Calcutta HC directs Centre to implement MGNREGA scheme in West Bengal from August 1

The Calcutta High Court on Wednesday (June 18) directed the Centre to implement the MGNREGA scheme prospectively in West Bengal from August 1.
The HC said the Centre is empowered to impose special conditions, restrictions and regulations, which have not been imposed in other States of the country, so as to ensure that no illegality or irregularity occurs when the scheme is being implemented in the State.
Allowing the Centre to continue its enquiry into the allegations of irregularities in some districts of the State, a Division Bench presided by Chief Justice T.S. Sivagnanam directed that the scheme be implemented prospectively with effect from August 1.
The Court directed that the authorities in charge of the implementation of the scheme are entitled to impose special conditions to ensure that whatever had occurred three years prior should not recur.
The Court said that it is not in dispute that certain irregularities have been pointed out by the Centre in the disbursement of wages under the MGNREGA (Mahatma Gandhi National Rural Employment Guarantee Act) scheme.
The Bench, also comprising Justice Chaitali Chatterjee (Das), noted that with regard to allegations of irregularities, action has been initiated, recoveries made and that such amount is being maintained in a bank account of the state nodal agency of MGNREGS, West Bengal.
The Division Bench said that at this juncture, the endeavour of the Court is to ensure implementation of the scheme, which has been kept in abeyance for the past close to three years in the state.
The Court said that no one can allow a person who illegally took advantage of the scheme to go scot free.
'At this juncture, the court is concerned about the implementation of the scheme in West Bengal prospectively,' the Bench observed.
'The scheme of the Act does not envisage a situation where the scheme would be put to cold storage for eternity,' it said.
The Bench said that the Centre has sufficient powers to inquire into irregularities or illegalities in the manner of disbursement of the wages.
The Court said that there can, however, be a line drawn between past actions and future steps to be taken to implement the scheme.
It said that this would be 'in public interest' and subserve the object and purpose for which the central law was enacted.

He asserted that the Tamil community has long struggled to establish its historical significance through scientific means, only to face continued resistance from the Centre. Stalin called for a change in mindset rather than a revision of reports. The Tamil Nadu State Archaeology Department continued the excavation after the Centre's withdrawal, unearthing evidence of advanced urban planning, iron usage without a Bronze Age, and various artefacts such as brick structures, wells, ornaments, and children's toys. The DMK has vowed to make the Keeladi report a central issue in the upcoming Parliament session, threatening to halt proceedings until the Union Government recognizes the findings. The Calcutta High Court on Wednesday directed the Union government to resume implementation of the Mahatma Gandhi National Rural Employment Guarantee Scheme, or MNREGS, in West Bengal from August 1, Live Law reported. The Union Rural Development Ministry suspended MGNREGS funding to West Bengal in March 2022, citing widespread irregularities and alleged violations of the scheme's implementation rules by the state government. West Bengal received Rs 7,507.8 crore in the financial year 2021-'22 under MGNREGS but has received no funds in the following three financial years, the Hindustan Times reported. On Wednesday, a division bench comprising Chief Justice TS Sivagnanam and Justice Chaitali Chatterjee (Das) was hearing a case on the non-payment of MGNREGS dues to daily wage labourers after the Union government's allegations. The bench said that the Union and state governments may impose special conditions to prevent irregularities that marred the scheme's implementation, but it must be restarted prospectively. The court said that it was not in dispute that certain irregularities have been pointed out by the Centre in the disbursement of wages under the MGNREGS, according to PTI. While the Centre retains authority to investigate alleged misappropriations, this does not justify an indefinite suspension of the program, added the bench. 'All these allegations are from before 2022, you do whatever you want, but implement the scheme,' it further said. MNREGS was introduced in 2005 by the Congress-led United Progressive Alliance and is aimed at enhancing the livelihood security of households in rural areas. The scheme guarantees 100 days of unskilled work annually for every rural household that wants it, covering all districts in the country.

RAIPUR: National Investigation Agency (NIA) has chargesheeted a key accused in the case relating to the IED blast that had killed 10 District Reserve Guard (DRG) personnel and their civilian driver in Chhattisgarh by members of the banned CPI (Maoist) terror outfit in April 2023 in Aranpur of Dantewada district. According to NIA release, Bandra Tati alias Hunga has been charged under various sections of IPC, Explosive Substances Act, Chhattisgarh Vishesh Jan Suraksha Adhiniyam, 2005, and UA(P) Act. NIA found during investigation that Bandra Tati was the president of Dandakaranya Adivasi Kisan Majdoor Sangh (DAKMS), a frontal organisation of CPI (Maoist), in Acheli Village in Dantewada District, Chhattisgarh. He was involved in the transportation of the IEDs used in the attack, carried out in Aranpur with the aim to loot weapons of the security forces as part of a criminal conspiracy to wage war against the govt of India and strike terror in the minds of the people. Bandra Tati was in the possession of the prohibited explosive material, which he had received from senior cadres of the organisation. He had also attended conspiracy meetings organised by CPI (Maoist), as per NIA investigations. The state police, during initial investigations, had chargesheeted 26 accused in 2023 before NIA re-registered the case as RC-07/2024/NIA/RPR on 23rd February 2024. NIA is continuing with its further investigations in the case.
