarly, if the salary of an employee has been fixed at ₹ 24,100 by the Nigam, then his daily wage has been fixed at ₹ 927 while per hour at ₹ 116. If an employee works for one hour per day in a month, he will get a salary of ₹ 3,012 per month. The government has also issued a notification amending the Haryana Civil Services (Leaves) Rules, 2016, to provide compensatory leave for Group-C and Group D government regular employees. Under the amended rule, if employees perform official duty on a notified holiday, they will be entitled to compensatory leave within a month. The state government has also decided to extend the contract period of employees working in departments, boards and corporations under Outsourcing Policy Part-2 by one month. Now the contract of these employees will remain effective till July 31, 2025.

Chirag vs Manjhi -- Duel of Dalits disorders NDA
Two most prominent Dalit faces in Bihar politics -- Jitan Ram Manjhi and Chirag Paswan -- are central ministers in the Modi cabinet. This must be enough for people to believe that there is no rift in the ruling National Democratic Alliance (NDA) and both these leaders are firmly behind the leadership of chief minister Nitish Kumar, asserted JDU MLC and party spokesman Neeraj Kumar on Wednesday. Chirag vs Manjhi -- Duel of Dalits disorders NDA The need for such a clarification, however, only unveils the discomfiture that the NDA's Dalit partners have brought upon the bloc at a time when the elections have entered the battle mode. The statement follows growing speculations that the two Dalit leaders are vying for bigger share in seat-sharing within the NDA and are also aiming to prove who is the number 1 Dalit leader of Bihar. They don't even shy away from taking potshots at each other. While Chirag has been fanning the state to exhibit his strength and has repeatedly claimed to contest the upcoming assembly election, Manjhi has called him someone 'lacking in maturity'. It's Manjhi's message to NDA that he won't play second fiddle in the alliance. 'A leader cannot claim only for the Scheduled Castes. A leader has to work for all the deprived and marginalised. It cannot be for one section only,' said Manjhi in response to Chirag's 'Bahujan Bhim Samagam' organised on Sunday in Nalanda and Rajgir. Manjhi also said that in Bihar, there are 23 Dalit sub-castes but only from among them are reaping maximum benefits, hinting that Dalit leadership has to take all along and make ways for everyone to grow. On his part, Chirag is trying to address all issues of Dalits, including their security. 'As long as I am there, no wrong can happen to Dalits,' he said in Sunday's gathering. Interestingly, he didn't clearly say that he would contest the elections, raising some doubts about clarity of his mind. His brother-in-law Arun Bharti, an MP, says that there is a growing demand from party workers in Shahabad region that Chirag should contest Assembly elections from there and play a decisive role in the state politics. But, Chirag remains indecisive. The bickering between the Dalit leaders is providing easy ammunition for the Opposition RJD that terms the rivalry as the 'reflection of intense infighting within the NDA'. However, the reality is that all parties, including RJD, are trying to woo Dalits and are coping with issues of their own to achieve this desired task that is pivotal to come through an important election for all of them. Dalits, according to the 2011 census, constitute 16% of the Bihar population. They are believed to have a decisive presence in around 15 Lok Sabha constituencies and 40-50 assembly segments. Analysts feel that Dalits are losing their strength because they are too scattered among a number of leaders and thus instead of them leading their own flock, others are eying to take their advantage. 'However, the problem with Dalit votes is that they are fragmented and have different political affiliations. This has resulted in different political parties having their own Dalit leaders, but so far none has been able to emerge as a unifying force for Dalits to lend them strength. Bihar Congress president Rajesh Ram and Jan Suraaj Party state chief Manoj Bharti are also from Dalit community. JD-U minister Ashok Choudhary is also another known Dalit face. BJP and RJD also have quite a few Dalit leaders. BSP of Mayawati is also flexing its muscles in Bihar, but presence of so many leaders sans any unifying face leaves space wide open for others to take lead. With chief minister Nitish Kumar not being in a good shape and no clue of his post-election move, everyone is sniffing a chance,' said DM Diwakar, former director of AN Sinha Institute of Social Studies. Even though Dalit leaders may still have to forge a united front, Dalits have been assertive and have been pressing for their demands actively. That's why the atrocities against them see immediate attention and all national and state leaders scramble to register their solidarity with them. One example is here of a recent and still burning controversy of RJD supremo Lalu Prasad Yadav allegedly showing disrespect to Dalit icon Babsaheb Bimrao Ambedkar on his 78th birthday. The BJP has been cashing it ever since and the RJD has to clarify it time and again. As the election moves forward, more and more leaders will court Dalits and many Dalit leaders will portray themselves as the beacon of the community and beneficiary of their votes.

New Delhi, July 2 (UNI) Marking the completion of one year as Leader of Opposition (LoP) in the Lok Sabha, Rahul Gandhi today highlighted his journey, sharing key moments, personal experiences, and his continued efforts to uphold the Constitution and amplify the voice of the people. In a social media post, Gandhi highlighted the central themes of his tenure so far including defending democratic values, presenting a clear economic vision for the country and connecting with citizens across diverse communities. "As I complete one year as the Leader of the Opposition in the Lok Sabha, I am sharing with you the memories, experiences, and my ongoing fight to protect the Constitution," he wrote. Gandhi invited the public to revisit his parliamentary speeches, which he said outline his vision for India's economy and shed light on the factors that led to the INDI alliance's success in the 2024 general elections. He visited 16 states, held 18 press conferences, addressed over 60 rallies, took part in more than 35 official events, delivered 16 speeches in Parliament, and participated in over 115 public interactions. Looking ahead, the Congress said Rahul Gandhi will continue to lead with a 'politics of love,' grounded in constitutional values and democratic principles.
