PAC calls for stronger enforcement to curb tax arrears, leakages

KUALA LUMPUR: The Public Accounts Committee (PAC) has urged the Inland Revenue Board (IRB) to step up efforts to reduce the risk of increasing accounts receivable and taxpayer appeals.
PAC chairman Datuk Mas Ermieyati Samsudin said the committee also recommends that IRB strengthen enforcement of existing tax laws while implementing improvements from time to time to enhance the management of accounts receivable.
"PAC acknowledges IRB's initiatives to enhance the management of accounts receivable, including internal improvements such as automating the issuance of tax arrears notification letters and expediting travel restriction procedures.
"Continuous monitoring must be carried out to ensure the effectiveness of the overall tax assessment process, along with more proactive enforcement of tax laws to curb leakages and fraud in tax payments," she said in a statement today.
Accounts receivable refers to the money owed to a business by its customers for goods or services that have been delivered or used but not yet paid for.
On the implementation of the e-Invoice system, Mas Ermieyati said PAC welcomes the government's initiative, which takes into account the commitments of taxpayers, particularly those in the Micro, Small and Medium Enterprise category, in complying with the legal requirements for e-Invoicing, and the need for sufficient preparation time.
She said PAC recommends that IRB provide comprehensive support and guidance to all taxpayers throughout the preparation phase for e-Invoice implementation.

'The company is currently seeking legal advice and evaluating its legal options, which may include initiating a formal appeal to the IRB,' Hartalega said.

KUALA LUMPUR: A member of Parliament has called for reform of the Inland Revenue Board (IRB), proposing that it be established as an independent statutory body accountable to Parliament rather than remain under the control of the Finance Ministry. Datuk Seri Dr Wee Ka Siong (PH–Ayer Hitam) said such reform is necessary to ensure a clear separation that prevents any influence from political interests or fiscal pressures faced by the government. "IRB must not be seen as a political tool and should follow the dictates of the executive, regardless of who is in power. "It should no longer operate directly under the Finance Minister, as it has done previously and continues to do now. "So, I propose that IRB be established as an independent statutory body under the oversight of Parliament," he told the Dewan Rakyat during the 13th Malaysia Plan debate here today. Wee cited examples of the Internal Revenue Service in the United States, which is monitored directly by Congress, and the UK's His Majesty's Revenue and Customs, which operates independently from ministerial instruction. He said these agencies have their own board of directors, and decisions related to audits or investigations cannot be directed by the government. Meanwhile, Wee said there has been a growing number of complaints from small and medium enterprises, who claimed that tax refunds have been delayed. "This creates the perception that the government is borrowing the people's money without interest," he said. He cited a recent case in which a taxpayer had applied for a RM13,000 refund, only to receive a response from IRB offering RM650, with the remaining amount to be paid over four years. "This shows why the power to determine tax interpretation, appeals and approvals for reliefs must be placed under an independent authority, one that is not subject to the influence of those currently in power," he said.

Kota Kinabalu: Malaysia has strengthened controls on foreign fishing vessels entering its waters through the Management System for the Entry of Foreign Fishing Vessels into Ports (e-PSM). Department of Fisheries Malaysia Director-General Datuk Adnan Hussain said the digital system was developed in line with international standards and under Section 15(2) of the Fisheries Act 1985, aimed at combating illegal, unreported and unregulated (IUU) fishing activities. 'This system manages applications for foreign vessels to enter the country's ports, improves control efficiency and supports Malaysia's commitment against IUU fishing. Any foreign vessel must obtain approval from the Fisheries Department before being allowed to dock at national ports,' he said. Through e-PSM, vessel owners must submit applications including information on entry dates, destination ports and catch details for assessment and entry approval. He said failure to implement such controls would be seen as supporting IUU fishing. Advertisement Despite not yet ratifying the Port State Measures Agreement, Malaysia remains committed to complying with the requirements outlined in the international agreement. The system ensures entering vessels are not in the IUU category and controls fish species landings to prevent violations of international regulations, including prohibited fish or species under the CITES list. Applications are reviewed with international bodies including Australia, the European Union and regional organisations such as the Indian Ocean Tuna Commission and Western Pacific Tuna Commission to verify vessel registration status. As of 2024-2025, a total of 20 foreign vessels have been approved to enter Malaysian ports, landing 550 metric tons of tuna and similar species at Penang Port.
