Justice Khanna appears before joint poll panel, flags vast EC powers

Former Chief Justice of India Sanjiv Khanna, who appeared before the Joint Parliamentary Committee (JPC) on One Nation One Election (ONOE) Bill on Tuesday, is learnt to have said that the Bill does not violate the basic structure of the Constitution in its entirety.
He is also learnt to have accepted the authority of the Election Commission in conduct of polls, but raised questions on the unfettered powers given to the EC on postponement of elections in the Bill.
Before Justice Khanna, four former CJIs — U U Lalit, Ranjan Gogoi, J S Khehar and D Y Chandrachud — had raised the issue of possible legal challenges to the Bill before the committee.
Justice Khanna is also learnt to have observed that while the stated intent of the Bill is to reduce the frequency of elections, this objective might not always materialise in practice, especially in cases of premature dissolution of legislatures.
At the same time, he expressed confidence in the maturity of India's democracy and political class. He is learnt to have highlighted that India has not witnessed any mid-term elections in the past few decades — a reflection of growing political stability and institutional resilience.
On the notification of appointment date by the President, Justice Khanna is learnt to have proposed replacing the current notification-based process proposed in the Bill with a fixed date within the Bill itself.
In a written submission to the committee submitted last week, Justice Khanna is learnt to have said that Clause 5 to the proposed Article 82A confers unfettered discretion on the EC to form an opinion that the elections to a Legislative Assembly cannot be conducted along with the general elections of the House of People, and to make a recommendation to the President to declare by an order that the election to that Assembly may be conducted at a later date.
This clause, Justice Khanna is learnt to have said in his submission, will be open to question as violating and offending the basic structure of the Constitution on the ground of being arbitrary and offending to Article 14.
He is also learnt to have submitted that postponement of elections by the EC may result in indirect President's rule, in other words the Union Government taking over the reins of the state government. This will be questionable judicially, Justice Khanna is learnt to have said, as violating the federal structure envisaged by the Constitution.

Bengaluru: The assembly Tuesday passed the Karnataka Municipal Corporations (Amendment) Bill, 2025, enabling municipal commissioners to regularise unlawful buildings by levying a penalty, a move that drew comparisons with the Akrama-Sakrama scheme still pending adjudication in the Supreme Court. Tired of too many ads? go ad free now Piloting the bill, urban development minister BS Suresha (Byrathi) said the amendment would apply only to unlawful buildings that can be regularised under existing building bylaws or relevant Acts. "This will not apply to buildings that have been ordered for demolition," he said. Under the provisions, municipal commissioners can issue occupancy certificates (OCs) by levying a penalty if they had not obtained commencement certificates (CCs) before construction. A penalty can also be levied for deviations from sanctioned plan or zonal regulation limit as may be specified in the bylaws. Suresha said the threshold for permissible building plan violations is being raised from 5% to 15%. He recalled that in Jan 2017, the Supreme Court stayed the Akrama-Sakrama scheme, which sought to regularise unauthorised urban buildings for a fee. "We cannot frame rules (for Akrama-Sakrama) as the matter is pending before the court. But we can regularise small sites," he said. "We will specify the size in the rules, but it'll be mostly 20x30 and 30x40 sites. We are exempting them from requiring CC and OC. This will help the poor and middle-class." He emphasised: "This is not the same Akrama-Sakrama scheme. Unlicensed properties are not being exempted from CC/OC requirement." Professionals to sanction plans The bill also allows municipal corporations to empanel professional architects, engineers, structural consultants, environment consultants and town planners as 'authorised persons' to inspect buildings before, during and after construction, sanction building plans, and certify compliance. In another key provision, the authority to sanction building plans will now rest with the commissioner or chief executive of urban local bodies (ULBs), instead of elected councils. Opposition members objected, calling it undemocratic. But Suresha said: "We are proposing to enable the commissioner or CEO to sanction building plans, as there are instances of the council not meeting for more than six months despite the norm that they must meet once a month. The proposed bill is being brought to ensure speedy issuance of plan sanction." Opposition members including CN Ashwath Narayan, opposed the clause making CC and OC mandatory for electricity connections. Suresha responded: "This clause is to comply with Supreme Court's directions."

MCD & NDMC Propose Reforms To Simplify Property Tax Assessment

New Delhi: To simplify the assessment of property tax and reduce chances of harassment to citizens, both the Municipal Corporation of Delhi and the New Delhi Municipal Council have proposed various reforms under the Jan Vishwas (Amendment of Provisions) Bill, 2025. Tired of too many ads? go ad free now The civic bodies proposed the conversion of imprisonment and fines into penalties for lapses or violations across several sectors mentioned under the DMC and NDMC Acts. According to the proposals in the bill, NDMC wants to implement the unit area method for the calculation of property tax instead of the rateable value of property for all properties in Lutyens' Delhi. Officials said this method was applicable in MCD areas since 2003-04, but only in certain places under NDMC. "This formula was implemented in NDMC from April 1, 2009, by incorporating it into a bye-law without amending the law," an official said. "Due to lack of any provision in the law for this, Delhi High Court quashed it in 2017. The Supreme Court upheld the high court decision in 2019, remarking that rateable value method could be implemented by amending the original Act." Meanwhile, traders in markets like Connaught Place, who are issued property tax bills as per the rateable or rental value method, have been consistently demanding changes and implementation of the unit area method for property tax calculation. Officials also accepted that the unit area method, which calculates property tax on the basis of six factors, namely unit area value, area of property, use factor, structure factor, age factor and tax rate, would bring transparency and fairness in tax determination. "However, adopting the unit area method will need changes in 47 provisions of the NDMC act," revealed an official. New Delhi Municipal Council proposes, in total, changes in the mode of decriminalisation in 105 provisions under the Act. Tired of too many ads? go ad free now This includes the conversion of imprisonment in certain cases to penalties, such as Section 298 ((1)& (2)) for the absence of sweepers, etc., from duty without notice. It also proposed the conversion of imprisonment and fines into penalties in some cases, such as Section 390 related to breaches of bye-laws. MCD has also proposed changes in the current legislation. One pertains to Section 123D (i) of DMC Act for 'no such assessment of property tax shall be done after the lapse of seven years from the closing of that assessment year.' "This means that MCD can carry out the assessment of tax for a property and generate bills at the most for seven years, unlike now when the civic body is raising bills from 2004 onwards (when the amnesty scheme was not in force) for properties where no tax was paid at all," explained an official. It also suggested changes in Section 153, which mandates that when a tax becomes due, the commissioner of MCD must present a bill for the amount due to the person liable for payment. MCD has proposed changes in its subsection I, which clarifies that the bill would be raised 'after carrying out a physical survey or collection of relevant data in respect of that property if it is being assessed for the first time.' Municipal Corporation of Delhi has also proposed amendments suggesting penalties for infractions as listed under Section 461 of the Delhi Municipal Corporation Act, which prescribes punishment or fines (as decided by the court or the civic body) for not disclosing property tax liabilities, not giving notice prior to the erection of a new building, not providing an instrument of transfer, and failure to give notice of devolution of land and building and other offences that lead to severe punishment.
