Bill seeking to reduce delay in disposal of civil cases gets Presidential assent, gets notified

Efforts by the Karnataka government to reduce delay in disposal of civil cases has got a boost with the Code of Civil Procedure (Karnataka Amendment) Act getting the President's assent. The legislation, which makes mediation mandatory and sets a time-frame for such mediation, was published in the State gazette on Monday.
Addressing a press conference in Bengaluru, Law and Parliamentary Affairs Minister H.K. Patil said such an amendment was aimed at ensuring that any civil dispute is disposed of within 24 months.
The Minister said the new legislation makes it mandatory to try mediation to end disputes. While a deadline of two months have been prescribed for the mediation process, the courts will continue with the hearing if the process fails to yield results, he explained.
He said the Bill in this regard was adopted by the Assembly on December 17, 2024, and the Council on December 18, 2024, during the Winter session of the legislature in Belagavi. While the Governor had reserved the Bill for Presidential assent, the President gave his assent this May 19, he pointed out.
The Minister said the new legislation had made provision for setting time limits for various procedures including written statements and collection of evidence.

Patil stated that the Global Investors' Meet has been a success. It attracted proposals worth Rs 10 lakh crore. "We expect at least 70% of these proposals turn into a reality and the department is constantly following up with the companies", he added. The govt, in a bid to correct regional imbalance and facilitate setting up of industries in tier-two cities, has launched 'Beyond Bengaluru' scheme. The GIM too has focussed on this policy. 75% of the proposals have been asked to look for land outside Bengaluru and 40% of them in North Karnataka. Therefore, there will be industrial boom in North Karnataka very soon, he added. On FMCG cluster in Hubballi-Dharwad, Patil acknowledged that the land prices have shot up and the govt has nothing to do with it. Many farmers whose lands were identified for acquisition have moved to the courts seeking better compensation. Based on the verdicts of the courts on compensation, the KIADB has fixed the final price. However, the department is in constant touch with firms willing to set up FMCG units, he added. It will generate 800 direct and 900 indirect employment thus supporting 3,000 families. The company which manufactures batteries and convertors in collaboration with Japan and France has plans to expand its operation and will generate over 4,000 employment in next two years, he said. The product will be exported to US and other countries.

New York, June 3: India's Permanent Representative at the U.N., Mr. Rikhi Jaipal, has told the Security Council that 'there is a clear case' for imposing mandatory measures under the Charter against South Africa for its refusal to quit Namibia. Intervening in the Council's discussions on Namibia yesterday, he said the U.N. was fully justified to take these measures since all other steps had failed. The mandatory measures envisaged by him, though not specifically stated at the Council meeting, included an arms embargo, economic sanctions and severance of diplomatic relations with South Africa by all member States. Although India is not a member of the Council, it asked for the floor to reaffirm its views on the Namibian question. India has supported the case of the Namibian people for self-determination and independence right from the start. Mr. Jaipal said that the crux of the Namibian issue was the Security Council's resolution calling on South Africa to withdraw its illegal presence from the area and to transfer power to the people of Namibia 'with the assistance of the U.N.' But, he said, quite simply, the Pretoria Government 'does not accept that the U.N. has any role in Namibia.' 'We are thus in a quandary. The territory has international status but the U.N. has no effective role concerning it or the future of its people. There is a conflict here between 'de jure' responsibility and 'de facto' authority.'

1 2 Hyderabad: With uncertainty looming over the existence of the Telangana Waqf Board following the amendment of the Waqf Act 2025, the state govt has sought advice legal advice from the advocate general and law department on whether the existing board should continue. According to official sources, the govt has requested guidance on the matter. Meanwhile, the minority welfare department has reportedly directed Telangana Waqf Board chairman Syed Azmatullah Husseni not to convene any board meetings until further orders. The issue came to the fore after chairman Husseni wrote a letter to the chief executive officer of the board last month, requesting that a meeting be convened. As the amended Waqf Act has come into force and there is no stay on its implementation from the Supreme Court , Telangana waqf board CEO Md Asadullah sought the opinion on the matter. Sources noted that the chairman has been forwarding files to the CEO. Officials said that under Section 14 of the amended Waqf Act, the composition of the board has undergone significant changes. While elected members are allowed to complete their terms, all nominated members are required to step down. The state govt is mandated to reconstitute the board in accordance with the new provision of Section 14. While the state govt has been adopting a wait-and-watch approach, similar to other states like Karnataka, pending the Supreme Court's verdict on several petitions challenging the new Waqf Act. However, the recent board meetings and decisions taken by the chairman have placed the govt in a fix, prompting it to seek the opinion of the advocate general. However, the chairman, on his part, argued that the last Waqf board meeting was held in October 2024 and several public issues and grievances are still pending. He asserted that it is in the public interest to address these issues. "The board has every power to take up the issues, take decisions and pass resolutions," the chairman informed the govt.
