Bushiris file application to set aside ruling ordering extradition to SA

Self-proclaimed prophet Shepherd Bushiri and his wife, Mary Bushiri, have filed a review application to set aside the judgment ordering their extradition to South Africa.
The Bushiris filed their application before the High Court of Malawi in Lilongwe on Wednesday.
They claim they weren't given a chance to be heard, violating natural justice principles.

They argued the chief magistrate erred in law by breaching the fundamental principles of natural justice.
'The applicants humbly but firmly pray for the quashing of the findings that the requesting State made out a case for extradition… setting aside of the order of committal.'
In March, Malawi's Chief Resident Magistrate's Court ordered that the Bushiris be extradited following a request by South Africa.

Charges
They face at least six charges including rape, violating bail conditions, contraventions of the Financial Advisory and Intermediary Services Act, Banking Act, Civil Aviation Act and Immigration Act.
The couple fled to Malawi in November 2020, after being granted bail of R200 000 each under strict conditions in the Pretoria Central Magistrate's Court.

'Safety and security'
At the time, Bushiri cited 'safety and security issues' for their actions.
'There have been clear and evident attempts to have myself, my wife and my family killed. Despite our several attempts to report to authorities, there has never been state protection,' he said.
'We have come to a painful conclusion that what my wife and I have faced in the Republic of South Africa since 2015 is purely persecution, not prosecution.
'What is shocking is that it was me who, in 2018, opened cases of extortion and intimidation against the officers who are, today, investigating, arresting and prosecuting me and my wife of these several allegations. Obviously, there can never be independence and impartiality. It's purely acts of open vengeance,' Bushiri said.
The Malawian couple run a church known as Enlightened Christian Gathering with branches in various African countries.

Nonyane-Mpe said that an operation was underway to retrieve zama zamas that remained underground. "The plans in terms of the others that went deep, our members from Vala Umgodi, in collaboration with the mine security and also the Department of Minerals and Energy, will regroup and also esure that we communicate whatever action will be taken following this development."

JOHANNESBURG - Mpumalanga police have confirmed the arrest of an additional 24 illegal miners at the Sheba Gold Mine near Barberton. Last week, police arrested close to 500 illegal miners at the same site. They are expected to make their first court appearance on Monday on charges including possession of gold‑bearing material, contravention of the Immigration Act and trespassing. According to provincial police, the 24 newly‑arrested suspects allegedly went deeper underground when officers first uncovered the operation last week. They resurfaced on Monday after spending the entire weekend underground. Police said a firearm was found in the possession of one of the suspects. Man arrested in Limpopo days after brutal murder of Gauteng woman A 36-year-old man has been arrested in connection with the brutal murder of a missing woman from Eersterust, east of Pretoria city centre. According to Pretoria Rekord, the woman's body was discovered on Thursday, partially buried in an open field, just weeks after she was reported missing. Gauteng police spokesperson Captain Johan van Dyk says a dedicated five-member investigation team was established to pursue the case. 'The team immediately began following leads and gathering crucial information to piece together the events surrounding the murder.' He adds that as the investigation progressed, a possible suspect was identified. 'Information received indicated that the suspect had travelled to Polokwane. Acting swiftly, the team traced the suspect to a residence in Polokwane and, at approximately 02:00 [this] morning, a 36-year-old man was arrested.' Van Dyk says the man is expected to appear in the Pretoria Magistrate's Court on Wednesday, where he will face a charge of murder. Major-General Samuel Thine, the district commissioner of Tshwane, commended the investigative team for their dedication and hard work in bringing the suspect to justice. He also extended his gratitude to the families of the detectives for their continued support throughout the investigation.
